[4. REPORTS]

UNDER REPORTS.

UM, COMMISSIONED REPORTS AS THE CHAIR.

I REALLY DON'T HAVE A REPORT ON TONIGHT, BUT I DID WANT TO MAKE ACKNOWLEDGEMENT TO OUR NEW MAYOR.

I SEE THAT HE HAS JOINED US HERE ON TONIGHT.

UM, MAYOR THANK YOU SO MUCH FOR COMING BY AND, UM, HOPEFULLY WE'LL DO YOU WELL, DID YOU HAVE ANY COMMENTS? I WILL.

SO I JUST WANTED TO JUST COME IN AND SAY HELLO.

UM, I HEARD NOTHING BUT GREAT THINGS FROM STACI AND JENNIFER AND THE ENTIRE TEAM.

SO YOU GUYS ARE DOING A WONDERFUL JOB, SO I'LL JUST POP IN AND OUT ONCE IN A WHILE, JUST TO HEAR SOME OF THE ISSUES AND SOME OF THE CONCERNS, PLEASE FEEL FREE TO REACH OUT TO ME WITH ANY CONCERNS OR ANY QUESTIONS YOU HAVE.

I, YOU KNOW, I DON'T HAVE MY CARD ON ME, BUT I'M SURE YOU CAN FIND MY EMAIL.

UH, IF ANYTHING I CAN DO TO MAKE ALL OF YOU, UM, PLANNING AND ZONING BETTER, PLEASE LET ME KNOW AS WELL.

THANK YOU.

WE SURE WILL.

THANK YOU SO MUCH MAYOR FOR COMING BY.

THANK YOU, MAYOR, OR ANY OTHER CONDITIONERS? DO YOU HAVE A REPORT ON TONIGHT FROM ANY OF THE OTHER COMMISSIONERS? OKAY.

UM, INTERIM DIRECTOR, MS. THOMAS, IS THERE A REPORT? THEY GAVE ME A CHAIR AND COMMISSION.

I DID NOT HAVE A REPORT, UM, ON TONIGHT, BUT JUST TO SAY HAPPY NEW YEAR, UH, TO ALL THE COMMISSIONERS AND WE LOOK FORWARD TO AN EXCITING 20, 21 AND HOPEFULLY A BETTER HEALTHIER, UH, 20, 21 FOR ALL OF US.

ABSOLUTELY.

ABSOLUTELY.

UM, THANK YOU SO MUCH FOR THAT, MR. HANEY, YOUR HAND IS UP ON THE SCREEN.

IT APPEARS MR. O'MALLEY IS NOW PRESENT.

WONDERFUL.

OKAY.

THANK YOU.

AND JAMIE, WOULD YOU PLEASE DO NOTE THAT, UH, O'MALLEY IS NOW PRESENT AS WELL.

[00:05:01]

THANK YOU.

OKAY.

MOVING NOW BACK TO ITEM TWO, THE CITY ENGINEER.

DID WE HAVE AN ENGINEER ON WITH US ON TONIGHT? WOW.

OKAY.

UM, WELL WE'LL MOVE FORWARD.

UM, IT, SHOULD THERE BE A REPORT OR SOMETHING THAT, UM, THEY NEED TO SAY, WE'LL GO BACK.

IF WE HAVE TO, HOPEFULLY WE WON'T HAVE TO, UM, UM, UNDER ITEM FIVE,

[5. PUBLIC COMMENT]

THIS IS THE PUBLIC COMMENT, OPPORTUNITY TIME, IF THERE'S ANYONE IN THE LINE OR OUT THAT WOULD LIKE TO SPEAK TO THE COMMISSIONERS IN REGARDS TO A MATTER, THAT IS NOT ON THE AGENDA.

NOW'S THE TIME TO DO SO, BUT JIMA, IS THERE ANYONE OKAY.

I'M SORRY.

CAN YOU HEAR ME? WE, I CAN NOW.

YES, MA'AM OKAY.

SORRY.

I'M HAVING PROBLEMS WITH THE AUDIO.

THAT WAS, I BELIEVE YOU'RE SAYING NO THAT THERE'S NO ONE I CAN BARELY HEAR YOU.

THAT IS CORRECT.

OKAY.

HOWEVER, THERE IS A SUPPORT FOR AGENDA ITEM SEVEN B.

OKAY.

LISA NICHOLS.

ALRIGHTY.

UH, IF YOU COULD, IF YOU CAN EMAIL IT TO ME, THAT'S OKAY.

WE'LL GET YOU TO READ IT IN AT SEVEN B.

IS THAT OKAY? THANKS TO JIMA.

OKAY.

WE'LL MOVE ON NOW TO ITEM SIX,

[CONSENT AGENDA]

A UM, THE SIXTH, THE PLANTS UNDER THE CONSENT AGENDA, ALL OF THE CONSENT AGENDA ITEMS TONIGHT, OR ARE GENERALLY APPROVED, UM, UH, STANDARD PRACTICE AND PROCEDURE OF THE PLANNING AND ZONING COMMISSION ITEM SIX ONE, CONSIDER AN APPLICATION FOR A PRELIMINARY PLAT FOR SIANNA SECTION 19 TO CONSIDER AN APPLICATION FOR A PRELIMINARY PLAT FOR SIANNA SECTION 36 THREE.

CONSIDER AN APPLICATION FOR A FINAL PLAT FOR SIANNA SECTION 33 C FOUR.

CONSIDER AN APPLICATION FOR A FINAL PLAT FOR PARKS AGE, SECTION 18 FIVE.

CONSIDER AN APPLICATION FOR A FINAL PLAT FOR PARK EDGE SECTION 19 AND SIX.

CONSIDER AN APPLICATION FOR WATERBROOK WEST.

REPLAT NUMBER ONE.

IS THERE A MOTION HANY? THANK YOU FOR THAT MOTION.

IS THERE A SECOND? SECOND.

THANK YOU, MS. LUCAS.

I APPRECIATE IT.

IS THERE ANY FURTHER DISCUSSION I DID.

I DID HAVE A QUESTION ABOUT, UH, ITEMS FOUR AND FIVE CONCERNING THE, UH, THE LETTER OF APPROVAL.

UM, IT SOUNDS LIKE THAT THAT COULD BE A PRETTY MAJOR ISSUE, BUT, UM, WE'RE, WE'RE MOVING FORWARD WITH, WITH, UH, APPROVAL WITH CONDITIONS AND I KINDA JUST WANT HER TO GET A FEEL FOR WHERE THE STAFF WAS ON.

THAT SOUNDS GREAT, JENNIFER.

YES.

UH, ON THAT QUESTION, UM, THIS IS THE FORT BEND COUNTY DRAINAGE DISTRICT, UM, WORKING WITH THE CITY AND ALSO THE, UH, DEVELOPER FOR, UM, THEY'RE WORKING OUT A CAPACITY DRAINAGE CAPACITY ISSUE, UM, IN THE KITTY HOLLOW AREA.

AND, UH, THEY'VE BEEN, UH, WORKING PRETTY PROACTIVELY SINCE THE SUMMER, UH, TO TRY TO RESOLVE IT.

SO WHAT THIS ITEM WOULD DO IS, UM, IT WOULD APPROVE THE PLEX INFORM.

HOWEVER THE APPLICANT WOULD HAVE TO RESUBMIT, UM, EACH OF THESE PLANTS TO CLEAR, UH, ONCE THE DRAINAGE DISTRICT HAS RELEASED ITS NO OBJECTION.

SO THEY'LL, THEY'LL BE COMING BACK FOR THE COMMISSION, UM, AT SOME POINT IN THE FUTURE.

SO WHY ARE WE ARE PROVING THAT AS FIRE PLATS? YEAH.

SUBSTANTIVELY THE FORM OF THESE PLANTS, MEET ALL OF THE CONDITIONS.

UM, NOTHING WILL, WELL, NOTHING IS EXPECTED TO ON, UM, THE LAKE OR THE SUBDIVISION THAT'S PRESENTED.

UM, HOWEVER, THE DRAINAGE FACILITY, UM, IT'S, IT'S LARGER THAN JUST THESE TWO SECTIONS IT'S FOR ANY NEW DEVELOPMENT THAT'S DEVELOPING IN THAT AREA.

UM, SO IT'S NOT DIRECTLY CONNECTED TO THESE TWO SECTIONS, BUT THEIR, UM, OVERALL DEVELOPMENT AFFECTS THE CAPACITY.

SO THE EXPECTATION IS THE FORM OF THESE TWO SECTIONS WILL STAY INTACT AND WE'LL STILL BE CONSISTENT WITH OUR SUBDIVISION AND ORDINANCE.

UM, BUT ONCE THE CAPACITY ISSUE, UM, AND I BELIEVE AT THIS POINT IT'S A FUNDING ISSUE, A FINANCING ISSUE

[00:10:01]

ON, UM, WHO WOULD BE, WHO WOULD BE PART OF THE FUNDING TO MAKE THOSE IMPROVEMENTS.

UM, BUT IF IN THE KITTY HOLLOW PARK AREA YEAH.

THAT THOSE IMPROVEMENTS WILL BE MADE.

OKAY.

I GUESS, ARE THERE ANY OTHER QUESTIONS, ANY FURTHER DISCUSSION? WE HAVE A MOTION AND WE HAVE A SECOND, ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE.

RIGHT.

I AS WELL, THAT WOULD BE THREE.

ARE THERE ANY NAMES? OKAY, THANK YOU FOR THE FOURTH ONE.

I AND THE FIFTH ONE, I, AND HE KNOWS OUR NAMES.

OKAY.

UH, ABSTENTIONS, UM, WELL CON FOR THAT.

OKAY.

THAT MOTION STANDS AS APPROVED.

THANK YOU.

WE'LL MOVE

[7A. PUBLIC HEARING FOR A SPECIFIC USE PERMIT]

NOW TO ITEM SEVEN ZONING MAP AMENDMENTS.

UH, IT W THIS IS GOING TO BE A PUBLIC HEARING FOR A SPECIFIC USE PERMIT ON TONIGHT.

WE'LL RECEIVE COMMENTS FOR, OR AGAINST THE REQUEST BY SCOTT NICHOLS, DESTINY CHURCH, OR AN SUP TO ALLOW FOR THE LOCATION OF A PLACE OF ASSEMBLING NEW CHURCH LOCATION.

AND TO THE EXTENT THAT SUCH ZONING DEVIATES FROM THE FUTURE LAND USE AND CHARACTER MAP OF THE COUNTRY.

GOOD EVENING COMMISSIONERS IN REGARDS TO THE, UH, SUP, UH, JUST TO GIVE YOU BRIEF HISTORY, AS YOU PROBABLY RECALL, UM, ON NOVEMBER THE 2020, UH, THE SUP WAS, UH, APPLIED FOR AT THE INTERSECTION OF COURT, RIGHT? AND FM 10 92, UH, THE CHURCH'S TRYING TO PROCEED, UM, AS THEY SPOKE BEFORE IN REGARDS TO BEING A GOOD NEIGHBOR AND GROWING THEIR CHURCH WITHIN THE COMMUNITY.

UM, AS YOU CAN SEE ON THE SCREEN, THE SITE LOCATION IS NORTH OF LEXINGTON BOULEVARD AND SOUTH OF LEXINGTON GROVE, RESIDENTIAL SUBDIVISION, EAST OF LEXINGTON SETTLEMENT, RESIDENTIAL SUBDIVISION AND WEST OF THE FIRST UNITED METHODIST CHURCH.

OH, IN REGARDS TO THE NEXT SLIDE, PLEASE, THE SITE PLAN AS DEMONSTRATED, THERE ARE PROPOSING AN 18,000 SQUARE FOOT BUILDING, UM, TO HOUSE THE, UH, SANCTUARY AS WELL AS OFFICE SPACE IN A, UH, A GATHERING AREA FOR THE CONGREGATION TO, UH, HAVE COFFEE OR SMALL THINGS.

NO KITCHEN IS PROPOSED IN REGARDS TO THE, UH, THE CURRENT, UH, CONGREGATION SIZE IS 80 PEOPLE.

WHAT THEY ARE PROPOSING A 400 SEAT AUDITORIUM, UM, AS YOU CAN SEE WHAT THE PROPOSED LAYOUT, UH, THE ASSOCIATED PARKING LANDSCAPING SCREEN AND SIGNAGE AND TRASH DISPOSAL, THE APPLICANT DID SPEAK TO, UM, MAKING SURE THAT THEY MEET OR EXCEED ALL STANDARDS SET FORTH BY THE CODE.

OKAY.

AND IN REGARDS TO THE ENGINEERING DEPARTMENT, THEY DID RECEIVE A TIA WORKSHEET.

AND AT THIS POINT IN TIME, UH, I DID SPEAK WITH THE ENGINEER AND HE STATED, UH, WITH THE AMOUNT OF, UM, TRIPS OR TRAFFIC, UH, FROM THE PROPERTY, THEY'RE NOT REQUESTING A TIA IN REGARDS TO THE, UH, SIGNAGE REGULATIONS AND INGRESS EGRESS, THE UTILITIES AND, UH, LANDSCAPING, PARKING REQUIREMENTS, TRASH DISPOSAL, AND ARCHITECTURAL STANDARDS.

THEY ARE WILLING TO WORK WITH US.

AND THIS PROPERTY DOES HAVE TO BE PLANTED AS WELL, IF IT IS, UH, APPROVED BY YOU, UM, AS WELL AS, UH, OR RECEIVES A POSITIVE RECOMMENDATION AND APPROVED BY CITY COUNCIL, UH, IN TERMS OF THE STAFF REPORT THAT WE DID PROVIDE TO YOU, UM, THERE IS ONE REQUEST FROM STAFF, UM, AFTER WE, UM, PROVIDED THIS TO YOU WERE ASKING THAT YOU, UM, NOT ADOPT THE DEVELOPMENT SCHEDULE THAT WE HAD ON THE REPORT, UM, AND THE SITE PLAN, UH, AND THAT'S TO ALLOW THEM THE TIME TO, UH, CONSTRUCT AND, AND COMPLETE THE, UH, PROJECT.

UM, THE APPLICANT IS SCHEDULED TO BEGIN THE CONSTRUCTION AT YEAR FOUR,

[00:15:01]

AND THERE'S, UH, SEEKING TO FOLLOW ALL CITY AND EL C3 STANDARDS WITH NO DEVIATIONS REQUESTED AT THIS TIME.

AND, UH, ONE OTHER CAVEAT, THE CITY COUNCIL DID APPROVE, UH, THE SUP THAT YOU HEARD ON NOVEMBER 11, 2020.

UH, THEY APPROVED THAT, UM, ON THE CITY COUNCIL MEETING, UH, UH, DECEMBER 21ST, 2020.

OKAY, WONDERFUL.

THANK YOU, MR. WHITE.

I WAS FOR A FIVE-YEAR TERM, CORRECT? YES, SIR.

THANK YOU.

UM, AND I JUST HAD ONE QUESTION KIND OF IN GENERAL, AND I'M SORRY THAT, UM, HOPEFULLY SOMEBODY HERE CAN ANSWER THIS, THAT AREA.

UM, THOMAS, CAN YOU GO BACK ONE SLIDE WHERE WE COULD SEE THE, YEAH.

BACK ONE MORE? OKAY.

THIS AREA I'LL LOOK AT ME TRYING TO USE MY MOUSE.

I'M SORRY.

BUT THE AREA SAY IN PARTICULARLY NEAR BLUESTONE AND LEXINGTON, THAT AREA, EVERY TIME IT RAINS, IT FLOODS THERE.

I MEAN, YOU CAN HARDLY YES, RIGHT THERE IN THAT AREA.

IT ALMOST PROBABLY BOTH OF THOSE THAT SUBDIVISIONS INTERSECTIONS.

SO I DON'T KNOW HOW THE DRAINAGE WILL, WOULD RUN OR ANYTHING LIKE THAT OR ANY OF THAT HAS EVEN BEEN CONSIDERED.

UH, OF COURSE I'M NOT AN ENGINEER.

I DID SPEAK TO, UH, JEREMY, THE ASSISTANT CITY ENGINEER.

UM, I'M NOT SURE IF HE'S ON THE CALL NOW, BUT, UH, WE DID TALK ABOUT, UH, THE EXISTING, UM, DRAIN HIS PATTERN AND ALSO THEM, UH, BEING REQUIRED TO RETAIN THAT WATER.

UM, I DID MAKE A NOTE, UM, OF YOUR CONCERN AT THAT INTERSECTION AND I CAN SPEAK WITH HIM TOMORROW AND BRING THAT TO HIS ATTENTION.

UH, AND WE, OF COURSE WE WILL MAKE SURE THAT, UH, THEY ADHERE TO OUR DRAINAGE REGULATIONS REQUIRED.

OKAY.

SO THIS IS ACM MARTEL.

CAN I SPEAK, UM, IN JUST A MINUTE? OKAY.

GIVE US JUST A MINUTE, SIR.

AND I'LL COME RIGHT BACK TO YOU, MR. MARTEL, RIGHT? YES.

OKAY.

I'LL COME RIGHT BACK TO YOU.

GIVE ME JUST A MINUTE.

THAT'S THE ASSISTANT CITY MANAGER, GLEN FROM, FROM THERE ALL THE WAY DOWN PAST BRIGHTWATER.

YEAH.

AND, UH, AND UNFORTUNATELY, UH, I DID READ IT, UM, BECAUSE OF THE PANDEMIC AND BUDGET CONSTRAINTS, THE PLAN RECONSTRUCTION OF LEXINGTON TO ADDRESS THOSE DRAINAGE ISSUES HAS BEEN DEFERRED AT THIS POINT.

SO, UM, IT'S, I, I DON'T KNOW THAT IT'S HAS ANYTHING TO DO WITH ANY OF THE PROPERTIES.

I THINK THAT LEXINGTON HAS BEEN FLOODING FOR THE LAST 20 YEARS SINCE I'VE BEEN HERE.

THAT'S TRUE.

YOU, YOU GOT A GOOD POINT THERE.

HANEY MR. MARTEL.

I AM SO SORRY.

COME ON YOUR STAFF.

WOULD YOU PLEASE TALK TO US? I, I APPRECIATE THAT.

I DON'T GET TO SPEAK OFTEN, SO THANK YOU.

UM, UH, UH, MR. HANEY HAD IT RIGHT.

UM, THE LEXINGTON IMPROVEMENTS, AS WELL AS THE CARTWRIGHT IMPROVEMENTS WERE PART OF OUR, UH, PROGRAM WITH FOUR BEN, UH, WORK TOGETHER.

AND THOSE IMPROVEMENTS, UH, BOTH FROM 10 92 ALL THE WAY BACK, UH, FURTHER TO THE WEST THERE.

SO AS MR. HANEY SAID AS WELL, YES, THOSE HAVE BEEN DELAYED, BUT WE RECENTLY, UH, RENEGOTIATE NOT RENEGOTIATED, BUT READJUSTED SOME OF THOSE.

AND THOSE WERE BACK ON TRACK.

UM, AND OUR IN DESIGN, THE DESIGN ENGINEERS HAVE BEEN, UH, ASSIGNED AND MONEY RECOMMITTED TO THOSE PROJECTS.

SO, UH, HOPEFULLY HERE IN THE NEAR FUTURE, UH, BOTH OF THOSE ISSUES WILL BE GREATLY REDUCED.

OKAY.

OKAY.

THANK YOU SO MUCH FOR SHARING THAT INFORMATION WITH US.

MR. MARTELL IS GREATLY NEEDED.

THANK YOU.

UM, COMMISSIONER OVERTON, I THINK YOU WERE GONNA MAKE A COMMENT.

WAS IT ALSO IN REGARDS TO THE, UH, FLOODING ISSUE? I SURE WAS.

THANK YOU FOR RECOGNIZING ME, UH, WHEN YOU MENTIONED THEY WOULD BE RESPONSIBLE FOR ANY FLOODING IN THAT AREA.

WHO WERE YOU REFERRING TO WHEN YOU SAID THEY, YOU SPEAKING? UH, IN REGARDS TO, OKAY.

SO WHEN I, WHEN I SPOKE, I WAS TALKING ABOUT DIRECTLY IN REGARDS TO THE PROPERTY, JUST LIKE ALL THE OTHER PROJECTS THAT HAVE COME BEFORE YOU, UH, ENGINEERING DOES THEIR DUE DILIGENCE AND MAKING

[00:20:01]

SURE THAT THEY PROTECT THE CITIZENS, UH, BY LOOKING AT THE, UH, DRAINAGE CALCULATIONS AND THINGS OF THAT NATURE.

SO I WAS SPEAKING JUST FROM THE STANDPOINT OF THE PROPERTY, NOT, YOU KNOW, THE STREETS AND ANYTHING OTHER THAN THAT, THEY HAVE TO, UM, THEY HAVE TO, UH, THEY HAVE TO MAINTAIN THAT WATER ON THE SITE.

AND WHEN YOU SAY THEY SHOULD, THEY YOU'RE SAYING THE PROPERTY OWNER HAS TO MAKE, I'M SORRY TO BE CLEAR.

YES.

MA'AM THAT WILL BE THE PROPERTY OWNER.

SO THEY WOULD, THEY WILL SUBMIT THEIR CIVIL PLANS AND THEY WOULD, UH, THEY WOULD HAVE TO ACCOUNT FOR THAT WATER THAT, UM, ON A SITE.

SO ANY DRAINAGE PATTERN THAT CHANGES, THEY STILL HAVE TO ACCOUNT FOR WHAT'S ON THE PARTICULAR SITE AND IT CAN DRAIN AND ADD TO THE, UH, THE PROBLEMS THAT YOU IN THE CHAIR, LADY STATED CLARIFICATION.

WHEN YOU SAID THEY'RE GOING TO BE RESPONSIBLE, WHAT ARE THE, UH, WHAT CAN BE DONE IF THEY DO NOT HOLD OR DO NOT TAKE ON THAT RESPONSIBILITY? IN OTHER WORDS, IF IT COMES TO A POINT WHERE THEY'RE NOT ABLE TO CONTROL IT OR ARE CHOOSING NOT TO, ISN'T TOTALLY, WELL, I'LL SAY THIS, I'M NOT AN ENGINEER BY ANY STANDARDS.

UM, HOWEVER, UH, THEY WILL HAVE TO.

AND WHEN I SAY THEY, I MEAN THE APPLICANT AND THEIR PROFESSIONALS, THEY WILL HAVE TO MAKE SURE THAT THEY CAN MEET THE REGULATION SET FORTH, WHETHER ENGINEERING DEPARTMENT, IF THEY CANNOT, THEN THERE MAY BE SOME ADDITIONAL OPTIONS IN WHICH THEY CAN MAYBE PAY TO, UH, TAKE CARE OF THAT MEASURE, BUT REGULATIONS HAVE TO BE MET.

AND SO WHEN I'M SAYING IS THE PROBLEM WILL NOT GET WORSE BASED ON THE NEW PROJECT.

THANK YOU, MR. WHITE, IF WE COULD HAVE, UH, MAYBE MS. WAY, IF SHE'S ON THE LINE.

MY, MY, YEAH, THIS IS TO ME THE WAY.

SO THOMAS IS ABSOLUTELY CORRECT.

WHAT WILL HAPPEN IS THEY WON'T GET A CERTIFICATE CERTIFICATE OF OCCUPANCY UNTIL THEY MEET ALL OF OUR REGULATIONS.

SO THEY WON'T BE ABLE TO USE THIS PROPERTY UNTIL ALL THE REGULATIONS ARE MET, WHICH INCLUDES THE DRAINING, UM, REGULATIONS.

THEY WON'T EVEN GET A PLAT.

YEAH.

WASTE, DRAINS CALCULATIONS ARE DONE AND THEY MEET THE CITY REQUIREMENTS.

SO AS REQUIRED FOR THE CL, THEY MEET THOSE REQUIREMENTS.

THERE, THERE WILL BE NO PLAN AND THEY WILL NOT EVEN BE ABLE TO START ANY WORK.

THAT'S CORRECT, TIM, NOR I WILL NOT SIGN OFF ON IT.

THEY WON'T GET IT.

OKAY.

SOUNDS GOOD.

ALL RIGHT.

UH, COMMISSIONERS, DO YOU HAVE ANY ADDITIONAL QUESTIONS FROM MR. WHITE BEFORE WE OPEN THIS TO THE PUBLIC? I, THIS IS COMMISSIONER LUCAS.

I JUST NEED SOME CLARITY.

UM, THEY SAID THAT, UM, FOR US NOT TO ADOPT THE DEVELOPMENT PLAN OR THE ORIGINAL PLAN OR SOMETHING, NOT TO APPROVE IT, I THINK I MAY HAVE MISSED SOMETHING THERE.

OKAY.

MR. WHITE, WOULD YOU GO BACK AND KIND OF GO OVER THAT A LITTLE BIT MORE? YES.

I'M SORRY.

I DIDN'T MAKE IT AS CLEAR AS I SHOULD HAVE THE FIRST TIME.

SO BASICALLY WHEN YOU RECEIVED THE STAFF REPORT, WE WERE LOOKING AT A PLACE IN A FIVE-YEAR PERIOD, UH, LIMITATION ON THAT.

HOWEVER, UH, WE DON'T WANT IT TO COME BACK BEFORE YOU, UH, IN TERMS OF THEY, THEY MISSED THE, THE TIMEFRAME, UH, FOR THE FIVE, BECAUSE KEEP IN MIND THE HISTORY OF IT.

SO THEY'RE, THEY'RE CURRENTLY, UH, MOVING INTO THE LOCATION THAT, UH, CARTWRIGHT AND FMT AND 92, WHICH IS A FIVE-YEAR PERIOD.

UH, THEY'RE THEY'RE THEY HAVE TO BE OUT OF THERE BY THAT TIMEFRAME.

THE AFRICAN HAS STATED WITHIN THE, THAT WINDOW WITHIN YEAR FOUR, THEY'RE LOOKING TO DO CONSTRUCTION, BUT THIS IS BASED ON, UH, FACTORS, UH, THAT ARE KIND OF UNKNOWN AT THIS POINT.

THEY ARE SEEKING TO MOVE FORWARD, BUT THINGS CAN HAPPEN BETWEEN NOW AND THEN.

UM, AND WE'RE JUST TRYING TO MAKE SURE THAT WE, UM, GIVE THEM MORE TIME ESSENTIALLY, RIGHT? IT'S GOING TO GIVE THEM MORE TIME TO, AND THEY'VE, THEY'VE BEEN GOOD STEWARDS THUS FAR DOING ALL THE RIGHT THINGS THERE.

THEY'RE GROWING, THEY'RE CONTINUE TO GROWING GROW, AND THEY'RE GOING FROM ONE, ONE LOCATION TO ANOTHER, AND NOW THEY'RE LOOKING FOR PERMANENT PLACEMENT.

UM, SO THAT'S THE DEMONSTRATE THAT NOW TO CLARIFY THE, LIKE I SAID, THE STAFF REPORT WAS, UH, SUBMITTED TO YOU GUYS, AND WE DID NOT HAVE, UH, WE DID NOT MAKE REVISIONS, UH, UP UNTIL NOW.

AND SO THAT'S WHY WE WERE ASKING THAT

[00:25:01]

YOU NOT, UM, ADOPT THE DEVELOPMENT SCHEDULE AS WELL AS THE SITE PLAN THAT YOU'VE SEEN ON THE SCREEN.

WE'RE ASKING GOOD.

BECAUSE THINGS COULD CHANGE JUST IN, IN REGARDS TO, UH, WE'RE, WE'RE TALKING ABOUT DRAINAGE.

IF, IF THEY'RE REQUIRED TO DO SOMETHING DIFFERENT THAN THE BUILDING MAY SHIFT, UH, PARKING AREA MAY CHANGE, UM, UH, THE DUMPSTER AND THINGS OF THAT NATURE.

SO THAT ALLOWS THEM, UH, FLEXIBILITY TO MAKE SURE THEY MEET OUR STANDARDS.

UM, AND THAT THEY DON'T HAVE TO COME BACK BEFORE YOU AT THE TIME, YOU KNOW, FOR THIS IT'S JUST FOR THE SUP UH, PART OF THE PROCESS.

CAN I ADD, CAN I ADD SOMETHING? YES, YES.

MA'AM SPEAKING.

I'M SORRY.

Y'ALL NORMALLY SHOW THE NAMES UP THERE.

WHO'S SPEAKING OR THE PICTURE, AND I DON'T RECOGNIZE EVERYBODY VOICE AND NON-LOCALS MS. LUCAS, ONCE THEY SAY SOMETHING, I'LL ACKNOWLEDGE THEM SO THAT YOU WILL HEAR THE NAME.

I PROMISE MS. GOMEZ, GO AHEAD.

WOULD YOU PLEASE? YES.

SO THIS IS JENNIFER GOMEZ, UM, JUST TO ADD ON TO WHAT THOMAS WAS DESCRIBING.

UM, SO YOUR, THE SPECIFIC USE PERMIT REGULATIONS, UM, AND THE ZONING ORDINANCE, UM, PROVIDES THAT, UM, CITY COUNCIL CAN ADOPT A DEVELOPMENT SCHEDULE THAT WILL ESSENTIALLY LAY OUT A PROJECT COMPLETION, UM, WITHIN A FIVE-YEAR PERIOD.

AND SO THE RECOMMENDATION THAT WAS INCLUDED IN THE REPORT WAS BASED ON, UM, THAT PROVISION THAT WOULD BE SUBSTANTIALLY COMPLETED WITHIN FIVE YEARS.

HOWEVER, AS, UH, THOMAS WAS DESCRIBING, UM, THIS IS THE PERMANENT LOCATION, UH, THEY'RE PREPARING TO START CONSTRUCTION, UM, AT A MINIMUM OF ABOUT FOUR YEARS FROM NOW.

SO WE KNOW THAT THE PROJECT WON'T BE SUBSTANTIALLY COMPLETE, UH, WITHIN THAT FIVE-YEAR PERIOD, BUT BECAUSE WE'RE REALLY JUST TALKING ABOUT THE USE HERE, UM, THEIR DEVELOPMENT WOULD ALL BE IN LINE WITH THE EXISTING ZONING, THE LC THREE STANDARDS.

UM, THE RECOMMENDATION IS TO NOT ADOPT OTHER SITE PLAN OR THE DEVELOPMENT SCHEDULE THAT WOULD TIE THEM INTO, UM, HAVING TO BE REQUIRED OR HAVING TO BE COMPLETED WITHIN A FIVE-YEAR PERIOD.

SO THAT'S, THAT'S THE REVISED RECOMMENDATION THAT, THAT WE'RE PROVIDING CLEANER.

YES, IT IS.

THANK YOU.

OKAY, GO AHEAD, MR. HANEY.

SO EFFECTIVELY, WE'RE JUST, WE'RE JUST APPROVING TO USE THAT'S IT.

AND, AND, AND OUTSIDE OF THE, THE SPECIFIC REQUIREMENTS AROUND THE USE, THE USEFUL ROMAINE NOW, ARE WE SETTING A DEADLINE ON THAT USE OR ARE WE JUST LEAVING IT? OPEN-ENDED IT'S PERMANENT.

THIS IS STIMULUS AWAY.

IF YOU PUT AN EXPIRATION DATE ON THERE, UH, THE USE WILL BE PERMANENT, SO YOU'RE AMENDING THE ZONING DISTRICT TO ALLOW FOR THAT USE.

OKAY.

UNDERSTOOD COMMISSIONER.

SO YOU HAVE ANY OTHER QUESTIONS FROM STAFF? I GET CLARIFICATION.

SO, UH, MS. WAY, YOU'RE SAYING, OH, EXCUSE ME.

THAT'S OKAY, GO AHEAD, MS. OVERTON, YOU'RE SAYING FOR CLARIFICATION, YOU'RE SAYING THAT IT WOULD BE OPEN-ENDED FOR THE USE, CORRECT.

LET US PASS THE FIVE YEARS.

SO AT WHAT POINT IS THERE ANYWHERE IN THERE THAT THEY ARE OBLIGATED TO COMPLETE ANY CONSTRUCTION OR ANY DEVELOPMENT IN THAT AREA, OR WOULD IT BE OPEN IN AFTER FIVE YEARS? AND I GUESS WHAT I'M GETTING AT, I JUST DON'T WANT, YOU KNOW, THAT AREA TO STILL BE IN THE PROCESS OF BEING FINISHING.

DO YOU, DO WE RUN THAT RISK OF THAT? IF YOU GIVE THEM AN OPEN END, NOT NECESSARILY, WE'RE TALKING ABOUT TWO DIFFERENT THINGS.

SO THE SUP IS ALLOWING TO USE THAT ZONE.

THAT'S NOT GOING TO, UM, MOST OF YOUR SUP'S, YOU, YOU DON'T EXPIRE THEM SINCE I'VE BEEN HERE.

YOU'VE ONLY EXPIRED ONE.

THE DEVELOPMENT SCHEDULE IS MORE LIKE A PERMIT, AND YOU'RE NOT PUTTING THAT CONDITION ON THESE THAT SAYS YOU HAVE TO FINISH THIS WITHIN FIVE YEARS, OR YOU'RE GOING TO HAVE TO COME BACK HERE AND ASK ME FOR PERMISSION, IF YOU HAVE A GOOD REASON.

BUT, UM, ONCE THEY START, WELL, LET ME BACK UP.

SO IT'S LIKE ANY TRACK OF LAND, ALL TRACKS OF LAND, HAVE SOME SORT OF USE ON THEM AND THEY'RE NOT BEING DEVELOPED.

SO IF THIS PROPERTY JUST SAT THERE FOR 10 YEARS AND THERE'S NOTHING WE CAN DO UNTIL THEY GET READY TO DEVELOP IT, ONCE THEY START DEVELOPING IT, UM, THE STATE OF TEXAS HAS A CODE, UM,

[00:30:01]

AND THE LOCAL GOVERNMENT CODE TWO 45 THAT TALKS ABOUT DOORMAN PROJECTS.

SO THEN THAT WOULD BE TRIGGERED ONCE THEY START TRYING TO DEVELOP A PROPERTY.

SO IF THEY DON'T DO ANYTHING, THERE'S NOTHING WE CAN DO.

WE CAN'T SAY DEVELOP THIS, BUT ONCE THEY START DEVELOPING THE PROPERTY, PULLING PERMITS, THEN THE LOCAL GOVERNMENT CODE KICKS IN AND WE CAN, UM, EXPIRE PERMIT AND, AND FOLLOW THE REGULATIONS UNDER THAT CODE.

SO THEY CAN START THE DEVELOPMENT FOUR YEARS FROM NOW.

AND IT CAN TAKE THEM FOUR YEARS TO COMPLETE THE DEVELOPMENT MINT.

AND IT'S NOTHING THAT CAN BE DONE IF WE APPROVE THIS.

W IS THAT CORRECT? IS THAT MY UNDERSTANDING CORRECTLY? I'M NOT SURE I FOLLOW YOUR QUESTION.

CAN YOU SAY THAT AGAIN? UH, THIS IS JENNIFER GOMEZ.

I THINK.

SO THE QUESTION IS IF THEY START CONSTRUCTION AND THEY DON'T COMPLETE IT WITHIN FOUR YEARS, THAT WE DON'T HAVE A MECHANISM TO REQUIRE THEM TO COMPLETE IT WAS THAT THE QUESTION, RIGHT? IF THEY DON'T COMPLETE IT WITHIN THE FOUR OR FIVE YEARS.

SO WHAT'S THE COURSE, THE STANDARD THAT, UH, JAMEELA WAS JUST REFERENCING, UM, SO LONG AS THERE'S CONTINUED PROGRESS.

AND SO THAT COULD BE ONCE THEY, ONCE THEY'RE ISSUED THE PERMIT AND THEY'RE ACTIVELY CONSTRUCTING, THEY CAN HAVE, YOU KNOW, ONE CONTRACTOR COME OUT ON SITE OR, UM, YOU KNOW, UH, A SMALL PIECE OF WORK BEING DONE SO LONG AS THAT WORK IS CONTINUOUS, THEN THE PERMIT WILL REMAIN, UM, ACTIVE.

IF ACTIVITY STOPS ON THAT CONSTRUCTION SITE, THEN THAT'S WHEN THAT PERMIT, UH, WILL BE, WILL BECOME DORMANT AFTER A PERIOD OF TIME STOPS FOR HOW LONG THOUGH? I BELIEVE IT'S 120 DAYS.

OKAY.

SO, SO THEY CAN JUST HAVE A, A CONTRACTOR TO COME OUT THERE AND TURN DIRT AND CAN BE CONSIDERED AS DOING SOME WORK OUT THERE AND STARTED UP AGAIN.

IS THAT CORRECT? YEAH.

AS LONG, AS LONG AS THEY HAVE, UM, SOME KIND OF WORK MOVING TOWARDS, UH, COMPLETION OF THAT PROJECT.

SO, SO WHAT'S THE, WHAT'S THE GENERAL CONCERN HERE.

I MEAN, THE, THE UNDERLYING ZONING DOESN'T CHANGE, IT'S STILL ELLS YOU THREE, THE APPLICANT OWNS THEIR PROPERTY.

UM, WE GRANT THEM THE RIGHT TO PUT A CHURCH THERE.

UM, IF THEY NEVER BUILD THAT CHURCH, UH, EVENTUALLY THAT RIGHT TO BUILD A CHURCH GOES AWAY, BUT IT DOESN'T REALLY CHANGE ANYTHING ELSE.

UH, I DIDN'T GET THAT UNDERSTANDING THAT THE RIGHT TO BUILD A CHURCH WILL GO AWAY BECAUSE AFTER A HUNDRED AND SOME DAYS, UH, THEY CAN GO BACK OUT THERE AND JUST TURN THAT DIRT.

RIGHT.

WELL, IT BECOMES DORMANT, BUT, BUT, BUT AGAIN, IT IS, WHAT'S OUR CONCERN ABOUT THEM TAKING 10 YEARS TO BUILD A CHURCH.

THEY OWN THE PROPERTY.

WE'VE, WE'VE ALLOWED THEM TO DOUBLE THE CHURCH THERE.

I'M NOT SURE WHAT THE CONCERN IS.

WELL, AND JUST, JUST TO CLARIFY, THIS IS JENNIFER GOMEZ.

SO THE, THE USE THE CHURCH USE, UNLESS YOU PUT AN EXPIRATION, UM, IN THE SUP TO EXPIRE THE USE, THE USE WOULD CONTINUE.

SO IF THAT SUP IS APPROVED FOR THE CHURCH USE, THEN THAT, THAT WOULD BE THERE.

UM, WE HAVE, YOU KNOW, STPS THROUGHOUT THE CITY, SOME THAT WERE APPROVED EARLY 80, YOU KNOW, OR SO ON THAT ZONING, THAT USE IS STILL IN PLACE.

SO THAT'S APPROVED THE SITE.

SOMEONE COULD BUILD A CHURCH THERE, OR THEY CAN DEVELOP AN ACCORDANCE WITH THE LC THREE, UH, REGULATIONS, BUT THE EX THE DORMANT PERMIT AND THE EXPIRATION CONVERSATION THAT WOULD BE ONCE THEY ACTUALLY START CONSTRUCTION.

SO THE PERMIT THAT THEIR ISSUE TO ACTUALLY, UM, START CONSTRUCTION, WHETHER IT'S A CHURCH PROPERTY, OR WHETHER IT'S AN EL C3, UH, DISTRICT USE THAT THAT DORMANT PERMIT IS RELATED TO THAT PART OF THE PROCESS.

MY CONCERN, THIS IS COMMISSIONER OVERTON.

I CONCERN IS THEY CAN START, UH, DOING ANY KIND OF DEVELOPMENT ON THE PROPERTY AND THE PROPERTY COULD BECOME ALWAYS IN CONSTRUCTION, ALWAYS IN THE PROCESS OF BEING FINISHING.

AND MY CONCERN WOULD BE OVER TIME, COULD THEY POSSIBLY NOT FINISH THE, THE PROJECT? AND SO NEIGHBORS ARE DRIVING BY SEEING THIS PROPERTY UNDEVELOPED, MAYBE WITH DIRT OR SOMETHING.

I JUST, THAT'S MY CONCERN.

IF I LIVED IN THAT NEIGHBORHOOD, I WOULD BE CONCERNED

[00:35:01]

AS A NEIGHBOR, AS A RESIDENT, IF I KEPT DRIVING BY THAT CHURCH AND I DON'T SEE ANY FINISH CONSTRUCTION.

AND SO THAT WAS MY CONCERN WHEN IT'S JUST OPEN-ENDED LIKE THAT.

OKAY.

UH, ONE, ONE, EXCUSE ME, IF Y'ALL DON'T MIND ONE, AND THIS IS THOMAS WHITE, UH, ONE THING IN REGARDS TO, I THINK THAT WE'RE STILL MISSING, AND I KNOW IT, IT STILL TIES INTO YOUR CONCERN, BUT THEY HAVE FIVE YEARS AT THE CURRENT LOCATION WHERE THEY ARE.

UM, SO THEY DO HAVE TO FIND A HOME AND THEY ARE SEEKING THE PURCHASE THIS.

SO THEY DO HAVE SKIN IN THE GAME PER SE.

I KNOW THAT DOESN'T TAKE AWAY ALL YOUR, BUT THEY ARE TRYING TO MOVE FORWARD AND BE GOOD STEWARDS.

AND I'M NOT SURE IF THE APPLICANT IS ON THE, UH, HE SHOULD BE ON THE CALL, BUT HE MAY BE ABLE TO, UH, MAYBE PROVIDE A LITTLE BIT MORE DETAIL IN REGARDS TO WHAT WE'RE SPEAKING OF, BUT THEY, THEY HAVE TO FIND ANOTHER PLACE TO BE, UH, FROM THE CURRENT LOCATION BECAUSE THEY ONLY HAVE FIVE YEARS.

SO WE HAVE AN EXPIRATION DATE, SO THEY HAVE TO FIND SOMEWHERE ELSE TO GO.

AND SO THEY'RE SEEKING PERMANENT, UM, PERMANENT, UH, PERMANENT BUILDING IN WHICH THEY CAN CONTINUE TO THRIVE AND, UH, BE A, A GOOD STEWARD OF THE COMMUNITY WE GOT.

OKAY.

HOLD ON, HOLD ON, HOLD ON, HOLD ON.

LET, LET ME SEE IF I CAN GET IT, GET IT RIGHT HERE.

I THINK I SEE WHERE COMMISSIONER LUCAS AND COMMISSIONER OVERTON ARE GOING WITH THIS CURRENTLY RIGHT NOW, THE APPLICANT HAS A FIVE-YEAR LEASE SOMEWHERE ELSE.

OKAY.

THEY'RE IN THERE OVER THERE.

THEY'RE COMMITTED TO THAT LEASE FOR FIVE YEARS, CORRECT.

WHAT WE HAVE ON THE TABLE TODAY, BEFORE US, ARE WE GOING TO ALLOW AN SUP TO COME HERE SO THAT THEY CAN BUILD A PERMANENT CHURCH FACILITY HERE? HOWEVER, THEY WILL NOT START BUILDING ON THIS CHURCH FOR FOUR YEARS.

SO WE KNOW THAT OUR TIMEFRAME ON BUILDING ANYTHING IN THE CITY OF MISSOURI CITY IS A FULL FIVE YEARS.

SO ALL WHAT YOU GUYS ARE ASKING US TO DO IS TO, IS TO NOT HOLD THEM TO THAT FIVE-YEAR TIMELINE.

WE'RE GOING TO LET THEM START BUILDING ON YOUR FOUR, WHICH MEANS THEY WOULD NEED TO GO PAST THE FIVE-YEAR TIMELINE.

I THINK WHAT THE LADIES ARE TRYING TO GET INTO IS IF AT ALL POSSIBLE, IS THERE ANY KIND OF WAY, EVEN AT THE FOUR YEAR MARK, CAN WE GIVE THEM A CERTAIN TIME TO SAY, OKAY, THIS THING NEEDS TO BE TOTALLY DONE BY YEAR EIGHT OR BY YEAR NINE? IS, IS THAT POSSIBLE? THIS IS JAMEELA AGAIN.

THAT'S WHAT I WAS SAYING.

THE LOCAL GOVERNMENT CODE DOES COVER THAT THEIR PROJECT CAN'T GO DORMANT FOR SAY TWO YEARS WITHOUT TRIGGERING A PROBLEM.

SO THERE ARE PROVISIONS UNDER TWO 45 NATURALLY.

AND EVEN WITH SAID, WE WOULD HAVE TO LOOK AT WHAT'S ACTUALLY HAPPENING ON THE PROPERTY THAT CREATES OTHER, UM, ISSUES BECAUSE THEM NOT ACTUALLY TAKING, UM, STEPS TO FINISH THE PROJECT IN ITSELF, UM, TO CREATE LIKE INCENTIVE.

SO TO SPEAK.

WE CAN'T JUST SAY, BUILD THIS.

WHAT IF THEY RAN OUT OF MONEY? BUT IF THE PROPERTY IS DEVELOPED ARE INCOMPLETE AT A POINT WHERE THEY'RE DIFFERENT HAZARDS OR OTHER CODE VIOLATIONS, THAT'S WHAT WE WOULD HAVE TO ADDRESS.

BUT I THINK THERE'S ANY MECHANISM THAT SAYS YOU HAVE TO DEVELOP THIS PROPERTY BECAUSE IT'S THEIR PROPERTY.

AND WE CAN'T TELL PEOPLE WHAT THEY CAN DO.

WE CREATE REGULATIONS EFFECTIVELY.

I'M NOT SURE THAT'S EVEN A CONCERN WE'RE APPROVING TO USE OR NOT.

RIGHT.

OKAY.

I MEAN, THE QUESTION IS, DO YOU ALL WANT TO ATTACH A DEVELOPMENT SCHEDULE, BUT IT'S JUST THE SCHEDULE.

I MEAN, I THINK WE NEED TO LOOK AT IT.

ARE WE GOING TO APPROVE THE USE OR WE'RE NOT GOING TO APPROVE VIEWS IF I COULD JUMP IN, UM, I RAISED MY HAND AND I WAS ASKED TO UNMUTE, UM, MY NAME IS GARRETT DELANO.

I'M THE LEAD ARCHITECT ON THE PROJECT.

WELL, I WAS TRYING TO GET TO YOU, SIR.

I REALLY IT'S.

ALL RIGHT.

OKAY.

COME ON MR. DELANO, WHAT YOU WANT TO DO WELL, THANK YOU EVERYBODY FOR HOSTING THE MEETING TONIGHT AND HERE IN THE SOUTH.

SO, UH, AS, UH, MR. WHITE EXPLAINED, YES, WE ARE INCENTIVIZED TO BE IN THE BUILDING AT THE END OF YEAR FIVE, THEY'VE GOT A FIVE-YEAR LEASE.

THE PLAN IS TO GROW THE CONGREGATION UNTIL IT GETS TO THE POINT WHERE THEY'RE, THEY'RE READY TO MOVE TO THIS NEXT BUILDING.

AND IN REALITY, THE TYPE OF BUILDING THAT WE'RE LOOKING TO BUILD HERE, THE SIZE AND COMPLEXITY IS PROBABLY NOT A 12 MONTH CONSTRUCTION.

IT MAY BE, YOU KNOW, 24 MONTHS,

[00:40:01]

WHICH WOULD PUT US STARTING CONSTRUCTION EVEN SOONER.

SO WE WOULD BE EVEN MORE INCENTIVIZED TO FINISH THE PROJECT.

SO THEY'RE GOING INTO THIS BUILDING AT THE END OF YEAR FIVE, NOT STARTED CONSTRUCTION AND DRAGGING IT OUT.

THAT WOULD BE, UM, SOMETHING THAT OUR, MY CLIENT WOULD NOT WANT TO DO.

NOT ONLY WOULD THAT BE AN EYESORE FOR THE COMMUNITY, BUT IT WOULD BE INCREDIBLY EXPENSIVE ALSO.

SO, UM, THAT'S WHAT I HAD TO SAY.

AND IF YOU GUYS HAVE ANY OTHER QUESTIONS, I'M HAPPY TO ANSWER.

THANK YOU SO VERY MUCH, UH, COMMISSIONER.

SO YOU HAVE ANY QUESTIONS OF MR. DELANEY, OKAY.

AT THIS POINT, LET ME JUST STOP THIS SO I CAN GET THIS TRAIN BACK ON TRACK.

THIS IS GOING TO BE A PUBLIC HEARING.

UM, IS THERE ANYONE HERE THAT WANTED TO SPEAK IN REGARDS TO THIS MATTER? I DO HAVE A COUPLE OF LETTERS OF SUPPORT HERE FROM, I HAVE ONE FROM A JOHN DUFFY.

I DIDN'T KNOW IF HE WANTED TO NECESSARILY SPEAK, BUT HE DID TURN IN A LETTER OF SUPPORT FOR THE PROPOSED ZONING AMENDMENT.

UM, I HAVE ONE HERE FROM GARY GILSON, UM, CHAIRMAN AND TRUSTEE OF LEXINGTON GROVE.

SO THAT MUST BE SOMEWHERE NEAR, UH, BY THE, BY THIS CHURCH.

UH, HE IS ALSO IN SUPPORT.

THAT'S A NEIGHBORHOOD THAT'S NORTH OF THIS.

OKAY.

THAT'S SERIOUS AT THE TOP.

THANK YOU.

UM, WE ALSO HAVE A LETTER OF SUPPORT FROM ALAN OWEN.

HE'S, UH, CONSULTING WITH THESE GUYS AND HE SERVES AS THE, UM, FIRST UNITED METHODIST, UH, FINANCE DIRECTOR, MR. JIMA.

IS THERE ANYONE THAT WANTED TO SPEAK IN REGARDS TO THIS? I CAN'T HEAR A JIMA.

UM, SINCE WE ARE STILL IN THE PUBLIC HEARING PHASE OF THIS, MR. DELANEY, DID YOU HAVE ANYTHING ELSE THAT YOU WANTED TO SHARE ABOUT THE PROCESS ABOUT THE PROJECT? WHAT YOU'VE SHARED THUS FAR WAS VERY VALUABLE.

THANK YOU.

YEAH.

THANK YOU.

UH, I JUST WANT TO TOUCH ON THE CONCERNS ABOUT FLOODING.

I DID SPEAK WITH THE CITY ENGINEER.

I THINK HIS NAME IS JEREMY, AND, UM, HE LET ME KNOW, YOU KNOW, WE ARE IN THE QUAIL VALLEY, UH, UTILITY DISTRICT, AND THAT, ACCORDING TO HIS CALCULATIONS, WE HAVE PLENTY OF CAPACITY IN THAT DRAINAGE DISTRICT.

AND WE WILL HAVE A FULL CIVIL ENGINEERING TEAM ON THE PROJECT.

UH, SO IF IT'S REQUIRED FOR PLANTING, THEN WE WILL HAVE CALCULATIONS FOR THAT.

AND IF WE ARE OVER, UM, THE CAPACITY FOR THE SITE, THEN WE WILL HAVE A DETENTION SYSTEM ONSITE.

HOWEVER, WE DON'T ANTICIPATE THAT.

OKAY.

THANK YOU SO VERY MUCH.

IS THERE A MOTION? I'LL MAKE A MOTION.

WE CLOSE THE PUBLIC HEARING.

THANK YOU, MR. HANEY.

IS THERE A SECOND, SECOND.

THANK YOU, MS. LUCAS, ALL THOSE IN FAVOR TO CLOSE THE PUBLIC HEARING.

HI AND I AS WELL.

UH, THERE ARE NO NAMES ON TONIGHT.

I COUNTED ALL THE EYES.

SO THE PUBLIC HEARING IS CLOSED TO SUBMIT THIS REPORT TO THE CITY COUNCIL WITH A POSITIVE RECOMMENDATION WITH, UH, WITHOUT THE, UH, SITE PLAN AND THE DEVELOPMENT SCHEDULE.

OKAY.

THANK YOU SO MUCH FOR YOUR MOTION, MR. HANEY, IS THERE A SECOND? SECOND.

THANK YOU, MR. O'MALLEY.

IS THERE ANY FURTHER DISCUSSION? OKAY.

MADAM CHAIR.

CAN, CAN I ASK YOU, OR I ASKED HIM TO GO BACK TO THE PREVIOUS SLIDE TO SEE WHAT THOSE DELETIONS OR WHATEVER IT WAS THAT THEY HAD LISTED OUT THERE, WHICH INCLUDED NOT TO ADOPT THE DEVELOPMENT PLAN.

THAT'S ON FILE.

AND THEY GO BACK TO THE, NO, NOT THAT ONE.

I DON'T THINK IT'S THAT ONE.

THAT WAS THE ONE THAT THEY MADE THE RECOMMENDATIONS ON.

CAN YOU SEE IT? THAT'S THE ONE MS. LUCAS.

DID YOU HAVE ANY OTHER DISCUSSION? NO, I'M JUST LOOKING AT THIS YEAR, BUT NO, MS. OVERTON, WAS THERE ANY DISCUSSION? NO.

OKAY.

[00:45:01]

UM, ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE.

AYE AS WELL.

ARE THERE ANY, OKAY, THANK YOU.

ARE THERE ANY NOS OR KNAVES? ABSTENTIONS? AYE.

MOTION CARRIES.

I'M SORRY.

ABSTENTION.

OKAY.

OVER 10.

OKAY.

LUCAS OF SAYING, OKAY, LET ME LOOK.

LET ME GO BACK TO MY NUMBERS.

NOW IT'S SIX OF US ON THE LINE, MR. HANEY AND FOUR YESES.

OKAY.

THANK YOU SO MUCH.

THAT MOTION DOES CARRY IT PASSES.

WE'LL MOVE NOW

[7B. PUBLIC HEARING FOR A PLANNED DEVELOPMENT DISTRICT AMENDMENT]

TO ITEMS SEVEN B.

THIS IS ALSO A PUBLIC HEARING FOR A PLANNED DEVELOPMENT DISTRICT WHERE WE'LL RECEIVE COMMENTS FOR OR AGAINST THE REQUEST BY CARMEN PEARSON, LOVETT, INDUSTRIAL TO A MAN EXHIBIT D AND THE REGULATIONS AND RESTRICTIONS CONTAINED AND PD NUMBER 88.

HELLO, AGAIN, COMMISSIONERS.

CAN YOU ALL HEAR ME? YES.

MA'AM.

IT'S GONE.

YEAH.

THANK YOU.

THIS IS JENNIFER GOMEZ.

UM, THIS IS A REQUEST TO AMEND A PLAN DEVELOPMENT DISTRICT NUMBER 88.

UM, IT'S A LITTLE HARD TO MAKE OUT, UM, ON THE AREA.

UM, BUT IT'S ESSENTIALLY ALL OF THE LAND AREA, UM, TO THE EAST OF THE BEN PARKWAY, UH, NORTH OF TREMOLO FRESNO ROAD.

UM, AND THEN ON THE WEST SIDE, IT'S A BORDER BY OLYMPIA STATES, UM, AND VICKSBURG.

AND THEN AGAIN EXTENDS FROM LAKE OLYMPIA, UH, PARKWAY TO THE SOUTH TO TRAMMELL FRESNO ROAD, UM, ON THE WEST SIDE AND INCLUDES THE DRY CREEK VILLAGE, A RESIDENTIAL SUBDIVISION THAT'S UNDER CONSTRUCTION.

UM, PRESENTLY ON THE EAST SIDE, IT INCLUDES THE NEWLY ANNOUNCED, UM, AMAZON FULFILLMENT CENTER, UM, IS UNDER CONSTRUCTION IN THE AREA THAT, UM, IS CALLED OUT ON THE MAP.

UH, NEXT SLIDE, PLEASE.

THIS IS A LITTLE BETTER DEPICTION.

UM, THIS IS, UH, THE IMAGE THAT IS ATTACHED TO THE EXISTING ORDINANCE AS EXHIBIT B.

UM, THE ORDINANCE IS DIVIDED INTO DIFFERENT SUB DISTRICTS, UH, BY, UH, THE USE, UH, USES PERMITTED WITHIN THE BOUNDARIES OF THE PD.

UM, AS WELL AS DEVELOPMENT REGULATIONS ASSOCIATED WITH, UH, THOSE USES OF THIS PD IS OVER 400 ACRES.

IT'S A HUGE PD, UH, UM, THAT THE COMMISSION PROBABLY REMEMBERS, UH, GENERALLY DESIGNED TO BE A MIXED USE, UM, PLANTED UP CLAN DEVELOPMENT DISTRICT, UM, AND LOOKING AT, UH, SOME OF THE REMAINING AREAS OF THE CITY, UM, THAT HAD, WERE LEFT, UM, FOR US TO BE ABLE TO MAXIMIZE, UH, OF USES, UH, TO SUPPORT, UH, CONTINUED GROWTH IN THE CITY.

UM, SO THIS AREA WAS IDENTIFIED IN THE CURRENT, UH, CITY'S COMPREHENSIVE PLAN, UM, AS A PRIME LOCATION FOR, UM, EMPLOYMENT GENERATING, UH, USES, UH, BECAUSE OF ITS PROXIMITY ALONG THE FOREBRAIN OF PARKWAY AND, UH, ITS CONNECTIONS INTO, UM, OTHER PARTS OF THE REGION.

UM, SO LOVING COMMERCIAL, UM, AND LOVE IT INDUSTRIAL AND I APOLOGIZE, UM, HAS, IS REPRESENTING THE OWNER, UM, FOR MOST OF THE AREA TO THE EAST OF THE FORT BEN PARKWAY.

UM, THEY HAVE BEEN, UH, THE PRIMARY CONTACTS WITH THE CITY, UM, ON THE AMAZON FULFILLMENT CENTER, UM, THE ACQUISITION FOR THAT AND, UM, UH, SUCCESSFULLY, UM, PUSHING THAT THROUGH, UH, VARIOUS CITY PROCESSES.

UM, AND SO WHAT THEY'RE LOOKING AT IS, UH, OPPORTUNITIES FOR, UH, CONTINUED GROWTH, UH, SIMILAR TO, UM, THE, A FULFILLMENT CENTER, UH, BEING ABLE TO PROVIDE THEM OPPORTUNITIES FOR OTHER, UH, BUSINESS PARK, UH, TYPE USES.

SO THE PURPOSE OF THIS AMENDMENT, UM, BASICALLY IS FOR THAT AREA, UH, THAT IS SHOWN IN RED ON THIS MAP.

AND IT'S OUTLINED BY THE DASH LINE OF THAT'S THE FOCUS AREA.

UM, IT'S DESCRIBED IN THE PD AS COMMERCIAL, UH, NORTHEAST SUB DISTRICT AND IT'S, UH, REGULATIONS, UH, UNDER THE CURRENT PD, UM, CALL IT OUT FOR JUST COMMERCIAL RETAIL USE.

THE APPLICATION IS, UM, TO EXPAND THE USE AS PERMITTED, UH, WITHIN THAT AREA, UM, AND ALLOW FOR BUSINESS PARK,

[00:50:01]

UM, USES.

SO ESSENTIALLY WHAT YOU SEE DEPICTED ON THIS MAP OF THAT BLUE AREA EXTENDING, UH, THE SAME, UH, USES PERMITTED AND REGULATIONS EXTENDING THAT ALL THE WAY UP, UH, TO, UH, THE LAKE OLYMPIA FRONTAGE THERE.

NEXT SLIDE PLEASE.

SO IT'S A BIG PD.

UM, A LOT OF PROCESSING WENT INTO, UH, PULLING US TOGETHER, BUT THE PROPOSED AMENDMENT IS, UH, IS VERY SIMPLE.

UM, IT'S A PROPOSED AMENDMENT TO, UH, THE USE REGULATIONS CONTAINED WITH MPD ADA, UH, TO EXPAND THE USES PERMITTED IN THE COMMERCIAL NORTHEAST SUB DISTRICT.

UM, THIS WOULD ALSO RESULT IN, UM, A AMENDMENT TO THE FUTURE LAND USE PLAN.

UH, THE FUTURE LAND USE PLAN FOLLOWS OF THE CURRENT ZONING, UH, DESIGNATIONS FOR THIS AREA.

UM, SO THIS WOULD BE A REQUEST TO AMEND, UH, THOSE DESIGNATIONS AND CHANGE THAT ENTIRE AREA, UH, TO BUSINESS PART.

UM, AND THEN THE, THIS AMENDMENT WOULD INCLUDE, UM, AMENDING THE REGULATIONS AS IT PERTAINS TO THAT COMMERCIAL NORTHEAST SUB DISTRICT, UM, TO ALLOW FOR, UH, BUSINESS PARK DISTRICT REGULATIONS.

UM, SO IN ESSENCE, WHAT IT WOULD BE IS JUST EXPANDING, UM, THE AREA THAT OFFICE WAREHOUSES, UM, OR OTHER BUSINESSES SIMILAR TO THE AMAZON FULFILLMENT CENTER, UM, COULD LOCATE, UM, TO THE EAST OF THE FORK AND PARKWAY.

SO THE STAFF RECOMMENDATION IS TO APPROVE.

WE DO HAVE REPRESENTATIVES FROM LOVETT INDUSTRIAL ON THE CALL, UH, TONIGHT, UM, AND THEY ARE TELLING ME TO CLARIFY THAT THEY DO OWN THE PROPERTY.

SO THEY, UM, NOT ONLY, UH, REPRESENT THE PROPERTY, THEY OWN THE PROPERTY, UM, THEY ARE ON THE CALL AS WELL.

UM, TO ANSWER ANY QUESTIONS, UM, THERE'S SOME ADDITIONAL INFORMATION AS WELL, UM, THAT WAS INCLUDED IN THE PACKAGE JUST TO GIVE YOU A FEEL FOR WHAT THAT DEVELOPMENT COULD LOOK LIKE.

UM, IF THIS AMENDMENT IS APPROVED, THAT IS ALL I HAVE TONIGHT.

AND IF THE COMMISSION HAS ANY QUESTIONS, UM, I CAN TAKE THOSE.

I DO GO AHEAD, MR. HANEY, UM, JENNIFER, SO THE, THE, THE SLIDES YOU SHOWED WITH THE DOTTED LINE AROUND THE BOX WAS VERY HELPFUL.

IT TOOK ME QUITE A WHILE TO FIGURE OUT FROM THOSE STAFF REPORT.

THAT'S EXACTLY WHAT WE WERE TALKING ABOUT.

CAUSE I HAD TO GO BACK AND COMPARE TWO DIFFERENT PICTURES AND FINALLY REALIZED THEY ADDED THE COMMERCIAL PIECE TO IT OR THE BUSINESS DISTRICT TO IT.

UM, BUT THAT'S KIND OF ON THE SIDE.

UM, BUT THE SITE PLAN THAT WAS IN THE REPORT ALSO IS THAT, IS THAT THE AMAZON FACILITY THAT THEY'RE SHOWING OR IS THAT WHAT THEY'RE PROJECTING AS A POSSIBLE FUTURE? UM, THING, IT WAS UNCLEAR IN THE, IN THE MATERIALS, UH, WHETHER OR NOT THAT WAS BECAUSE I WASN'T SURE THAT THAT THAT WOULD FIT IN THE AREA THAT THAT'S OUTLINED IN YOUR DAUGHTER MINDS AND, UH, CARMEN PEARSON WITH 11 INDUSTRIAL.

SHE CAN, UM, PROVIDE YOUR INPUT, UM, ON, UH, THE CONCEPT PLAN THAT THEY INCLUDED IN THERE.

UM, BUT GENERALLY IT WOULD BE A CONCEPTUAL LAYOUT, UM, FOR WHAT'S THEY'D BE DEVELOPED IN THIS COMMERCIAL NORTHEAST TRACK.

CARMEN.

HI EVERYONE.

UM, MR. HANEY, TOO, TO ADDRESS YOUR QUESTION.

UM, THERE, THE SITE PLAN THAT WE INCLUDED, UM, SORT OF HAD THE, THE TWO SEPARATE AREAS.

ONE WAS ABOUT 18 AND A HALF ACRES AND THE OTHER ONE WAS 45.

AND THE AREA TO THE NORTH OF THE EXISTING DITCH IS ABOUT 67 ACRES.

SO WHAT WAS INCLUDED ON THAT SITE PLAN WOULD INDEED FIT, UM, IF THAT ANSWERS YOUR QUESTION? WELL, I GUESS THE, THE SIDE PLAN THAT I WAS LOOKING AT HAD THE MILLION SQUARE FOOT BUILDING, AND I JUST DIDN'T KNOW IF THAT WAS AN ADDITIONAL MILLION SQUARE FEET OR IF THAT WAS WHERE THE ACTUAL AMAZON WAREHOUSE WAS GOING TO LIVE.

YEAH.

SO THE, THE SITE PLAN THAT YOU PROBABLY RECEIVED HAD A PARCEL B OF 83.5 ACRES, AND THAT WAS THE MILLION SQUARE FOOT AMAZON BUILDINGS.

AND THEN WE DO CONTEMPLATE AN ADDITIONAL, UM, LARGER BUILDING ON THE NORTH SIDE AND THEN HOPEFULLY TWO SMALLER BUILDINGS THAT COULD ALSO BE ACCOMMODATED ON THAT 67 ACRES.

OKAY.

YEAH, YOU'RE WELCOME.

I HAD A QUESTION FOR THE DEVELOPER, UM, TRADITIONALLY AFTER, UH, AMAZON BRINGS

[00:55:01]

IN A FULFILLMENT CENTER, HAVE YOU TRACKED THE PREVIOUS LOCATIONS THAT AD FULFILLMENT CENTERS ON WHAT HAPPENS TO THE COMMERCIAL PROPERTY AROUND THAT GENERAL VICINITY AND TRADITIONALLY, DOES THEIR SUPPLY CHAIN FOLLOW THEM, UH, WHETHER IT'S PEOPLE THAT MAINTAIN THEIR VEHICLES OR WHAT HAVE YOU, IS THIS ONE OF THE REASONS WHY YOU'RE ASKING FOR MORE OF THIS TYPE OF PROPERTY? YOU KNOW, THAT THAT'S A REALLY GOOD QUESTION.

AND, UM, I DON'T HAVE A CONCRETE ANSWER FOR YOU IN TERMS OF, OF HAVING SUPPLY CHAIN PARTNERS AS BEING THE TARGET MARKET FOR, UM, THE, THE PD AMENDMENT THAT WE'RE LOOKING FOR.

I THINK IT'S MORE TO, UM, BECAUSE THE, THE FACILITY THAT WE'RE BUILDING RIGHT NOW IS SORT OF, UH, ATTRACTS LIKE FOR LIKE, AND WE, WE REALLY FEEL LIKE THE PROPERTY WOULD LEND ITSELF WELL TO HAVING A CONTIGUOUS FEEL IF WE WERE ALLOWED TO INCLUDE BUSINESS PARK USES, UH, SIMILAR TO WHAT WE'RE BUILDING WITH THE AMAZON FACILITY.

OKAY.

THANK YOU.

COMMISSIONER, DO YOU HAVE ANY OTHER QUESTIONS OF THE APP OF THE APPLICANT WHILE WE HAVE THEM HERE? NO, I DON'T.

OKAY.

THANK YOU SO MUCH, MS. LUCAS, MR. SILVA, MS. OVERTON ONE QUESTION ON THE BUSINESS PARK USAGE, WILL THAT BE RETAIL AT ALL OR MORE WHOLESALE BUSINESSES? WAS THERE ANY, ANY RESTRICTIONS? IS THERE ANY CLASSIFICATION? WHAT TYPE OF BUSINESSES COULD GO IN THAT PARK? SO THIS IS, UH, JENNIFER GOMEZ.

UM, I'LL SPEAK TO THE RESTRICTIONS.

SO YOU'RE THE BUSINESS PARK DISTRICT, UM, ALLOWS GENERALLY FOR ANY COMMERCIAL OFFICE USES.

AND SO IT HAS, IT HAS SOME PERFORMANCE STANDARDS, UH, THAT THOSE USES HAVE TO, UH, MEET GENERALLY, BUT IT'S PRETTY BROAD, UM, DISTRICT.

IT IS BASICALLY COMMERCIAL IF THEY COULD STILL DO COMMERCIAL.

YES.

OKAY.

OKAY.

THANK YOU SO MUCH.

AND THAT QUESTION WAS POSED BY COMMISSIONER OVERTON.

UM, IF THERE ARE NO OTHER COMMENTS THAT NEED TO COME FROM US IN REGARDS TO THIS, THIS IS A PUBLIC HEARING.

UM, I DO HAVE TWO LETTERS IN SUPPORT OF THIS PARTICULAR PROJECT, AND I WANTED TO DENOTE THAT STAFF MAILED OUT OVER 300 NOTICES, UH, TO SURROUNDING INDIVIDUALS WHERE THIS, UH, PROP WORK IN REGARDS TO THIS PARTICULAR APPLICATION.

AND I ONLY HAVE TWO BACK AND THEY WERE BOTH IN SUPPORT.

RUNNERS.

ONE IS FROM A ROCKY LAWYER.

UH, YOU KNOW, HE JUST SAYS HE SUPPORTS THE PROJECT AND THEN WE LIE LIE.

OKAY, THANK YOU.

UM, AND THEN WE HAVE ONE MORE THAT WAS ALSO RECEIVED FROM A LISA NICHOLS, UH, PARKWAY CROSSING.

UH, THAT LETTER IS ALSO IN SUPPORT.

MR. JAMIE, CAN YOU CONFIRM IF THERE IS ANYONE ELSE ON THE LINE THAT WOULD LIKE TO SPEAK IN REGARDS TO THE PROJECT? I DID NOT SEE ANYONE ELSE WISHING TO SPEAK.

ALL RIGHT.

THANK YOU.

IS THERE A MOTION THAT WE CLOSE THE PUBLIC HEARING? THANK YOU.

UH, THANK YOU, MS. LUCAS, IS THERE A SECOND? THANK YOU, MS. ALBERTON, ALL THOSE IN FAVOR TO CLOSE THE PUBLIC HEARING AND I AS WELL, THE EYES HAVE THAT ONE ON TONIGHT.

UH, THE PUBLIC HEARING IS CLOSED.

IS THERE A MOTION THAT WE APPROVE THIS AS A FINAL REPORT AND FORWARD ON TO CITY COUNCIL? SO MOVE.

THANK YOU, MS. LUCAS, IS THERE A SECOND? I WAS WAITING FOR YOU.

ALL RIGHT.

WELL THAT SECOND BE FROM COMMISSIONER OVERTON.

THANK YOU SO MUCH, MISS OVERTON, ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE AND I AS WELL.

ARE THERE ANY NAYS, ANY ABSTENTIONS SEEING NONE THAT MOTION CARRIES AS WELL TONIGHT? WE HAVE NO OTHER MATTERS WITHIN OUR, UH, WE HAVE NO ZONING TEXT AMENDMENTS.

WE HAVE NO OTHER MATTERS WITHIN OUR JURISDICTION.

IS THERE A MOTION? ALL RIGHT, FINE.

[01:00:01]

FINE.

IS THERE A SECOND PLACE? THANK YOU, MR. O'MALLEY ALL THOSE IN FAVOR, SIGNIFY BY SAYING AYE.

AND THE I'S HAVE THAT ON TONIGHT AS WELL.

GOOD NIGHT, LADIES AND GENTLEMEN.

THANK YOU.

THANK YOU SO MUCH.

YOU'RE WELCOME.
