THIS ITEM IS BEING PRESENTED TO YOU FOR YOUR INITIAL CONSIDERATION, INCLUDES THE PROPOSED 2021 TYPES OF LEGISLATIVE AGENDA.

UM, THE AGENDA ITSELF MAY BE PRESENTED OR ADOPTED LATER ON AT THE REGULAR MEETING.

THIS IS JUST AN INTRODUCTION TO THE SUBJECT TO PROVIDE YOU ALL WITH THE PREVIEW.

AS YOU ALL KNOW, THE 87 SESSION STARTED ABOUT A WEEK AGO, AND YOU'LL SEE, IN THE COVER MEN THOUGH, AS WELL AS IN THE AGENDA THAT FIT THE CITY'S PROPOSED, UH, PRIORITIES AND THEY'RE LISTED, THEY INCLUDE ECONOMIC DEVELOPMENT, POVERTY TAX REFORM, PUBLIC SAFETY, SPECIAL DISTRICTS, ANNEXATION, AND ROUTE TONES WITH THAT.

UH, I WILL GO AHEAD AND TURN OVER THE PRESENTATION TO THE CITY OF LEGISLATIVE CONSULTANT.

KAREN CANARD, AS YOU ALL MIGHT REMEMBER, PARENTS HAS BEEN A CONSULTANT WITH

SHE IS A PARTNER WITH GREENBERG TRAURIG AND IS A FORMER CITY ATTORNEY HERSELF AND A FORMER EMPLOYEE, UH, ATTORNEY FOR TEXAS MUNICIPAL LEAGUE.

WITH THAT, I'LL TURN IT OVER TO KAT.

UH, I'M JUST GOING TO GIVE YOU A VERY HIGH LEVEL PREVIEW OF WHAT'S GOING TO POTENTIALLY BE CONSIDERED IN THE STATE LEGISLATURE.

UH, THIS YEAR, UH, AS JOYCE MENTIONED, UH, MYSELF AND MY COLLEAGUES AT GREENBERG TRUCK, WE'VE REPRESENTED THE CITY SINCE 2017.

AND, UH, WE ARE REALLY PROUD AND HAPPY TO REPRESENT YOU AGAIN IN THIS 2021 LEGISLATIVE SESSION.

UH, AS MOST OF YOU KNOW, THE TEXAS CONSTITUTION IS VERY SPECIFIC ABOUT HOW THE TEXAS LEGISLATURE OPERATES, UH, UNDER CONSTITUTION.

IT SAYS THAT THEY MEET EVERY TWO YEARS FOR 140 DAYS.

UH, AND SO THAT PROCESS STARTED AS EQUAL THAT LAST WEEK, UH, UNDER THE CONSTITUTION AS WELL.

UH, LEGISLATORS ARE ALLOWED TO START PRE-FILING BILLS.

AND THAT STARTED, UH, BACK IN NOVEMBER ON NOVEMBER 9TH, BILL PRE-FILING STARTED, UH, THEY HAVE FROM THE FIRST DAY OF THE SESSION STARTING, THEY HAVE 60 DAYS TO FILE BILLS.

AND SO THE BILL FILING DEADLINE WILL END ON MARCH 12TH, WHICH IS THE 60TH DAY AFTER THE SESSION STARTS.

AND THEN ALSO THE HUNDRED AND 40TH DAY OF THE LEGISLATURE.

THIS SESSION IS MAY 28TH AND UNDER THE 140 DAY CALENDAR.

THAT INCLUDES HOLIDAY WEEKENDS.

SO YOU COUNT 140 DAYS FROM JANUARY 12TH AND YOU GET TO MAY 28TH AND IT'S CALLED SUNNY DIED AND IT'S LATIN FOR THE LAST DAY.

AND SO THE LAST DAY OF THE SESSION THIS YEAR IS MAY 28TH.

AND THEN AFTER THAT PERIOD, THE GOVERNOR WILL HAVE UNTIL JUNE 17TH TO EITHER VETO LEGISLATION THAT WAS PASSED OR ALLOW IT TO BECOME, UH, THE LAW WITHOUT HIS SIGNATURE.

AND THEN UNDER THE CONSTITUTION, MOST BILLS WILL BECOME EFFECTIVE, UH, UH, 90 DAYS AFTER THAT, WHICH IN THIS CASE WOULD BE AUGUST THE 27TH, UNLESS THERE'S SOME PROVISIONS WHERE THE LEGISLATURE CAN, UH, THROUGH A THREE FORCE VOTE, UH, MAKE LEGISLATION EFFECTIVE IMMEDIATELY.

AND, AND THAT HAPPENS QUITE OFTEN, WHEREBY IF THEY HAVE A SUPER MAJORITY VOTE ON LEGISLATION, THE LEGISLATION BECOMES EFFECTIVE IMMEDIATELY.

SO THAT'S JUST A GENERAL OVERVIEW OF THE PROCESS.

UH, WHAT WE'VE SEEN SO FAR IS, UH, FROM 2019 TO SO FAR UNDER A PRE-FILING IT AS OF FRIDAY OF LAST WEEK, UH, BETWEEN PRE-FILING AND FRIDAY OF LAST WEEK, THAT'S THE SELECTION LITERATURE PERIOD THAT WASN'T NECESSARILY THAT THERE WILL BE STUFF SESSION.

THAT JUST MEANS THAT WE'RE AT THE PACE OF SO FAR.

UH, I DO THINK THAT MOST PEOPLE BELIEVE, PROBABLY BE A DISCUSSION, BUT THAT IS STILL TO BE DETERMINED.

I WILL SAY THAT CITIES, THIS LEGISLATIVE SESSION, WE'LL PROBABLY SEE SIMILAR CHALLENGES THAT THEY'VE SEEN IN THE LAST TWO SESSIONS.

AND FOR THOSE OF YOU WHO ARE NEW TO THE COUNCIL, UH, CITIES UNFORTUNATELY SEEN SOME REALLY TOUGH CALENDARS IN PAST LIMITS TO THESE, UH, FORTIES PARENTS.

WE ARE HAVING A HARD TIME HEARING YOU.

OKAY, CAN YOU HEAR ME NOW MUCH BETTER? THANK YOU.

AND SO I WAS JUST SAYING THAT SIMILAR CHALLENGES, UH, IF WE'LL GO TO THE NEXT SLIDE, WE'LL GO THROUGH WHAT THOSE CHALLENGES WILL LOOK LIKE AS WE GO THROUGH THIS SESSION.

SO ONE OF THE MOST IMPORTANT THINGS THAT WE, UH, AT GT, UH, LOOK OUT FOR THE CITY OF MISSOURI CITY SPECIFICALLY, IS WE LOOK AT, UH, BILLS THAT RELATE TO ANNEXATION AND ATJ REFORM.

AND WE SPECIFICALLY FOCUS ON THAT FOR THE CITY OF MISSOURI CITY, BECAUSE YOU HAVE THOSE REALLY CRITICAL STRATEGIC PARTNERSHIP AGREEMENTS IN YOUR CITY.

AND SO WE, WE REALLY TRACK ALL OF THE BILLS ARE ANY BILLS RELATED TO ANNEXATION, AND ETG J REFORM

TO MAKE SURE THAT NO LEGISLATION NEGATIVELY IMPACTS YOUR CURRENT AGREEMENTS.

SO THAT'S ALWAYS NUMBER ONE ON WHAT WE ARE TRACKING FOR YOU, AND WE WILL CONTINUE TO DO THAT THIS LEGISLATIVE SESSION.

SO THE MOST IMMEDIATE ISSUES, AND YOU PROBABLY READ A LOT ABOUT THIS, THAT THE CITIES ARE PROBABLY GOING TO BE LOOKING AT, AND THAT WE HAVE SEEN BILLS FILED THIS LEGISLATIVE SESSION.

FIRST BROAD CATEGORY OF WHAT'S REFERRED TO AS POLICE REFORM.

THERE HAS ALREADY BEEN ONE LARGE BILL OF REFORM AS REFERRED TO AS THE GEORGE FLOYD ACT AND, UH, YOUR POLICE DEPARTMENT AND YOUR POLICE CHIEF PROBABLY HAS ALREADY THROUGH HIS ASSOCIATION, THE POLICE CHIEF ASSOCIATION, TO LOOK AT IT.

BUT MOST OF THE BILLS THAT ARE COMING THROUGH THIS LEGISLATIVE SESSION, WE'LL LOOK AT THINGS LIKE REQUIRING POLICE TO HAVE CERTAIN TYPES OF POLICIES FOR THEIR DEPARTMENTS, CORE THINGS LIKE OFFICERS BE REQUIRED TO INTEREST.

SEE IF THEY, WHEN YOU FORCE OR TO REPORT ON AUDRA TO SUPPORT BILLS, THAT ADDITIONAL TRAINING ALSO PROHIBIT THINGS LIKE CHILD CALLS AND OTHER TYPES OF POLICE TACTICS.

MAYBE THESE TYPES OF DEALS, LOTS OF POLICE DEPARTMENTS HAVE ALREADY THOSE TYPES OF POLICIES, BUT THESE BILLS ARE INTENDED TO HAVE TYPES OF POLICIES AND CHAIN THROUGHOUT THIS DAY.

UM, SOME PEOPLE, YOU KNOW, IT'S UM, BECAUSE, UM, YOU KNOW, WE SAW THE ECONOMY, UH, ACROSS THE BOARD, EVERY CITY DEPARTMENT.

AND SO A LOT OF PEOPLE DECREASE IN POLICE FUNDING.

GOOD EVENING, MAYOR AND COUNCIL AGAIN, GREENISH MASTER PLAN IS ONE OF THE UPDATING THE DRAINAGE MASTER PLAN IS ONE OF THE STRATEGIES THAT IS FUNDED THROUGH THE FISCAL YEAR 20 CAPITAL IMPROVEMENTS PROGRAM.

UH, THE CITY COUNCIL

AUTHORIZED A CONTRACT, UH, IN APRIL LAST YEAR, UH, TO, UH, FOR THIS INITIATIVE.

UH, TWO THINGS THAT THE COUNCIL EMPHASIZED DURING THE AUTHORIZATION WAS THAT THEY WANTED A MID-LEVEL PROJECT UPDATE ON WHERE WE ARE AND, UH, KIND OF THE, UH, PROGRESS REPORT, SO TO SPEAK ON THE PROJECTS.

SO WE'RE HERE TO GIVE THAT TODAY AND ALSO WHAT THE COUNCIL IS AND EMPHASIZED BACK THEN WAS TO SEEK CITIZENS AND STAKEHOLDERS INPUT.

AS PART OF THIS UPDATE PROCESS.

JEREMY DAVIS WAS MY CORE PRESENTER HERE, THE ASSISTANT CITY ENGINEER, AND HE IS LEADING THIS PROJECT ALONG WITH THE CONSULTANT TEAM FROM WALTER P. MOORE AND FREESE AND NICHOLS.

UH, JUST LIKE, AS YOU KNOW, AS YOU ALL MAY KNOW THAT, UH, WE ARE DIFFERENT WHEN IT COMES TO UTILITIES HERE IN THE CITY, BECAUSE OF THE MUNICIPAL UTILITY DISTRICTS.

WE'RE ALSO VERY DIFFERENT HERE IN THE CITY WHEN IT COMES TO GRAINAGE.

UH, THE REASON PRIMARILY IS A LOT OF ENTITIES SHARE DRAINAGE ROLES AND RESPONSIBILITIES CITY HAS SOME ROLE TO PLAY.

SO DOES THE DRAINAGE DISTRICTS FOR PENN COUNTY AND HARRIS COUNTY, THE LEVEE IMPROVEMENT DISTRICTS, AND MORE IMPORTANTLY, THE MUNICIPAL UTILITY DISTRICTS WE'LL, UH, WE'LL JUST OVER TO JEREMY AND HIS TEAM.

UH, WHAT THEY WILL COVER TODAY IS WHAT WERE THE MAJOR GOALS IDENTIFIED FOR THIS UPDATE, WHERE WE ARE NOW IN WHAT'S OUR PATH MOVING FORWARD, AND MORE IMPORTANTLY, SOLICIT ANY FEEDBACK FROM THIS COUNCIL AS WE, UH, TRY TO WRAP THIS PROJECT UP, UH, JEREMY, THIS IS BACK TO YOU AND I WILL BE THERE AT THE END TO ANSWER ANY QUESTIONS THAT THE MAYOR AND COUNCIL MAY HAVE.

SO A AS SHAWSHEE SAID, UH, THIS UPDATE WAS ORIGINALLY PRESENTED TO COUNCIL LAST YEAR, UH, AFTER WE SELECTED OUR CONSULTANTS.

UM, SINCE NOW WE HAVE SOME NEW MEMBERS IN COUNCIL I'D LIKE TO GO OVER, UH, SOME OF THE MAJOR GOALS OF THIS UPDATE AND PROVIDE SOME BACKGROUND INFORMATION.

SO, UH, FOR THIS UPDATE, WE HAVE FIVE GOALS HERE, UNDERSTANDING THE CITY'S ROLES AND RESPONSIBILITIES, UH, COMPLIMENTING OTHER ONGOING STUDIES, UH, FOUR BEING COUNTIES CURRENTLY UPDATING THEIR MASTER PLAN AS WELL.

UH, HIGH LEVEL UPDATE OF WATERSHED MASTER PLANS EVALUATING THE ATLAS 14 CRITERIA AND THE BROWSES BACKWATER IMPACTS AND INUNDATION MAPPING.

SO HERE'S A BASIC TIMELINE OF WHAT HAS HAPPENED AND A BASIC SCHEDULE OF OUR PROGRESS.

SO ON THE FIRST QUARTER OF 2020, UH, WE HAD OUR CONSULTANT SELECTION AND WE CHOSE WALTER P. MOORE AND FREEZED NICHOLS.

UH, THEY'RE ALSO THE TEAM THAT'S PERFORMING THE UPDATE FOR, UH, FORT BEND COUNTY.

UH, THE CONTRACT WAS AUTHORIZED BY COUNCIL IN APRIL 20TH, 2020.

UH, THE FIRST PART OF OUR UPDATE, UNDERSTANDING THE CITY'S ROLES AND RESPONSIBILITIES AS A HUNDRED PERCENT COMPLETE, UH, WE HELD A WORKSHOP ON AUGUST 25TH, 2020, UH, WITH SOME OF OUR STAKEHOLDERS SUCH AS THE MUD DISTRICTS AND THE LIDS.

UH, THE OTHER PORTION OF THIS UPDATE, THE MASTER PLAN ASSESSMENT IS A HUNDRED PERCENT COMPLETE.

UH, THE HIGH LEVEL UPDATE OF OUR WATERSHED MASTER PLAN IS CURRENTLY ONGOING.

WE'RE 75% COMPLETE.

UH, THE BRAZOS BACKWATER IMPACTS AND INUNDATION MAPPING IS STILL ONGOING AND WE'RE 45% COMPLETE AND EVALUATING THE ATLAS 14 CRITERIA, UH, WERE EXPECTED TO COMPLETE THAT IN FEBRUARY OF 2021.

SO THEY EXPECT TO COMPLETION OF THIS STUDY IS, UH, JUNE 30TH, 2021.

UM, SO UNDER THE CITY'S EMERGENCY OPERATION CENTER OR EOC, WE MANAGED STREET CLOSURES, POTENTIAL HIGH WATER RESCUES, UH, COORDINATE RESOURCE REQUESTS AND, UH, WORK ON COMMUNICATION AND OUTREACH.

SO, UH, ANOTHER MAJOR PART OF THIS STUDY WAS TO DETERMINE EXACTLY WHERE THE CITY DIRECTLY MAINTAINS DRAINAGE AND WHO MAINTAINS DRAINAGE IN THE OTHER AREAS OF THE CITY.

SO IN THE VAST MAJORITY OF OUR CITY, THE DRAINAGE ROLE AND RESPONSIBILITIES LIE WITH THE MUDS OR LIDS FOR THAT AREA.

SO ON THIS MAP, WE SHOW WHERE THE CITY DIRECTLY HAS A ROLE.

UH, SO THAT'S EVERYWHERE IN BLUE, UH, EVERYWHERE THAT'S NOT IN BLUE IS, UH, IS THE MUD OR THE LIDS FOR THAT AREA.

SO EVEN THOUGH THE CITY DOES NOT DIRECTLY MAINTAIN THE DRAINAGE THROUGHOUT THE ENTIRE CITY, UH, DURING A DISASTER RESPONSE SCENARIO, MISSOURI CITY PLAYS THE ROLE OF COLLECTING RESOURCE REQUESTS FROM EACH OF THE MUDS AND LIDS.

SO REOC HAS BEEN RESPONSIBLE FOR COMMUNICATING THOSE NEEDS UP THE CHAIN TO THE COUNTY'S EMERGENCY CENTER.

AND THIS IS JUST A GRAPHIC SHOWING THE PROGRESSION FROM THE MINES TO THE CITY AND THE COUNTY.

AND SO ON NEXT SLIDE.

SO TO GAIN EVEN MORE INFORMATION ABOUT ROLES AND RESPONSIBILITIES, WE ALL REACHED OUT TO EVERY MUD AND LEAD WITHIN MISSOURI CITY AND OUR ETJ, UH, ON AUGUST OF 2020.

SO AT THIS MEETING, WE ALSO HAD AN ATTENDANCE FROM FORT BEND COUNTY DRAINAGE DISTRICT AND THE HARRIS COUNTY FLOOD CONTROL.

NEXT SLIDE AFTER PERFORMING OUR RESEARCH, UH, THE TEAM DETERMINED THAT, UH, MUDS ARE RESPONSIBLE FOR PLANNING, PERMITTING, AND MAINTENANCE WITHIN THEIR AREAS.

UH, THEIR ROLES ARE TO RECLAIM THE HAZARDOUS FLOODPLAIN LAND FOR DEVELOPMENT CONSTRUCT AND MAINTAIN FLOOD PROTECTION, LEVIES, MAINTAIN PUMP STATIONS AND OPPORTUNITY STRUCTURES, AND DEVELOP AND IMPLEMENT AN EMERGENCY ACTION PLAN.

WE TOOK EXISTING MODELS DEVELOPED SEVERAL YEARS AGO AND INCORPORATED HIGH LEVEL UPDATES AS NEEDED EXAMPLES, EXAMPLES OF HIGH LEVEL UPDATES INCLUDES INCORPORATION OF RECENT DEVELOPMENT AND READINESS PROJECTS.

USE OF NEW MODELING METHODS RECENTLY ADOPTED BY FOUR MAIN COUNTY AND HARRIS COUNTY AND INCLUSION OF NEW RAINFALL DATA.

FOR EXAMPLE, WE ARE ACCOUNTING FOR THE FACT THAT THE A HUNDRED YEAR RAINFALL INCREASED FOR APPROXIMATELY 13 INCHES TO ABOUT 17 INCHES.

NEXT IS LIGHT.

ONE OF THE PRODUCTS OF THIS MODEL EXERCISE IS THE CREATION OF WIN INUNDATION MAPPING FOR SEVERAL RAINFALL AS SCENARIOS.

SO WHAT WE ARE DOING IS ANALYZING, UM, DIFFERENT SCENARIOS THAT RANGE FROM 40 INCHES IN ONE HOUR TO A MULTI-DAY STORM, LIKE THE ONE WE SAW DURING HURRICANE HARVEY AND THE EACH SCENARIO PRODUCES DIFFERENT INUNDATION MAPPING, WHICH AN INUNDATION MAP IS A PRODUCT THAT REFLECTS THE AREAS THAT ARE SUBJECT FLOODING, UH, DURING A STORM EVENT.

SO THE CITY AND THE EMERGENCY

OPERATION CENTERS STOP, WE HAVE INFORMATION TO BLOCK POTENTIAL FALLING CONDITIONS FOR THESE VARIOUS SCENARIOS THAT WE MODEL.

AND AT THE BOTTOM OF THE GRAPHIC, YOU WILL SEE KIND OF THE PROCESS THAT HOW THIS INFORMATION IS GOING TO BE USED.

THERE IS GOING TO BE AN INUNDATION MAP LIBRARY, ONE FOR EACH SCENARIO THAT WILL REFLECT DIFFERENT CONDITIONS OR STORMS. THEN THAT LIBRARY IS GOING TO BE AVAILABLE FOR CITY TO DETERMINING WHAT, WHAT IS THE SCENARIO THAT BEST MATCHES THE RAINFALL THAT IS BEING FORECASTED.

AND WITH, WITH THAT INFORMATION LIKE WIDER ELEVATION DEPTH OF WATER, THE NEW ADDITION, EXTENTS AT DIFFERENT LOCATIONS CAN BE USED TO FACILITATE EMERGENCY CONDITIONS AS JEREMY PRESENTED AT THE BEGINNING.

THINGS LIKE HIGH WATER RESCUES ON CITY CLOSERS ARE PART OF THE CITY'S RESPONSIBILITIES, AND THIS INFORMATION CAN BE USED TO IDENTIFY THOSE AREAS OF CONCERN.

IN ADDITION TO THOSE HIGH LEVEL HIGH LEVEL UPDATES, UH, WE ARE DOING ADDITIONAL WORK INTO SPECIFIC WATERSHEDS.

ONE IS THE WILLOW WATER WHOLE WATERSHED IN WHICH, UM, WE ARE IN ADDITION TO UPDATING PREVIOUS STUDIES TO NEW CRITERIA.

UM, WE ARE LOOKING AT A SPECIFIC RECOMMENDATIONS FOR REGIONAL DETENTION PONDS THAT ARE IN THE PROCESS OF BEING BUILT BY THE CITY.

SO OUR MODEL EXERCISES ARE DEFINING THOSE RECOMMENDATIONS AND THERE WILL BE NO PROVIDING DIRECTIVE ON, ON THE DESIGN THAT THE CITY, UM, NEEDS TO PURSUE AS A DESIGN MOVEMENT.

NEXT IS LIGHT.

THE SECOND WATER SHEDDING, WHICH ARE DOING, UM, ADDITIONAL WORK IS CANGIALOSI DITCH IN KANJI IN .

UH, THERE IS A PORTION OF THIS CHANNEL THAT IS PROPOSED TO BE IMPROVED.

IT'S ABOUT 4,400 LINEAR FEET OF CHINA.

UM, PROPOSED TO BE WIDENED ON OUR MODELING EXERCISE IS PROPOSING A SPECIFIC RECOMMENDATION OF WHAT NEEDS TO BE INCORPORATED IN THE DESIGN TO ACHIEVE THE GOALS OF, UH, INITIALLY PROPOSED IN THE INITIAL STUDIES FOR THIS WATERSHED.

WE HAVE A BETTER PICTURE OF HOW THE BRUSSELS RIVER IMPACTS THE CITY.

THIS IS GOING TO PROVIDE VERY VALUABLE INFORMATION DURING FUTURE FLOODS.

THE FIRST SCENARIO CORRESPONDS TO SUNDAY CONDITIONS WHERE THERE IS NO RAINFALL WITHIN THE CITY, BUT A LARGE FLOOD MAY BE COMING DOWN THE BRESLOW SWEETER.

THIS IS SIMILAR TO WHAT HAPPENED DURING THE MEMORIAL DAY 2016 FOR THIS CONDITION.

WE ARE ESTABLISHING WHAT OUR LEVELS ARE.

FIVE KEY LOCATIONS THAT ARE SHOWN IN THE MAP, AND WE'RE GOING TO BE DOING THIS FOR VARIOUS STAGES IN THE RIVER AT THE RETREAT.

IN ADDITION, EXTENTS OR WATER SURFACE ELEVATION WHEN RICHMOND HITS A STAGE 50, SO YOU CAN SEE THE AREAS THAT ARE IMPACTED WITHIN THE CITY, AND YOU CAN EVEN CLICK ON THE VARIOUS LOCATIONS AND YOU CAN GET A VALID FOR THE WATER SURFACE ELEVATION.

THIS IS AN EXAMPLE FOR THE SAME, UH, CONDITIONS THAT THE RICHMOND GAUGE, EXCEPT THAT THE INFORMATION PROVIDED ALLOWS US TO KNOW HOW DEEP THE WATER IS AT VARIOUS LOCATIONS ACROSS THE CITY.

THE FIRST STEP IN THE, AND THIS PROCESS HAS ALREADY BEEN COMPLETED, AND WE'RE IN THE PROCESS OF COMPLETING STEP TWO THAT I'M GOING TO SHOW NEXT, NEXT SLIDE, PLEASE.

THE SECOND SCENARIO CORRESPONDS TO WHEN A LOCAL STORM EVENT IS HAPPENING AT THE SAME TIME AS THE FLOOD IN THE BRAZOS RIVER, LIKE WHAT HAPPENED DURING HARVEY? THIS IS WHAT WE CALL A COINCIDENCE RAINFALL EVENT AND HAS THE POTENTIAL TO HAVE MORE SEVERE, SEVERE IMPACTS.

WE WILL BE EVALUATING DIFFERENT CONDITIONS ON THE BRAZOS RIVER, COMBINED WITH DIFFERENT RAINFALL INTENSITIES THAT WILL GENERATE A LIBRARY OF INUNDATION MAPS THAT CAN BE USED FOR EMERGENCIES.

SO WE CAN IDENTIFY THE AREAS THAT ARE, UH, VULNERABLE TO FLOODING OR THE VARIOUS CONDITIONS.

UH, ONE OF THE THINGS THAT WE'RE LOOKING AT POTENTIALLY COMING, UH, THIS LEGISLATIVE SESSION IS, UH, LOTS OF LEGISLATION RELATED TO CREATING A PRESUMPTION OF, OF, OF COVID AS A DISEASE, NOT ONLY IN THE PUBLIC SAFETY, UH, UH, ARENA, BUT FOR ALL EMPLOYEES.

AND SO THERE, THERE ARE A COUPLE OF BILLS OUT THERE SPECIFICALLY RELATED TO PUBLIC SAFETY EMPLOYEES.

AND LET ME JUST SAY WE WOULD NOT OPPOSE ANY OF THAT, BECAUSE LIKE I SAID, THAT'S, UH, THAT'S SOMETHING THAT CITIES ALREADY DEAL WITH IN RELATIONS TO POLICE IN FAR AND THOSE KIND OF DISEASE PRESUMPTION, BUT THE POTENTIAL TO EXPAND THAT, UM, TO ALL EMPLOYEES AND THE FINANCIAL IMPLICATIONS THAT THAT COULD POTENTIALLY HAVE, UH, ON CITIES, UH, TO, TO MAKE A PRESUMPTION, UH, FOR THAT.

AND THEN FINALLY, UH, THERE'VE BEEN SEVERAL BILLS.

I THINK WE TALKED ABOUT THIS, UH, WHEN WE DID OUR WRAP-UP WITH THE CITY, UH, AT THE END OF THE 2019 LEGISLATIVE SESSION, UH, THE BILLS HAVE ALREADY BEEN PASSED.

UH, THERE IS LEGISLATION THAT WOULD PROHIBIT CITIES FROM, UH, ENGAGING, UH, LOBBYISTS TO LOBBY ON BEHALF OF CITIES AT THE LEGISLATURE, OR THE BILL IS ALSO WITH PROHIBITS CITIES, FROM PAYING DUES TO ORGANIZATIONS LIKE THE TEXAS MUNICIPAL LEAGUE OR OTHER ORGANIZATIONS LIKE YOUR LOCAL CHAMBER, IF THOSE ORGANIZATIONS HIRE LOBBYISTS AT THE STATE LEGISLATURE.

AND SO, UM, THOSE ARE KIND OF REAL HIGH LEVEL, UM, UH, ISSUES THAT WE SEE COMING THERE HAVE BEEN BILLS FILED.

WE THINK THERE WILL BE OTHER BILLS FILED UNDER THOSE KINDS OF SIX BROAD TOPICS.

IT WOULD REQUIRE THE STATE TO STUDY THE INTERPLAY

OF LOCAL AND STATE REGULATIONS RELATED TO GROUP HOMES.

UH, LAST, UH, LEGISLATIVE SESSION.

WE, WE GOT A HEARING ON THE, UH, COUNCIL MEMBER BONEY AND, UH, UH, SOMEONE FROM THE POLICE DEPARTMENT CAME UP AND THEY TESTIFIED ON THE BILL WHEN IT WAS IN THE HOUSE.

UH, UNFORTUNATELY, UM, THERE IS A, UH, YOU KNOW, PRETTY SIGNIFICANT, UH, GROUP HOME, UH, LOBBY THAT FOR SOME REASON, DOESN'T EVEN LIKE A STUDY OF THE ISSUE.

AND SO WE WILL WORK IT AGAIN THIS YEAR.

IT WAS PRE-FILED ON THE VERY FIRST DAY OF PRE-FILING NOVEMBER, THE NINTH, UH, REPRESENTATIVE REEL FILED IT, UM, WITH COVID.

HOWEVER, UM, THINGS ARE A LOT MORE DIFFICULT, THIS LEGISLATIVE SESSION.

I DON'T KNOW IF YOU GUYS HAVE HEARD, BUT WE'VE ALREADY HAD ONE MEMBER FROM THE FIRST WEEK WHO HAS TESTED POSITIVE FOR COVID.

UH, IT'S IT'S BEEN PUBLICLY ANNOUNCED, SO I'M NOT SAYING ANYTHING OR SPEAKING OUT OF TURN.

HE WAS ONE OF THE MEMBERS WHO INTRODUCED THE SPEAKER.

HE HAD TESTED NEGATIVE ON THE DAY OF THE SESSION TO GO INTO THE CAPITOL.

THIS PRESENTATION IS COVERING THE OVERVIEW OF THE PROPOSED AGREEMENT BETWEEN THE CITY AND SIENNA MUNICIPAL UTILITY DISTRICT.

NUMBER ONE REGARDING WASTEWATER REUSE NEXT LOT TO START A QUICK OVERVIEW OF TYPE ONE.

RECLAIMED WASTEWATER USES OUR RESIDENTIAL IRRIGATION PARKS, GOLF COURSES, IRRIGATION IRRIGATION OF FOOD CROPS, UH, TOLL THAT FLUSHING AND REFILLING OF WATER BODIES.

FOR EXAMPLE, LIKE PONDS THAT WE COULD USE FOR FIRE SUPPRESSION.

NEXT LOT, THIS MAP SHOWS IN YELLOW, THE AREAS IN OUR CITY THAT USES PRIMARILY SURFACE WATER AND THE GREEN AREA OF THE MAP, OUR GROUNDWATER USERS AND THE BLUE DOTS ARE GROUNDWATER WELL PLANTS JUST TO GIVE YOU A REFERENCE.

AND THE RED AREA IS WHERE OUR SURFACE WATER TREATMENT PLANT IS LOCATED.

THE CITY WILL BENEFIT BY REUSE OF TYPE ONE RECLAIMED WASTEWATER BY THE CONTINUATION OF OUR FORT BEN SUBSIDENCE DISTRICT MANDATES OF GROUND WATER REDUCTION OVER USE CREDITS UNTIL THE YEAR 2025.

AND YOU SEE THAT 30%, 60% WE'RE CURRENTLY AT 40% GROUNDWATER REDUCTION.

NEXT SLIDE, OUR SURFACE WATER TREATMENT PLANT PHASE TWO EXPANSION, UH,

FROM 20 MILLION GALLONS PER DAY TO 20 MILLION GALLONS PER DAY IS NEAR COMPLETE.

NEXT SLOT GROUNDWATER REDUCTION MANDATES HAVE ASSOCIATED COSTS SUCH AS SURFACE WATER TREATMENT, PLANT OPERATIONS AND MAINTENANCE COSTS, CAPITAL IMPROVEMENT, PROJECT COST FOR EXPANDING THE TREATMENT CAPACITIES AT OUR SHELTERS WATER TREATMENT.

THIS BRINGS US TO THE SALIENT POINTS FOR THIS EVENING.

THE CITY AND CNM MISS SCHOOL DISTRICTS BEGAN A DISCUSSION ABOUT TYPE ONE WASTEWATER REUSE BACK IN THE YEAR 2015, THE ESTIMATED DIFFERENCE IN COST TO DESIGN AND BUILD A MEMBRANE BIOREACTOR ALSO KNOWN AS AN NBR TYPE WASTEWATER TREATMENT PLANT VERSUS A CONVENTIONAL TYPE WASTEWATER TREATMENT PLANT TO ACHIEVE THIS TYPE ONE REUSE TREATMENT WATER WAS APPROXIMATELY $2 MILLION.

UH, SIENNA HAD RELIED ON THE CITY TO PAY THIS DIFFERENCE IN COST FOR THE MORE ADVANCED DESIGN TO ACHIEVE THE DESIRED TYPE ONE, REUSE WATER QUALITY.

THE DIFFERENCE BETWEEN A TYPE ONE AND A TYPE TWO, A REUSE IS THAT A TYPE ONE IS MUCH CLEANER WATER QUALITY, AND IT REQUIRES THIS MEMBRANE FILTERING PROCESS WITHIN THE TREATMENT PLANTS IN CONJUNCTION WITH THE TANGIBLE BENEFITS OF TYPE ONE RECLAIMED WATER USES THE CITY WOULD ALSO PROMOTE CONTINUING ENVIRONMENTAL STEWARDSHIP ALONG WITH PARTICIPANTS OF THE GROUNDWATER REDUCTION PLAN OVERSIGHT COMMITTEE THAT HAS BEEN USUALLY SUCCESSFUL FOR OUR CITY.

NEXT SLIDE NEGOTIATIONS ON THE TERMS OF THE REUSE AGREEMENT HAVE TAKEN ABOUT TWO YEARS UNTIL FINALLY ON DECEMBER THE THIRD 2020, THE GRP OVERSIGHT COMMITTEE VOTED UNANIMOUSLY TO ACCEPT AN INVESTMENT CONCEPT.

THAT INCLUDES A PROFIT SHARE.

NEXT SLIDE.

SO THIS IS, UH, WHAT THE GRP, UH, COMMITTEE'S RECOMMENDATION IS, IS THE INVESTMENT OF $2 MILLION TO SIENNA MUD ONE.

THEN SIENNA MUD ONE WOULD BE RESPONSIBLE FOR FUTURE INFRASTRUCTURE EXPENSES, WHICH THEY CALL PURPLE PIPE CNM.

ONE WOULD ALSO BE RESPONSIBLE FOR BILLING THE ONM EXPENSES TO THE CUSTOMERS.

AND, UM, THERE WOULD BE A FIXED PROFIT SHARING VARIABLE.

NOW THE 50 50 PROFIT SHARING, IT COULD GO UP, IT COULD GO DOWN, THERE WOULD BE A, A FLOOR OF, OF 27 AND A HALF CENTS PER THOUSAND GALLONS OF WASTEWATER SALT.

AND THAT WOULD BE IN PERPETUITY.

UM, WE'RE WORKING ON, WE'VE ALREADY WRITTEN A DRAFT CONTRACT THAT WILL BE DISCUSSED AT THE NEXT COUNCIL MEETING, AND IT'S A CORE OF 40 YEARS.

UH, THE INVESTMENT WOULD BE, UH, RETURNED BACK TO THE CITY, UM, WITH A CHART THAT I HAVE ON THE NEXT PAGE IN ABOUT 30 YEARS.

AND THAT'S THE MINIMUM NEXT SLOT.

SO HERE'S AN, I KNOW YOU JUST KIND OF HARD TO READ, BUT, UM, AT THE TOP OF HOLIDAY TO YELLOW, THAT'S THE $2 MILLION INVESTMENT.

AND THEN THERE'S A, THERE WOULD BE A VARIABLE COST OF AND THEN A FLUCTUATING WATER COSTS THAT WOULD BE ASSOCIATED.

AND THAT 27 AND A HALF CENT OF THAT 50 50 PROFIT SHARE BETWEEN SIENNA MUD, ONE IN THE CITY, UM, COULD GO UP, BUT IT COULDN'T GO ANY LESS THAN 27 HALF CENTS PER THE AGREEMENT THAT WE'VE ALREADY WORKED ON.

SO, UM, WE'VE DRAFTED THAT AND TONIGHT THERE'S NO ACTION REQUESTED BY THE COUNCIL.

UM, THAT AUTHORIZATION, UM, FOR REQUEST HAS BEEN PLACED ON THE NEXT COUNCIL AGENDA FOR FEBRUARY.

THE FIRST I WOULD LIKE TO ADD FINALLY THAT WE DO HAVE REPRESENTATIVES ON THE CALL FROM SANTA AND WHO ARE ALSO OUR PARTNERS IN THE GROUNDWATER REDUCTION PLAN OVERSIGHT COMMITTEE.

AND I MEASURE SUCCESS BY THE COST TO THE CONSUMER.

UM, WE HAVE ONE OF THE LOWEST GROUNDWATER FEES, A GROUNDWATER, UH, PUBLISH FEES, UH, OF ANY OF THE, UH, CONVERTING ENTITIES IN OUR REGION.

UH, AND THAT'S JUST A TESTAMENT TO THE HARD WORK OF THE FOLKS, THE CITY, UH, THAT AND THE GRP COMMITTEE WHO HAVE PUT IN THE TIME AND EFFORT TO REALLY COME UP WITH A GOOD SOLUTION.

LONG-TERM, UH, THIS EFFLUENT REUSE, UH, AGREEMENT IS JUST ONE PIECE OF THAT, A MUCH LARGER PUZZLE.

UH, IT'S A WIN-WIN FOR EVERYBODY.

UH, IT SAVES ALL OF THE GRP PARTICIPANTS.

SO THE CITY RESIDENTS AND ADJ RESIDENTS SAVES EVERYBODY MONEY BY USING LESS SURFACE WATER, WHICH IS THE MOST COSTLY WATER YOU CAN, UH, USE.

UM, THERE ARE SOME REGULATORY CREDITS THAT, UH, THAT THE CITY AND THE GRP WILL RECEIVE BECAUSE OF, UH, THIS VERSION.

AND THEN LONG-TERM, WE PROBABLY HAVE SOME, SOME LONG-TERM CAPITAL COSTS AND O AND M REDUCTIONS AT THE SURFACE WATER PLANT THAT AREN'T REALLY EVEN PART OF THE ANALYSIS.

UM, SO YOU KNOW, IT ALL AT ALL, IT'S, UH, IT'S A VERY, UH, POSITIVE INVESTMENT FOR, UH, FOR EVERYONE THAT THE NUMBERS THAT ARE ON THE SCREEN, I THINK ARE VERY, VERY CONSERVATIVE THAT ASSUMES WE USE A VERY SMALL AMOUNT OF REUSE.

I THINK THOSE NUMBERS WILL BE BETTER, BUT FOR PURPOSES OF THE EVALUATION, WE'VE GIVEN YOU A VERY CONSERVATIVE SET OF NUMBERS.

IF YOU MAY RECALL, A TEXAS PARKWAY WAS THAT WAS LIKE THIS DECADES AGO, AND TECHSTARS CAME AND DID WHAT THEY CALL THE MEDIAN IMPROVEMENTS, OR THE TECHNICAL NAME IS ACCESS MANAGEMENT IMPROVEMENTS.

AND THAT CONTRIBUTED TO REDUCING COLLISION AS WELL AS, UH, AIDING THE MOVEMENT OF, UH, TRAFFIC VOLUME THROUGH THIS MAJOR CORRIDOR TECHSTAR, UH, NOTIFIED THE CITY LATE, UH, IN DECEMBER OF LAST YEAR THAT THEY INTEND TO DO THE SAME THING FOR FM 10 92 OR TO MORPH MURPHY ROAD THAT IS TO BUILD MEDIANS PART OF THEIR ACCESS MANAGEMENT INITIATIVES, UH, WHAT THE CITY DID.

THE PROPOSED INSTALLATION OF A RAISED MEDIAN WOULD LIMIT LEFT TURN OPPORTUNITIES AND THEREBY REDUCE SAFETY RISK ASSOCIATED WITH LEFT TURNING CARS CROSSING IN FRONT OF ONCOMING TRAFFIC.

THIS IS JUST AN OVERVIEW OF THOSE ITEMS. THE FIRST ITEM IS TO AMEND SECTION 3.05

OF THE CITY'S CHARTER TO DELETE THE PROVISION THAT STATES THAT THE MAYOR SHALL ACCESS A CHIEF ADMINISTRATIVE OFFICER UNTIL THE CITY MANAGER IS APPOINTED AS MENTIONED LAST WEEK.

THIS ITEM IS INCONSISTENT WITH OTHER PROVISIONS OF THE CHARTER, WHICH PROVIDES THAT THE MAYOR CANNOT SERVE AS THE CITY MANAGER.

THE NEXT ITEM IS TO AMEND SECTION 6.01 TO EXTEND THE TERMS OF THE CITY COUNCIL TO FOUR YEARS.

THE NEXT ITEM IS SECTION 6.01 AS WELL, WHICH WOULD LIMIT THE COUNCIL SERVICE, UH, TO 12 CONSECUTIVE YEARS AFTER WHICH A COUNCIL MEMBER WOULD HAVE TO SIT OUT FOR A MINIMUM OF TWO YEARS.

THERE IS CURRENTLY NO SUCH A TERM LIMITATION OR SERVICE LIMITATION.

THE NEXT PROPOSED ITEM IS TO AMEND SECTION 9.04 TO CHANGE THE AMOUNT OF TIME THE CITY MANAGER HAS TO TRANSFER UNENCUMBERED FUNDS FROM 60 DAYS TO 90 DAYS.

AND THAT'S ALLOWING STAFF MORE TIME TO CLEAN UP THE BOOKS AND TO RECONCILE ACCOUNTING.

AFTER THE END OF THE FISCAL YEAR, THEN NEXT ITEM WAS TO AMEND SECTION 9.10, TO CLARIFY THAT BIDS ARE ONLY REQUIRED A BOARD THAT GOES A COMPETITIVE SALES.

WHAT THIS WOULD DO IS IT WOULD CLARIFY THAT THE CITY MAY, IF IT'S PROFITABLE AND IN THE CITY'S BEST INTEREST TO ACTUALLY NEGOTIATE BOND SALE.

THE NEXT ITEM IS SECTION 11.13, WHICH WOULD CHANGE THE APPOINTMENT DATE FOR THE CITY CHARTER REVIEW COMMISSION FROM JULY TO JANUARY.

SO IT DELETES THE WORD CONCURRENCE AND REPLACES THAT WORD WITH THE PHRASE AND FIVE AND CONSENT.

AND IF YOU'LL TAKE A LOOK AT THE DISCHARGE THAT WAS PROVIDED AS WELL, YOU'LL SEE THAT THERE ARE SEVERAL CITIES THAT DON'T, UM, REQUIRE THAT SORT OF, UH, LANGUAGE OR THAT DON'T REQUIRE CONCURRENCE AT ALL.

UM, BECAUSE I'VE TRIED TO SEE HOW THE WORDING THAT IS PRESENTED IS ANY DIFFERENT THAN WHAT WAS ALREADY DONE.

OR IF, IF I'M LOOKING AT IT WRONG, IT SAYS, UH, THE COUNCIL BY MAJORITY VOTE OF THE ENTIRE COUNCIL MAY ENTER INTO AN EMPLOYMENT CONTRACT WITH THE CITY MANAGER THAT PRESCRIBES THE CONDITIONS OF EMPLOYMENT AS THE COUNCIL DETERMINES APPROPRIATE.

THEN IT GOES ON AND BE THE, SAY IF THE COUNCIL ALEKS TO ENTER INTO A EMPLOYMENT CONTRACT WITH THE CITY MANAGER, THE CITY MANAGER WHO RECEIVES SUCH COMPENSATION, THERE'LL BE A FIX BY THE COUNCIL WHEN SUCH EMPLOYMENT CONTRACT.

UH, I DON'T KNOW IF DOES THAT SPEAK TO WHAT I WAS THINKING TO DO THAT BECAUSE WHAT HAPPENED BEFORE WAS, UH, COUNCIL GAY MAJORITY VOTE THE MAYOR, THE AUTHORITY TO NEGOTIATE THE CONTRACT WITH THE CITY MANAGER, BUT THAT FINAL CONTRACT NEVER CAME BACK BEFORE US FOR APPROVAL.

SO I'M JUST TRYING TO ENSURE THAT, THAT WE HAVE THE ABILITY AS COUNCIL MEMBERS OR AS THE BODY TO VOTE ON THE FINAL AGREED UPON CONTRACT, BECAUSE UPON OUR, OUR COMMUNICATING, WE DIDN'T, WE DIDN'T KNOW IF ANY OF OUR EDITS OR A REQUEST HAD BEEN ADDED TO THE CONTRACT OR NOT, OR ACCEPTED BY THE CITY MANAGER OR NOT.

SO DOES THAT, DOES THIS SPEAK TO THAT AUTHORIZATION? I THINK THAT THE PREVIOUS MAYOR HAS, UH, I THINK THAT

UM, SECONDLY, IT DOES SAY THAT IF THE COUNCIL ELECTS TO ENTER INTO SUCH AN EMPLOYMENT CONTRACT, THEN THE MANAGER CAN ONLY RECEIVE THE COMPENSATION THAT, UH, A BIG BY COUNCIL IN THE CONTRACT ITSELF.

UH, WHAT I CAN DO IS, UH, UM, IT'LL MAKE IT MORE CLEAR IF I CAN ADD ADDITIONAL LANGUAGE TO THAT FIRST SECTION A THAT STATES THAT SUCH CONTRACT SHALL BE VOTED ON OR SOMETHING LIKE THAT BY COUNCIL, BUT THE BRIAN'S THE COUNCIL BY MAJORITY VOTE OF THE ENTIRE COUNCIL MAY ENTER INTO IS ESSENTIALLY SAVING THAT IN ORDER FOR THE COUNCIL TO ENTER INTO SUCH A CONTRACT, IT HAS TO DO SO BY MAJORITY VOTE.

AND, UM, SHE HAD, SINCE THAT TIME PROVIDED A NUMBER OF PIECES OF EVIDENCE TO SHOW THAT THAT WAS AN IMPROPER AND, UM, MISTAKEN TEST SPECIFICALLY, SHE PROVIDED A URINE TEST THAT WAS NEGATIVE.

SHE LATER PROVIDED A HAIR TEST AFTER REMOVING HER BRAIDS.

THAT WAS NEGATIVE.

UM, AND THEN SHE FINALLY PRESENTED A FINGERNAIL TEST THAT WAS ALSO NEGATIVE AND DATES BACK TO THE TIME PERIOD COVERED THE ORIGINAL TEST GIVEN BY THE CITY.

UM, IN ADDITION, SHE DID VOLUNTARILY SUBMIT TO A POLYGRAPH WHICH SHOWED THAT SHE WASN'T BEING TRUTHFUL WHEN SHE DENIED ANY DRUG USE.

UM, IT SHOULD BE NOTED THAT THE POLYGRAPHER THAT CONDUCTED HER EXAMINATION WAS THE ONE THAT IS REGULARLY USED BY THE CITY OF MISSOURI CITY FOR POLICE DEPARTMENT EMPLOYEES.

UM, AND SO I THINK THEY HAVE A VERY CLEAR CASE OF SLOPPY MISTAKEN DRUG TESTING DONE IN TOTAL CONTRADICTION OF CITY POLICY.

AND, AND SO IT'S BECAUSE OF THAT, WE'LL REPLACE IT OR WHETHER YOU BUY THE CITY MANAGER.

UM, I BELIEVE THAT THAT THE CITY MANAGER WAS NOT AT ALL PREPARED FOR OUR MEETING.

I DON'T BELIEVE HE REVIEWED ANYTHING WE PROVIDED TO HIM.
