AS, AS MOST PEOPLE KNOW, THE AMERICANS WITH DISABILITY ACT IS, UM, A FEDERAL LAW THAT WAS ENACTED, UH, I BELIEVE, UH, 30 YEARS AGO, UH, REQUIRES, UH, COMPANIES AND PUBLIC, UH, ENTITIES TO HAVE, UH, UM, ACCESSIBILITY FOR THOSE WITH DISABILITIES. UM, FOR US AS A CITY, WE, ONE OF THE REQUIREMENTS IS FOR US TO DO IT AN AUDIT, A SELF-ASSESSMENT AND A, UH, HAVE A TRANSITION PLAN. AND, UH, THAT WAS IMPROVED IN THE, IN THE BUDGET THIS YEAR. AND WE, WE HIRED, UH, THE WT GROUP, UH, SPECIFICALLY JOHN MCGOVERN TO, TO LEAD US IN THOSE EFFORTS TO, UM, UM, DEVELOP THAT. AND HE'S HERE TO PRESENT A LITTLE BIT ABOUT AN OVERVIEW OF WHAT THEY'VE DONE AND, AND WHERE WE GO FROM NOW. SO I'LL GO AHEAD AND TURN THE TIME OVER TO JOHN. THANK YOU, JASON. UH, TONIGHT I WAS GOING TO BRIEFLY TALK ABOUT OUR SCOPE OF WORK, THEN REVIEW THE ADA TRANSITION PLAN REQUIREMENT THAT JASON REFERRED TO TALK A LITTLE BIT ABOUT SOME OF THE AMERICANS WITH DISABILITIES ACT POLICY MANDATES IN PARTICULAR, THE MOST INTEGRATED SETTING. UH, DESCRIBE OUR DELIVERABLES TO YOU AND JUST HIGHLIGHT A COUPLE OF THE KEY FINDINGS, UH, THAT WE DISCOVERED IN OUR WORK. I'LL DESCRIBE OUR TRANSITION PLAN. THAT'S A REALLY IMPORTANT PIECE OF THE ADA REQUIREMENTS FOR YOU, AND THEN TALK ABOUT SOME NEXT STEPS, UH, AND MAKE SOME CONCLUSION REMARKS. UH, JASON TALKED ABOUT THIS ALREADY, BUT THE NEXT SLIDE TALKS ABOUT THE SCOPE OF WORK. SO WE DID REVIEW EVERY ELEMENT OF EVERY ASSET AT ALL 37 CITY OF MISSOURI CITY PARKS AND FACILITIES. OUR ROLE THERE IS TO IDENTIFY BARRIERS. SO WE DOCUMENT THE BARRIERS WITH DIGITAL IMAGES. WE ARE CONTRASTING THE SITE CONDITIONS TO THE FEDERAL REQUIREMENTS, UH, THE 2010 STANDARDS FOR ACCESSIBLE DESIGN, AS WELL AS THE TEXAS ACCESSIBILITY STANDARDS THAT WERE PUBLISHED IN 2012 AND WHEREVER EITHER ONE OF THOSE ARE MORE STRINGENT. THAT'S WHAT THE CITY HAS TO ADHERE TO. AND THAT'S WHAT WE FOLLOWED IN OUR WORK AS WELL. WE THEN PUT TOGETHER A TRANSITION PLAN THAT IT'S JUST A PHASED SCHEDULE [00:05:01] OF RETROFITS. THERE'S BEEN A LOT OF DISCUSSION ABOUT TRANSITION PLANS IN A COVID ERA. UH, WE CERTAINLY RECOGNIZE THAT THE TRANSITION PLAN, ISN'T THE ONLY THING THAT THE CITY WILL BE ADDRESSING IN THE NEXT SEVERAL YEARS. SO I'LL TALK BRIEFLY ABOUT THAT. UH, MORE TOWARD THE END, WE ALSO IDENTIFY AS WE ARE PERMITTED TO DO, AND AS THE CITY IS PERMITTED TO DO ANY RETROFITS THAT ARE TECHNICALLY INFEASIBLE TO MAKE, BECAUSE THEY WOULD REQUIRE ALTERING A LOAD BEARING WALL OR ELEMENT. SO WHERE WE SAW THOSE, WE NOTED THOSE. THE CITY DOES NOT HAVE AN OBLIGATION TO MAKE THOSE CHANGES. OUR FIRM DOES THIS FROM TEXAS TO ILLINOIS, CALIFORNIA, TO MASSACHUSETTS. WE STARTED IN 2008 AND WE HAVE SERVED MORE THAN 410 CITIES AND OTHER UNITS OF LOCAL GOVERNMENT. WE DO WORK OUT OF OUR CHICAGO OFFICE, BUT WE HAVE OFFICE IN HOUSTON AS WELL AS IN DALLAS. THE NEXT SLIDE JUST TALKS ABOUT A COUPLE OF OTHER ITEMS RELATED TO OUR BUSINESS. AND JASON, I THINK WE CAN, I'LL HIGHLIGHT THE THIRD BULLET POINT. UM, TEXAS IS UNIQUE, NOT EVERY STATE HAS A PROFESSIONAL ACCESSIBILITY CREDENTIAL, UH, BUT TWO STATES, CALIFORNIA AND TEXAS HAVE SUCH A PRUDENTIAL. WE HAVE TWO STAFF WHO ARE REGISTERED ACCESSIBILITY SPECIALISTS, UH, IN THE TEXAS CREDENTIAL. SO THOSE WERE BOTH, BOTH OF THOSE EMPLOYEES WERE INVOLVED IN OUR WORK. I BRING A LITTLE UNUSUAL BACKGROUND TO THE TABLE. I HAVE A LOT OF GRI AND WORKED IN LOCAL GOVERNMENT FOR 30 YEARS. SO, UH, SEVERAL OF US ON OUR TEAM HERE ARE IMPLEMENTERS OF THE ADA AS WELL AS CONSULTANTS. UM, OUR PROCESS, JASON, IF WE CAN GO TO THAT SLIDE, LIKE I SAID, WE LOOK AT EVERYTHING. SO EVERY ASPECT OF EVERY ELEMENT AT EVERY SITE, AND WE USE A HANDHELD APP IN OUR SMARTPHONES AND IT INCLUDES THE FEDERAL ACCESS STANDARDS AND ANY MORE STRINGENT TEXAS REQUIREMENTS, WE DO ALSO RECOMMEND THAT THE CITY ADHERE TO SMART PRACTICES, THOSE ARE, UM, TECHNIQUES THAT ARE PROVEN TO BE EFFECTIVE IN MAKING SITES MORE USABLE. THOSE ARE CALLED OUT IN OUR REPORTS. UH, THEY ARE NOT A MANDATE, UH, BUT WE BELIEVE THAT THEY PROVIDE BETTER ACCESS FOR YOUR RESIDENTS. UM, WE DO, AS WE ARE AUDITING, UH, STORE OUR DATA IN THE CLOUD AND IT DEVELOPS A SITE REPORT THAT WE THEN TONE UP AND PROVIDED ALL OF THOSE TO JASON. UH, WE ALSO SOUGHT STAFF ADVICE ON FACTORS TO CONSIDER IN THE ORDER OF RETROFIT. AND THEN IN THE END, UH, PROVIDED TRANSITION PLAN THAT BALANCES THE MANDATES OF THE ADA, UH, THE COST OF RETROFITS AND OTHER PRIORITIES THAT WE'RE AWARE OF. THE NEXT SLIDE TALKS ABOUT OUR DELIVERABLES COVID DID AFFECT THIS PROJECT. UH, WE WERE AWARDED THE WORK, UH, LATE WINTER, EARLY SPRING, AND THAT WAS RIGHT AT THE PEAK OF THE SEVERAL SETS OF RESTRICTIONS. SO WE DID AS MUCH AS WE COULD REMOTELY, UH, WE MOVED A DEADLINE OR TWO, BUT THEN WHEN WE WERE ABLE TO GET TO MISSOURI CITY, WE DID AND WE GOT ALL THE AUDITS DONE AND THE REPORTS DONE AND OUR TRANSITION PLAN PHASE IS YOUR WORK OVER WHAT WE RECOMMEND AS AN 11 YEAR SPAN. AND IT'S IN A TOTAL AMOUNT OF JUST UNDER $2,800,000. WE DID PROVIDE A FINAL REPORT AS WELL. AND THAT REVIEWS, THE ADA REQUIREMENTS PROVIDES AN OVERVIEW OF FINDINGS BY TYPE OF ASSETS. SO FOR EXAMPLE, UH, WE SAW 17 PLAYGROUNDS. UH, YOU ALREADY HAVE SEVEN THAT ARE ACCESSIBLE. UH, WE RECOMMEND THREE MORE BE MADE ACCESSIBLE. UM, AND WE DO THAT TO IMPLEMENT THE DEPARTMENT OF JUSTICE PROGRAM ACCESS TEST. UH, WE ENCOURAGE YOU TO AIM FOR AT LEAST A MINIMUM OF THREE, ONE OF THREE OF EVERY TYPE OF ASSET THAT YOU HAVE BEING MADE ACCESSIBLE ON THE NEXT SLIDE. I START TO TALK ABOUT SOME OF THE KEY FINDINGS. PARKING IS ONE OF THE HARDEST REQUIREMENTS TO MEET IN THE AMERICANS WITH DISABILITIES ACT WORLD. UH, AND SO AS IT DOES EVERYWHERE, WE SAW THAT IT NEEDS ATTENTION HERE TOO. UH, PARKS, THEMSELVES [00:10:01] LACK ACCESSIBLE ROUTES WITHIN THE PARK. AND THAT'S JUST A FUNCTION OF THE WAY PARKS HAVE BEEN DESIGNED FOR DECADES, GRASS AND DIRT IS NEVER AN ACCESSIBLE ROUTE. SO THIS IS A PRETTY COMMON FINDING AS WELL. UH, THERE IS A RECENT SETTLEMENT AGREEMENT REGARDING PLAYGROUND SURFACE ACCESS, AND WE DID SEE SOME ISSUES WITH EXISTING PLAYGROUND SURFACES, UH, AND WE ALSO CONSIDERED MAKING THE MORE HEAVILY USED SITES, UH, AS A HIGHER PRIORITY. WE'VE GOT A COUPLE OF PICTURES COMING UP JUST TO SHOW YOU SOME OF WHAT WE SAW THROUGH OUR EYES. SO IT, LEXINGTON VILLAGE PARK PLAYGROUND SURFACES HAVE TO BE COMPACTED AND FIRM ENOUGH FOR SOMEBODY WHO USES A WHEELCHAIR TO ROLL OVER THEM, BUT THEY ALSO HAVE TO BE IMPACT ATTENUATING, UH, PRETTY TYPICAL IN THE SLIDE TO THE RIGHT TO SEE EMPLOYEES SPACES THAT LACK ACCESS OR VERY TIGHT, UH, EMPLOYEE SPACES ARE NOT EXEMPT, UH, AND DO HAVE TO MEET THE ACCESSIBLE ROUTE REQUIREMENTS. THE NEXT SLIDE, UH, SHOWS AGAIN, ONE OF THE MOST COMMON ISSUES AND THAT IS NONCOMPLIANT RESTROOM STALLS. JASON, CAN YOU ADVANCE THERE? SO THERE ARE ABOUT 13 THINGS THAT WE MEASURE IN A RESTROOM STALL. YOU PROBABLY NEVER THOUGHT THAT THERE WOULD BE SO MANY AND THIS PICTURE LACKS A GRAB BAR ON THE BACK. UH, THE GRAB BAR ON THE SIDE IS TOO HIGH. THAT TOILET PAPER IS A LITTLE TOO FAR AWAY FROM THE TOILET. UH, THE DOOR HAS TO BE SELF-CLOSING. SO THERE'S QUITE A FEW, UH, REALLY NUANCED, UH, REQUIREMENTS, UH, FOR RESTROOMS AND ANOTHER PEEK AT PARKING, UH, SLOPES IN THE STALLS AT THE TENNIS CENTER. THOSE LOOK PRETTY DARN GOOD TO THE NAKED EYE, BUT, UH, THAT SLOPE IS 2.6% AND IT CAN'T BE STEEPER THAN 2.08 OR 2.1% IF YOU WANT TO ROUND UP, UH, IN ANY DIRECTION. SO JUST A COUPLE OF EXAMPLES OF SOME OF THE THINGS THAT WE SAW, THE NEXT SLIDE STARTS TO TALK ABOUT THE TRANSITION PLAN FROM THE 30,000 FOOT LEVEL HERE. SO WE PEGGED YOUR PHASE ONE WORK, AND THIS IS WORK THAT IS BOTH LOW HANGING FRUIT AND ALSO WORK THAT WE THOUGHT IS MORE CRITICAL BECAUSE IT ADDRESSES YOUR UNIQUE SITES. WE PEGGED IT AT SIX YEARS AT A LITTLE OVER 1 MILLION, WELL ABOUT 1 MILLION, $200,000 PHASE TWO TENDS TO BE WORK AT PARK SITES LIKE CREATING ACCESSIBLE ROUTES THROUGH PARKS. THOSE ARE NEWER REQUIREMENTS IN THE DESIGN STANDARDS. SO WE TYPICALLY HAVE PUT THAT IN PHASE TWO. AND WE HAD THAT AT TWO YEARS THAT WE HAD PHASE THREE AT THREE YEARS, AND THAT TENDS TO BE SITES THAT ARE MORE COMPLEX OR COSTLY TO RETROFIT AT A COST OF ABOUT $700,000 ALTOGETHER. THE XL SPREADSHEET TRANSITION PLAN THAT WE PROVIDED JASON WITH CAN BE SORTED AND ORGANIZED AND EVERY DIFFERENT WAY WE KNOW MOST CITY STAFF USE XL FREQUENTLY. SO IT'S A GOOD TOOL FOR YOU TO BE ABLE TO FOLLOW THIS. UH, THERE MIGHT BE SOME UNFINISHED BUSINESS IF THE CITY HAS NOT EVALUATED ALL OF ITS PUBLIC RIGHT AWAY FOR ADA COMPLIANCE, UH, THAT'S AN IMPORTANT PIECE OF THIS, AND THERE ARE PROBABLY OTHER CITY POLICIES, UH, PERHAPS IN DEPARTMENTS, OUTSIDE OF PARKS AND RECREATION, UH, THAT DESERVE A LOOK AS WELL. SOME OF THE NEXT STEPS IN THE NEXT SLIDE IS TO DIGEST THE RECOMMENDATIONS. WE'VE TALKED TO JASON AND STAFF, AND WE'LL PROVIDE TWO, ONE HOUR GO TO MEETING OR ZOOM CALLS TO CLARIFY THE ADVICE AND THE REPORTS, UH, FROM AN EFFICIENCY PERSPECTIVE, COST EFFICIENCY. THIS JUST MAKES IT EASIER AND LESS COSTLY ACROSS THE BOARD. I MENTIONED COVID-19, YOU KNOW, WE CERTAINLY RECOGNIZE THAT MANY CITIES ARE LOOKING AT THE NEXT FISCAL YEAR AND WONDERING WHAT'S GOING TO CHANGE. UH, MY ONLY ADVICE HERE IS, WELL, I GUESS I'D SAY TWO THINGS. WE'RE JUST MAKING RECOMMENDATIONS. UH, THE CITY STILL, UH, YOU KNOW, CERTAINLY HAS THE AUTHORITY AND PERHAPS EVEN THE OBLIGATION TO MAKE CHANGES THAT FIT INTO YOUR, UH, CIRCUMSTANCES. BUT MY SECOND PIECE HERE WOULD BE TO MAKE SURE THAT THERE ARE SOME RESOURCES FOR SOME RETROFIT [00:15:01] WORK THAT OCCURS EVERY YEAR. THERE'S A FAIR AMOUNT OF COURT AND ADMINISTRATIVE DECISION AND SETTLEMENT AGREEMENT GUIDANCE ON THIS. SO LASTLY, HERE, FOLLOW THE LEADERS STAY CURRENT ON NEW TECHNOLOGY REGARDING ACCESS AND CERTAINLY NEW SETTLEMENT AGREEMENTS. LIKE THE ONE I MENTIONED REGARDING PLAYGROUND, UH, ACCESSIBILITY. AND THEN LASTLY, UH, IN THE NEXT SLIDE, JUST, THIS IS AN IMPORTANT FIRST STEP IN MEETING THE ADA COMPLIANCE MANDATE.
