THIS IS A PUBLIC HEARING TO RECEIVE COMMENT FOR OR AGAINST THE REQUEST OF DON ASSOCIATES TO RE, TO ZONE AN APPROXIMATE 0.656 ACRE TRACT OF LAND FROM LC THREE COMMERCIAL DISTRICT TO PD PLAN DEVELOPMENT DISTRICT TO ALLOW FOR LC THREE COMMERCIAL DISTRICT USE.

AND TO THE EXTENT SUCH ZONING DEVIATES FROM THE FUTURE LAND USE PLAN AND CHARACTER MAP OF THE COMPREHENSIVE PLAN TO PROVIDE FOR AN A AN AMENDMENT.

THEREFORE, THEREFROM, GO AHEAD.

UM, THE PROPOSED ZONING WOULD ALLOW FOR THE DEVELOPMENT OF A GAS STATION CONVENIENCE STORE WITH REDUCED SETBACKS AND THANKSGIVING REQUIREMENTS.

UM, SO THE PROPOSED LEARNING APPLICATION IS REQUESTING TO GO FROM LC THREE COMMERCIAL DISTRICT TO A PD PLAN DEVELOPMENT DISTRICT, WHICH WOULD ALLOW FOR THOSE DEVIATIONS.

SO THE SUBJECT SIDE, AS I MENTIONED, IS LOCATED ON THE SOUTHEAST CORNER OF TEXAS PARKWAY AND THIRD STREET.

AND DUE TO THE SIZE AND LOCATION OF THE SUBJECT SIDE, THE APPLICANT HAS CLAIMED THAT THEY ARE FACING DEVELOPMENT CONSTRAINTS, UM, IN REGARDS TO THE HEIGHTENED AREA REGULATIONS AND THE LANDSCAPING REGULATIONS.

AND SO WITH THIS APPLICATION, THEY ARE SEEKING TO, UM, REQUEST DEVIATIONS FROM THOSE AND REQUEST A REDUCTION IN BOTH HEIGHTENED AREA REGULATIONS AND THE LANDSCAPING REGULATIONS.

SO THE FIRST DEVIATION REQUEST IS FOR REDUCED BUILDING SETBACKS.

CURRENTLY, THE SITE REQUIRES SETBACKS OF 25 FEET IN THE FRONT, 25 IN THE REAR AND 30 ON THE SIDE.

AND THE APPLICANT IS REQUESTING THAT THE ALLOWED SETBACKS BE REDUCED TO 20, UM, TO 10 FEET IN THE FRONT.

EXCUSE ME.

YEAH.

10, 25 FEET IN THE FRONT, 10 FEET IN THE REAR, AND 10 FEET ON THE SIDE.

SO STAFF IS RECOMMENDING TO DISAPPROVE THE REDUCED YARD SETBACK ALONG TEXAS PARKWAY AND TO THE REAR OF THE PROPERTY.

UM, BUT TO ALLOW THE REDUCTION OF THE SIDE YARD SETBACK OF NOT LESS THAN 10 FEET ON THE SIDE ABUTTING THIRD STREET.

SO ANOTHER CONSIDERATION FOR THIS IS THAT TEXT.IS, UM, CURRENTLY HAS PLANS TO EXPAND TEXAS PARKWAY, UM, IN THIS PORTION OF THEIR RIGHT OF WAY.

AND SO A CONSIDERATION FOR Y'ALL TO TAKE INTO ACCOUNT IS THAT ALLOWING FOR A REDUCTION IN THE SETBACKS WOULD, UM, WOULD ALLOW, WOULD PUT THE OVERALL DESIGN AT RISK, THE DESIGN INTEGRITY AT RISK FOR THIS DEVELOPMENT WITH THE REDUCTION OF THE SETBACKS.

AND THE SECOND DEVIATION THAT THE, UM, APPLICANT IS REQUESTING IS FOR LANDSCAPING.

SO SECTION 11 OF THE CODE OF ORDINANCES REQUIRES THAT THERE BE A 20 FOOT LANDSCAPING BUFFER, UM, FOR ANY PROPOSED NON-RESIDENTIAL DEVELOPMENT, UM, IN FRONT OF A MAJOR THOROUGHFARE, WHICH WOULD BE APPLICABLE IN THIS CASE.

UM, AND THEN IT WOULD ALSO REQUIRE A 10 FOOT LANDSCAPING BUFFER IN THE REAR WHERE THERE'S A DIFFERENCE IN INTENSITY.

AND SO THIS PROPOSED DEVELOPMENT WOULD BE FOR GAS STATION AND IT WOULD BE A BUDDING WHAT IS AN EXISTING EVENT CENTER.

SO THAT WOULD TRIGGER A 10 FOOT, UM, LANDSCAPING BUFFER IN THE ROOM.

SO THESE, UH, LANDSCAPING PLAN PROVIDED BY THE APPLICANT PROPOSES A 10 FOOT LANDSCAPING BUFFER IN THE FRONT AS OPPOSED TO THE 20 THAT IS REQUIRED.

UM, AND A FIVE FOOT LANDSCAPING AREA IS SHOWN ALONG THE WEST SIDE OF THE PROPERTY STAFF RECOMMENDS TO ONLY APPROVE THE REDUCTION OF THE LANDSCAPING BUFFER ALONG THIRD STREET.

UM, AND ALL OTHER LANDSCAPING BUFFER YARDS AS REQUIRED BY SECTION 11 WOULD NEED TO BE PROVIDED.

SO OVERALL STAFF IS RECOMMENDING, UH, THE COMMISSION ADOPT THIS AS ITS FINAL REPORT AND UH, FORWARD IT TO CITY COUNCIL WITH A NEGATIVE RECOMMENDATION.

IN LAST FIVE YEARS, CITY HAS PERMITTED TO DEVELOP THREE NEW BUILD GAS STATION WITHIN CITY LIMITS AND CORRIDOR OF TEXAS PARKWAY.

IF WE DRIVE AROUND TEXAS PARKWAY TODAY, THERE IS STATION ON EVERY CORNER.

WE NEED TO ASK OURSELVES, DO WE NEED ANOTHER GAS, GAS STATION? DO WE NEED OUR CITY TO BECOME LIKE OTHER CITIES WHERE NO ZONING LAWS HAVE ALLOWED FOUR GAS STATIONS AS A SINGLE LIGHT? I REQUEST THE CITY OFFICIALS AND COUNCIL MEMBERS TODAY TO CONSIDER THE IMPACT IT'LL HAVE ON THE COMMUNITY AND THE TRAFFIC OVERALL.

AND WE HAVE RESTAURANTS CLOSING IN THAT AREA RIGHT NOW.

UH, MS. METZ PHYSICALLY PROMISED TO MAYOR ELLA CAT TO COUNSEL AND TO OUR COMMUNITY THAT BECAUSE MAYOR ELLA CAT ASKED HER, HER, HE CALLED HER OUT AND ASKED HER IF THEY WERE TO DO, IF THEY WERE GOING TO DO ANYTHING, ANY DEVELOPMENT AT ALL, THEY WOULD DEVELOP WHAT WE AGREED TO.

AND THIS IS EXACTLY THE OPPOSITE OF THAT.

THE DEVELOPERS SHOULD HAVE ALREADY COME TO OUR NEIGHBORHOOD WITH ALL OF THE DEVELOPMENT COMING UP WITHIN A TWO MILE, MUCH LESS A THREE MILE RADIUS OF WHICH IS SO MUCH IS VACANT.

THERE SHOULD BE NO CHANGE TO THE L THREE, TO THE, THERE SHOULD BE NO CHANGE TO THE R FIVE ZONING.
