THE CITY OF MISSOURI CITY, TEXAS, AMENDING CHAPTER 16, NAMING OF CITY PROPERTY AND CITY PROGRAMS OF THE MISSOURI CITY CODE BY DECREASING THE PERCENTAGE OF PROPERTY OWNERS REQUIRED TO PETITION TO CHANGE THE NAME OF A PUBLIC STREET, PROVIDING FOR REPEAL, PROVIDING A PENALTY, AND PROVIDING FOR SEVERABILITY.

THIS PROPOSED ORDINANCE WAS SUBMITTED TO THE CITY ATTORNEY'S OFFICE BY COUNCIL MEMBER BONY.

THIS ORDINANCE WOULD DECREASE THE THRESHOLD AMOUNT NEEDED TO CHANGE A PUBLIC STREET, THE NAME OF A PUBLIC STREET FROM 70% TO 60%.

SO TONIGHT'S ITEM, UM, WE'RE GONNA REVIEW ANNEXATION AND DISSOLUTION OF SIENNA MUD NUMBER TWO.

UH, SIENNA MED NUMBER TWO WAS CREATED IN 1997.

UH, THERE'S A STRATEGIC PARTNERSHIP AGREEMENT, UH, WITH THE CITY, AND THAT WAS APPROVED IN 2001.

THE ESTIMATED POPULATION OF THE AREA IS 6,000, AND THE AREA IS IN THE CITY'S E TJ.

THE PRIMARY RESPONSIBILITIES OF THE MUD IS CONSTRUCTION, MAINTENANCE AND OPERATION OF WATER, SEWER, AND DRAINAGE FACILITIES.

THE DISTRICT CONTRACTS WITH VARIOUS CONSULTANTS AND DOES NOT HAVE ANY EMPLOYEES.

UH, SERVICES ARE RECEIVED BY THE REGIONAL UTILITY SYSTEM, UH, THE MASTER MUD, WHICH IS SEEING A REGIONAL MUD.

UH, WE CONTRACT WITH, OR THEY CONTRACT WITH THEM FOR FINANCING, OPERATING, UH, AND MAINTENANCE OF WATER, SANITARY SEWER, STORM SEWER, AND ALSO INCLUDES SERVICES FOR MOSQUITO SPRAYING AND SUPPLEMENTAL PATROL.

THIS IS A MAP OF SIENNA MUD TOO.

AS YOU CAN SEE, UH, THE CITY'S BOUNDARIES IS IN RED.

IT'S, UH, BORDERING, UH, THE CITY.

AND SO WHAT IS ANNEXATION? ANNEXATION IS EXPANDING THE CITY'S BOUNDARY, THE CITY'S BOUNDARIES TO INCLUDE ADDITIONAL TERRITORY.

IT'S A TRANSFER OF JURISDICTION AND CONTROL OF THE ANNEXED AREA FROM ONE GOVERNMENT ENTITY TO ANOTHER, AND IT'S GOVERNED BY STATE LAW AND, UH, CONTRACT THE STRATEGIC PARTNERSHIP AGREEMENT THAT WE HAVE, UH, WITH THE MUD.

AND THE QUESTION IS WHY ANNEX? NOW? WELL, WE HAVE MET THE REQUIREMENTS FOR ANNEXATION.

THAT'S IN THE STRATEGIC PARTNERSHIP AGREEMENT.

WE'RE ABLE TO ANNEX WHEN AT LEAST 90% OF THE AC DEVELOPABLE ACREAGE HAS BEEN DEVELOPED WITH THE NECESSARY, UH, UTILITY INFRASTRUCTURE.

AND WHEN THE DEVELOPER IS PAID OFF, OR IF THE CITY, UH, ASSUMES THE REIMBURSEMENT.

AND IN THIS CASE, THE DEVELOPER IS PAID OFF.

UH, THE COST BENEFIT ANALYSIS SUPPORTS DOING SO AT THIS TIME AND AT THIS TIME, UM, THE MUD WILL BE DISSOLVED BEFORE CALENDAR YEAR 2024, AND BEFORE THEIR FISCAL YEAR, END OF FEBRUARY 28TH, 2024, IF THIS IS APPROVED IN AUGUST.

SO THERE'S A LOT OF QUESTION ABOUT WHAT SERVICES DOES THE MUD PROVIDE VERSUS THE CITY VERSUS THE COUNTY.

UM, THIS CHART PROVIDES THAT INFORMATION AND IT SHOWS THAT A LOT OF THE AREAS, UM, THAT MAY BE OF CONCERN TO SOME OF THE RESIDENTS WILL STILL BE IN PLACE BECAUSE THE HOA PROVIDES A LOT, UM, OF SERVICES THROUGH THEIR H OA DUES.

SO, UH, ON THE LEFT SIDE, YOU'LL SEE THE SERVICES CURRENT AND WHAT THE SERVICES WOULD BE UPON ANNEXATION, UH, FOR MOWING OF THE PUBLIC RIGHT OF WAYS.

CURRENTLY, UH, THE H O A, IT'S PROVIDING THAT THEY WILL CONTINUE TO PROVIDE THAT, UH, MOWING OF THE MEDIANS, THE SAME STREET LIGHTS, UH, THE HOA.

UH, BUT UPON ANNEXATION, THE CITY WOULD PROVIDE STREET LIGHTS, STREET MAINTENANCE AND REPAIR.

UH, THE HOA, STREET MAINTENANCE AND REPAIR WOULD BE THE CITY.

UH, CODE ENFORCEMENT WOULD BE THE CITY.

CURRENTLY, UH, WE DON'T BELIEVE THERE'S CODE ENFORCEMENT THAT'S BEING COMPLETED, BUT THE HOA DOES HAVE, UH, CCNRS.

AND SO THOSE WILL CONTINUE TO BE, UM, ENFORCED BY THE HOA.

SUPPLEMENTAL PATROL IS, UH, CURRENTLY BEING PROVIDED THROUGH HOA DUES AND UTILITY USER FEES.

UH, UPON ANNEXATION THAT SUPPLEMENTAL PATROL WOULD CONTINUE THROUGH HOA DUES AND THROUGH THE CITY, AND THE CITY WILL PROVIDE LAW ENFORCEMENT.

WHEREAS NOW, UM, THE COUNTY IS RESPONSIBLE FOR LAW ENFORCEMENT.

WE KNOW THE HOA PROVIDES PARKS, UH, FOR THE RESIDENTS.

THAT WILL CONTINUE ALSO, BUT THE CITY WILL ALSO HAVE PARKS AND RECREATION AVAILABLE.

CONTINUING ON, UH, MOSQUITO SPRAIN, CURRENTLY RESIDENTS ARE PAYING FOR MOSQUITO SPRAIN THROUGH THEIR USER FEES.

UH, AND MOSQUITO SPRAIN WILL CONTINUE THROUGH THE CITY SIDEWALK MAINTENANCE IN THE PUBLIC RIGHT OF WAY.

THE CITY WILL PROVIDE THAT.

UH, ANIMAL SERVICES AND BUILDING PERMITS CURRENTLY ARE PROVIDED BY THE COUNTY.

THEY WILL BE PROVIDED BY THE CITY.

ZONING WILL BE PROVIDED BY THE CITIES, CURRENTLY NOT PROVIDED BY THE COUNTY FIRE.

UH, CURRENTLY, THE RESIDENTS ARE PAYING A FIRE FEE, UH, UPON ANNEXATION, THEY WILL NO LONGER PAY THE FIRE FEE, AND THE FIRE WILL BE PROVIDED BY THE CITY.

DITCH MAINTENANCE, UH, WILL BE PROVIDED BY THE CITY CURRENTLY PROVIDED BY, UH, THE USER FEES AND GARBAGE COLLECTION.

THE SAME, THE GARBAGE COLLECTION WILL REMAIN THE SAME WITH THE SAME, UH, VENDOR.

BEST TRASH.

IT WILL JUST BE, UM, PROVIDED BY THE CITY STREET SWEEPING.

CURRENTLY, HOA

DUES ARE PROVIDING STREET SWEEPING, AND UPON ANNEXATION THAT WOULD CONTINUE.

UM, BUT THE CITY WOULD ALSO PROVIDE STREET SWEEPING.

SO THERE'S ALSO QUESTIONS ABOUT HOW DOES THIS IMPACT THE PROPERTY OWNERS.

AND SO WE DO HAVE THE PRELIMINARY, UH, PROPERTY TAX ROLES, WHICH SHOWS THAT THE AVERAGE HOMESTEAD FOR THE AREAS $432,452, EXCUSE ME, THE MUD TAX CURRENTLY IS APPROXIMATELY 43 CENTS.

WHILE THE CITIES IS 57 3 7 50.

UM, THIS RESULTS IN A DIFFERENCE IN TAX OF $622 PER YEAR ON THE AVERAGE HOMESTEAD, UH, REDUCING IT BY THE FIRE FEE AND THE RESIDENTIAL HOMESTEAD THAT THE MUD DOES NOT HAVE.

THE ADDITIONAL TAX WOULD BE APPROXIMATELY $301 ON THE AVERAGE HOMESTEAD.

JUST A LITTLE INFORMATION ABOUT THE PROPERTY TAX EXEMPTIONS.

UM, CURRENTLY OVER 65, UH, FOR MUD, THE MUD, IT'S 25,000 FOR THE CITY, IT'S ALSO 25,000 FOR DISABLED PERSONS.

THE MUD IS 25,000 AND THE CITY IS 20,000.

FOR THE RESIDENTIAL HOMESTEAD, THE MUD DOES NOT HAVE A RESIDENTIAL HOMESTEAD, BUT THE CITY HAS A 2.5% RESIDENTIAL HOMESTEAD, WHICH ON THE AVERAGE, UH, HOMESTEAD WOULD BE $10,811.

SO I WOULD LIKE TO PROVIDE A LITTLE, UH, INFORMATION ABOUT LEGISLATION.

UM, THERE'S BEEN DISCUSSION ABOUT, UH, NEW LEGISLATION REGARDING, UH, THE TJ OF THE CITY AND, UH, THE RELEASE OF ANY AREA.

UM, THIS CHAPTER DOES NOT APPLY TO THE CITY BECAUSE, UM, IT DOESN'T APPLY TO AN AREA THAT'S SUBJECT TO A STRATEGIC PARTNERSHIP AGREEMENT.

THERE ARE OTHER, UH, PIECES OF LEGISLATION THAT WERE PASSED DEALING WITH MUNICIPAL UTILITY DISTRICTS, ONE BEING, UH, SEC, UH, CHAPTER 49 OF THE WATER CODE, UM, WHICH DEALS WITH THE DIRECTOR'S FEES, UM, THAT THEY'RE ENTITLED TO EARN A FEE OF OFFICE FOR EACH DAY OF ACTIVE SERVICE AND ACTUAL EXPENSES.

IT ALSO TIES THE DIRECTOR FEE, UM, TO WHAT'S IN LEGISLATION, UM, PROVIDED BY THE TEXAS ETHICS COMMISSION, WHICH WILL AUTOMATICALLY BE ADJUSTED FOR INFLATION.

CURRENTLY, THEY'RE PAID $150 PER DAY.

IT WOULD BE $221 PER DAY WITH THE MAXIMUM OF $7,200 PER YEAR.

UM, WE'VE LOOKED AT THE FINANCIAL STATEMENTS FOR THE MUD, AND LAST YEAR THERE WERE, UH, MEMBERS THAT WERE PAID FOR 11 AND 12 DAYS.

AND WE DO KNOW THAT THE DIRECTOR FEES ARE ON THE SIENNA MUD AGENDA FOR JULY 20TH.

OKAY, SO NOW MOVING INTO MUD DISSOLUTION.

SO WHAT HAPPENS? SO, FINANCIAL TRANSACTION.

SO FOR, WE'RE GONNA LOOK AT THE BALANCE SHEET, AND WE'RE GONNA LOOK AT THE INCOME STATEMENT.

SO THE MUDS ASSETS AND LIABILITIES BECOMES THE CITY'S ASSETS AND LIABILITIES.

AND WITHIN THE STRATEGIC PARTNERSHIP AGREEMENT, UPON ANNEXATION, THE MUD WILL DISSOLVE WITHIN 120 DAYS, WHICH WILL BE APPROXIMATELY DECEMBER 19TH.

SO THE ASSETS THAT THE MUD HAS AT THAT POINT IN TIME, AS WELL AS THEIR LIABILITIES WILL BECOME THOSE OF THE CITY.

SO, ASSETS BEING CASH, RECEIVABLES, THEIR INFRASTRUCTURE, LIABILITIES BEING ALL OF THEIR OUTSTANDING DEBT AND OTHER OBLIGATIONS.

THIS IS A SNIPPET FROM THE MUD'S FINANCIAL STATEMENTS FOR THE FISCAL YEAR ENDING FEBRUARY 28TH, UH, 2023.

UH, IT INCLUDES ALL OF THEIR ASSETS AND LIABILITIES AND THEIR NET POSITION.

AND SO WHEN LOOKING AT WHETHER OR NOT TO DISSOLVE THE MUD AND TO SEE IF IT'S FINANCIALLY FEASIBLE, UM, LOOK AT THE CURRENT AND OTHER ASSETS.

THAT'S THEIR CASH, THAT'S THEIR INVESTMENTS.

UH, THAT'S THEIR, UH, LIQUID ASSETS THAT COULD BE USED TO PAY OFF THEIR LIABILITIES.

AND NOW THIS FINANCIAL STATEMENT HERE INCLUDES ALL OF THEIR FUNDS, WHICH IS THEIR OPERATING FUND, THEIR GENERAL FUND, AND THEIR DEBT SERVICE FUND.

SO AS OF FEBRUARY 28TH, 2023, THEIR CURRENT ASSETS WERE APPROXIMATELY 8.2 MILLION WITH TOTAL LIABILITIES OF 6.6, ALMOST 6.7 MILLION, LEAVING A NET OF 1.5, ALMOST 1.6 MILLION.

AND AGAIN, THIS INCLUDES ALL OF THEIR FUNDS, INCLUDING THEIR GENERAL OPERATING FUNDS.

AND AS YOU CAN SEE, THE ASSETS EXCEED THE LIABILITIES.

WE HAVE BEEN SOMEWHAT NOTIFIED THAT THE MUD PLANS TO SPEND ALL OF THEIR GENERAL FUND FUND BALANCE.

SO THAT WOULD NOT BE FUNDS THAT WOULD BE TRANSFERRED TO THE CITY AS OF FEBRUARY 28TH.

THAT'S APPROXIMATELY $4.7 MILLION.

UM, THEY DO HAVE ON THEIR JULY 20TH AGENDA SOME ITEMS, UM, THAT THEY'RE LOOKING TO, UH, SPEND, UH, THEIR FUNDS ON.

AND THIS INCLUDES PROJECTS AND AGREEMENTS WITH THE SIENNA RESIDENTIAL ASSOCIATION.

UH, PROJECT FUNDING AGREEMENTS FOR, UH, WITH THE SIENNA PARKS AND LEVY IMPROVEMENT DISTRICT, THE SIENNA ORIGINAL MUD, UH, THE INTERNAL SIENNA MUD, UH, AN AGREEMENT WITH THE SIENNA

RESIDENTIAL ASSOCIATION AND OTHER PROJECT FUNDING AGREEMENTS WITHIN THE SIENNA COMMUNITY.

THEY WILL ALSO, LIKE MENTIONED BEFORE, UH, LOOK AT THEIR DIRECTOR PER DEMS. THEN THEY'LL ALSO BE LOOKING AT, UH, DIRECTOR ATTENDANCE AT SUMMER CONFERENCES, UH, REIMBURSABLE EXPENSES, AND, UH, ATTENDANCE AT A WINTER CONFERENCE.

OKAY, NEXT.

SO WE, WE TALKED ABOUT THEIR ASSETS AND HOW THEY PLAN, UM, TO SPEND THEIR, UH, FUND BALANCE IN THE GENERAL FUND.

AS FAR AS THEIR FUND BALANCE IN THE DEBT SERVICE FUND, IT IS RESTRICTED AND IT CAN ONLY BE USED TO PAY FOR THE PRINCIPAL AND INTEREST, UM, FOR THE DEBT THAT HAS BEEN ISSUED.

SO IF, UH, YOU'LL, YOU'LL SEE IN ANOTHER SLIDE THAT THEY HAVE A FUND BALANCE OF APPROXIMATELY 3 MILLION.

THEY HAVE OUTSTANDING DEBT OF ABOUT 6 MILLION.

SO THAT MONEY WILL BE USED TO PAY, UH, THAT DEBT.

BUT UPON DISSOLUTION, AGAIN, THOSE DEBT AND OBLIGATIONS ARE TRANSFERRED TO THE CITY.

WE HAVE WORKED WITH OUR BOND COUNCIL AND OUR FINANCIAL ADVISOR.

UM, AND THIS IS A CASH FLOW ANALYSIS THAT WAS PROVIDED.

THERE ARE, UH, TWO OPTIONS THAT ARE BEING PRESENTED, UH, AS FAR AS HOW WE WILL HANDLE THE DEBT SERVICE.

UM, THE FUND BALANCE, AGAIN, AS OF FEBRUARY 28TH, 2023 FUND BALANCE FOR THE MUD AND THEIR DEBT SERVICE FUND WAS APPROXIMATELY 2.9 MILLION, WHICH IS SUFFICIENT TO PAY THEIR DEBT SERVICE FOR ALMOST THE NEXT TWO FISCAL YEARS.

UM, THE CITY IN FISCAL YEAR 2025, IF, UH, ANNEX WILL BE RESPONSIBLE FOR PAYING 1.5 MILLION IN DEBT SERVICE.

AND AT THE END OF 2026, THE TOTAL AMOUNT OF DEBT SERVICE THAT THE CITY WOULD BE RESPONSIBLE FOR IS 3.7 MILLION.

AND NOW THIS IS, IF THE CITY DECIDES TO CONTINUE TO PAY.

ACCORDING TO THE CURRENT DEBT SCHEDULE, THERE ARE TWO OUTSTANDING BOND ISSUANCE.

UH, THERE'S ONE FROM 2014 AND ONE FROM 2019.

THE 2014 DEBT ISSUANCE CAN BE PAID OFF EARLY.

AND SO THIS, UH, THIS ANALYSIS SHOWS WHAT THE TOTAL COST WOULD BE IF WE PAID THE, UH, 2014 DEBT OFF IN FISCAL YEAR 20, UH, 24.

AND SO THE TOTAL COST WOULD BE APPROXIMATELY 3.6 MILLION, WHICH WOULD BE A SAVINGS AND INTEREST PAID, BUT IT DOESN'T ACCOUNT FOR THE AMOUNT OF INTEREST THAT WE COULD EARN IF WE KEPT THE MONEY.

UM, THE DEBT CURRENTLY HAS COUPON RATES OF TWO AND 3%, WHERE THE CITY IS EARNING, UM, OVER 5% ON ITS REVENUE.

SO IF WE WERE TO, UM, PAY IT OFF, WE COULD POSSIBLY BE LOSING TWO 2% OF INTEREST INCOME ON THAT MONEY.

SO ONE OPTION THAT WE HAVE IS TO USE OUR DEBT SERVICE FUND BALANCE TO BE ABLE TO PAY, UM, THAT, THAT THOSE FUNDS, OR AT LEAST TO BUY DOWN OUR INS RATE.

THE DEBT SERVICE FUND BALANCE AS OF JUNE 30TH OF THIS, UH, YEAR IS OVER 6 MILLION.

UM, I HAVE INFORMATION ABOUT THE TRUTH AND TAXATION CALCULATION.

UM, WHENEVER YOU'RE CALCULATING YOUR I N S PORTION OF YOUR TAX RATE, YOU INCLUDE ALL OF YOUR DEBT.

SO ONCE THE MUD IS ANNEXED INTO THE CITY, THAT WILL BE CONSIDERED THE CITY'S DEBT, WHICH WE WOULD HAVE TO INCLUDE IN OUR TAX CALCULATION.

BUT THERE IS, UH, AN AREA WHERE WE CAN SUBTRACT THE AMOUNT PAID FROM OTHER RESOURCES, SUCH AS OUR, UM, DEBT SERVICE FUND BALANCE SO THAT, UM, IT CAN BUY DOWN THE RATE SO THAT THERE WILL BE, UH, NO IMPACT, UH, FOR THIS, FOR THIS DEBT.

AND AGAIN, OUR DEBT SERVICE FUND BALANCE IS ONLY TO BE USED FOR PRINCIPAL AND INTEREST ON THE CITY'S DEBT, OF WHICH UPON ANNEXATION, THE MUDS DEBT WOULD BE CONSIDERED THE CITIES.

NOW MOVING ON TO THE INCOME STATEMENT.

UM, ALL OF THE SERVICE FEES AND OPERATIONAL COSTS FOR THE UTILITY WILL BE TRANSFERRED TO THE CITY.

UH, THE WATER FEES AND THE SEWER FEES WILL CONTINUE, BUT THE FIRE FEES WILL NOT, UH, THEY WILL NO LONGER PAY A PROPERTY TAX TO THE MUD, BUT THEY WILL BE PAYING PROPERTY TAXES FOR THE CITY.

AS FAR AS EXPENDITURES, UH, WE WILL STILL PROVIDE, UH, THE WATER WASTEWATER SERVICES, AND THAT INCLUDES CONTINUING WITH THE CURRENT OPERATOR AND, UM, PAYING ALL OF THE MASTER DISTRICT OBLIGATIONS.

THERE WILL NO LONGER BE COST RELATED TO CONSULTANTS SUCH AS THE BOOKKEEPER, ENGINEERS, AND THE DIRECTORS.

SO THIS INFORMATION, UM, IS FROM THEIR FINANCIAL STATEMENT.

AGAIN, FISCAL 2023 OF WHICH WE RECEIVED WITHIN THE PAST MONTH.

UM, AND WHAT I WANTED TO SHOW IS WHAT THE FINANCIALS LOOK LIKE UNDER THE MUD, AND IF IT WAS THE CITY USING THE SAME INFORMATION, WHAT IT WOULD LOOK LIKE.

SO, OF COURSE, THE CITY WOULD NOT RECEIVE THE FIRE SERVICE OR THE PROPERTY TAXES, THE PENALTIES AND INTEREST OR PENALTIES AND INTEREST ON, UH, DELINQUENT TAXES.

THEY PAID $107,134 FOR THE AUDIT UNDER MCGRATH AND CO 14,000 A YEAR ENGINEERING UNDER L J ENGINEERING 27,925 BOOKKEEPING DIRECTOR FEES.

YOU CAN SEE A LOT OF THE ADMINISTRATIVE STUFF.

IT WOULD NOT BE A COST OF THE CITY.

UM, BUT WE WILL HAVE THE TAX ASSESSOR COLLECTOR, WHICH IS, UM, UH, DECREASED COSTS COMPARED TO WHAT THE MUD IS CURRENTLY PAYING TO THEIR TAX ASSESSOR COLLECTOR.

UH, THOSE COSTS THAT PRETTY MUCH REMAIN THE SAME.

WE HAVE UTILITIES CAP, UH, TAP CONNECTION INSPECTIONS.

THE OPERATORS SEE ENVIRONMENTAL, UH, THE MASTER DISTRICT REPLACEMENT FUND, REPAIRS AND MAINTENANCE, GARBAGE COLLECTION, UH, MONTHLY CONNECTION CHARGES, SURFACE WATER.

AND THEN THE, UH, FIRE PROTECTION SERVICES.

THE EXPENSE WOULD BE IN OUR GENERAL FUND AS OUR FIRE DEPARTMENT WILL BE PROVIDING, CONTINUE TO PROVIDE THOSE SERVICES, BUT IT WILL NOT BE, UM, UNDER THE UTILITY.

SO TOTAL EXPENSES WOULD BE 2,010,143 FOR THE MUD.

IN, UH, 2023, THEY HAD REVENUE OVER EXPENDITURES OF ALMOST $500,000.

FOR US, IT WOULD SOMEWHAT BE BREAKEVEN.

SO WHEN YOU LOOK AT THE FULL PICTURE, NOT JUST WHAT IS GOING ON WITH THE UTILITIES, BUT WHAT HAPPENS WHEN IT COMES TO GENERAL OPERATIONS.

UH, THE CITY PROPERTY TAX USING THE, UH, ASSESSED VALUATION AT THAT TIME WOULD BE ALMOST 3.8 MILLION.

OF COURSE, WHEN IT COMES TO THE CITY, BECAUSE WE WOULD BE PROVIDING THE FIRE SERVICE, WE WOULD NO LONGER RECEIVE THE FIRE FEE, WHICH IS APPROXIMATELY 390,000.

SO THE NET REVENUES TO THE CITY FOR ALL FUNDS, INCLUDING DEBT, DEBT SERVICE, WOULD BE $3.4 MILLION.

RIGHT NOW OUR DISTRICT HAS A LOT OF DITCH MAINTENANCE.

THERE'S GONNA BE, AND IT'S SIGNIFICANTLY OLDER, UH, BECAUSE IT WAS ONE OF THE FIRST MUD DISTRICTS IN SIENNA.

SO WE'VE SAVED UP THAT MONEY, NOT ONLY TO PROVIDE ENHANCEMENTS TO THE CITIZENS, BUT ALSO TO BE ABLE TO PROVIDE THE NECESSARY MAINTENANCE THAT'S GONNA COME UP.

UM, A COUPLE THINGS THAT I JUST WANNA POINT OUT IS, UM, EVERYBODY IS, UH, WOULD AGREE THAT, UM, PUBLIC SAFETY AND LAW ENFORCEMENT IS A HOT TOPIC.

UM, I'VE HAD THE OPPORTUNITY TO LOOK AT THE, UH, UH, STRATEGIC PARTNERSHIP AGREEMENT.

AND EVEN THOUGH, UM, IT'S NOT A CONDITION PRECEDENT TO ANNEXATION, THERE IS A SECTION IN THERE THAT DEALS WITH PUBLIC SAFETY.

THAT SECTION SPECIFICALLY SAYS THAT THERE SHOULD BE A POLICE STATION SLASH FIRE STATION IN THE CENTER OF SIENNA THAT WOULD SERVICE THE ENTIRE COMMUNITY.

THAT DOESN'T EXIST.

AND THE PROBLEM IS, IS THAT, UM, AS YOUR POLICE ASSISTANT POLICE CHIEF, UH, MENTIONED LAST WEEK, RIGHT NOW MISSOURI CITY IS DOWN 20 PATROL OFFICERS.

IT'S ALSO MY UNDERSTANDING THAT THEY'RE DOWN SIX DETECTIVES.

UH, IT'S VERY IMPORTANT FOR PURPOSES OF JUST PUBLIC SAFETY THAT YOU TAKE A LOOK AT NOT ONLY THE FINANCIAL ASPECT OF IT, BUT SOME OF THESE INTANGIBLES, UH, THAT MAKE IT APPEAR AS THOUGH IT'S NOT SUCH A GREAT DEAL FOR THE CITY TO DO AT THIS POINT.

UH, WE, UH, DO KNOW THAT AT SOME POINT IT'S GONNA GET ANNEXED.

USUALLY THE ANNEXATION OCCURS AFTER THE BONDS ARE PAID OFF.

YOU SEE A MUD WITH DOLLARS YEAR MARKED FOR IMPROVEMENTS WITHIN THE COMMUNITY AND ARE DETERMINED TO TAKE THAT MONEY FROM THE RESIDENTS WHO PAID INTO IT TO MAKE THINGS WORSE.

IN ADDITION TO REDISTRIBUTING THE ASSETS OF MUD TWO, YOU'RE RAISING THE TAXES ON THE SAME RESIDENCE YOU JUST EXPLOITED.

YOU CLAIM TO BE PROVIDING SERVICES IN EXCHANGE FOR THE 33% INCREASE IN TAX RATE.

HOWEVER, C A RESIDENCE ARE ALREADY RECEIVING THE SERVICES WE NEED, AND IN MANY CASES, SIGNIFICANTLY HIGHER QUALITY SERVICES.

THE CURRENT UNFILLED POSITIONS WITHIN THE MISSOURI CITY POLICE DEPARTMENT MAKE IT CLEAR THE CITY IS NOT ABLE TO HANDLE A SUDDEN 9% INCREASE IN POPULATION IN A TIME OF EXCRUCIATING INFLATION AND OUT OF TOUCH HOME VALUATIONS.

NOW IS NOT THE TIME TO ASK OUR RESIDENTS TO PAY MORE FOR LESS.

THE ANNEXATION MUST BE PAUSED OR CANCELED ALTOGETHER.

YOU CLAIM TO WANT PARTNERSHIP IN THIS PROCESS, BUT ALL WE'VE HEARD SO FAR IS READY OR NOT.

AT THE PUBLIC HEARING ON JULY, JUNE 19TH, UM, MS. PORTIS STATED THAT THE, UM, ANNEXATION WAS FISCALLY FEASIBLE FOR THE ASSOCIATION AND ALSO CONSISTENT WITH THE 2019 ANNEXATION REPORT.

IT WAS NOT UNTIL, UM, JULY 12TH, A COUPLE DAYS AGO THAT THE CITY EVER SPOKE TO THE ASSOCIATION TO FIND OUT WHAT KIND OF MUNICIPAL SERVICES THE ASSOCIATION PROVIDES.

UM, I HAD REACHED OUT RIGHT AFTER THE PUBLIC HEARING IN JUNE, AND I WAS TOLD THE FIRST AVAILABLE DATE I COULD MEET WITH CITY ADMINISTRATION WAS TODAY.

THEY THEN SUBSEQUENTLY CHANGED THAT TO BE CONSISTENT WITH THE COMMUNITY MEETING LAST WEEK.

FURTHER, THE, THE 2019 REPORT, AS SEVERAL OTHER PEOPLE HAVE MENTIONED, DISCUSSES GETTING TOGETHER WITH THE AFFECTED PARTIES IN ADVANCE OF THE ANNEXATION, TALKING THROUGH THE ISSUES AND TRYING TO FIGURE OUT WHAT'S THE BEST ANSWER FOR ALL INVOLVED.

THE ASSOCIATION IS PART OF THE AFFECTED ENTITIES.

UM, AND THAT HAS NOT OCCURRED.

WE HAVE TWO SHERIFF DEPUTIES PHYSICALLY LOCATED IN SIENA 24 7.

I SPOKE WITH ONE OF THE DEPUTIES TODAY.

UH, THEY ENJOY COMING OUT HERE, WORKING, UH, WITH THE RESIDENTS.

AND, UH, I ALSO SPOKE WITH THEIR SERGEANT.

UH, ONE OF THE MAJOR COMPLAINTS I HEARD WAS HOW QUICK THIS WAS HAPPENING.

UH, THE POOR COMMUNICATION, WHY, WHY, WHAT'S THE HURRY? UH, WHY IS THERE NO COORDINATION WITH THE, UH, HOA AND THE RESIDENCE? SO I DID A LITTLE RESEARCH OVER THE WEEKEND.

I LOOKED AT THE, UH, 2023 FINANCIAL STATEMENT, UH, THAT'S PRODUCED BY THE MUD.

UH, ONE OF THE INTERESTING THINGS I FOUND WAS THAT THE, UH, MISSOURI CITY, UH, NOTIFIED THE MUD OF THE ANNEXATION PRIOR TO FEBRUARY, UH, 2023, WHICH IS THE DATE OF THE, UH, REPORT.

SO, MAKES ME WONDER, WHY DID IT TAKE FOUR MONTHS TO NOTIFY THE RESIDENCE AND THE HOA? ONLY YOU GUYS CAN ANSWER THAT.

UH, I ALSO LOOKED AT THE MUD RE REPORT AND THE FINANCIAL REPORT THAT WAS PRESENTED KIND OF CONFIRMS THAT, UH, WE HAVE ABOUT 6 MILLION IN DEBT.

UH, THE REPORT ALSO SAYS WE'LL PAY IT OFF IN THREE YEARS.

UM, 34 CENTS OF THE 43 CENTS OF THE, UH, ASSESSMENT GOES TOWARDS PAYING OFF DEBT.

SO I'VE BEEN DOING MY PART, AND FOR 16 YEARS I'VE BEEN PAYING MY SHARE OF THIS BIG MULTIMILLION DOLLAR MORTGAGE.

AND IN THREE YEARS WHEN I THOUGHT THIS DEBT WOULD BE PAID OFF, YOU'VE COME TO ME AND SAID, WE'RE GONNA RAISE YOUR TAXES AND OTHER 14 CENTS, PLUS THOSE 34 CENTS THAT YOU'RE PAYING ON THE MORTGAGE, THEY'RE GONNA CONTINUE FOREVER.

THAT'S HOW I'M LOOKING AT IT.

AND I'M SURE OTHER RESIDENTS WILL SEE IT THAT WAY.

I UNDERSTAND THAT THE MISSOURI CITY POLICE DEPARTMENT IS UNDERSTAFFED BY 20 OFFICERS AT THIS TIME.

THE CITY'S WEB WEBSITE, EXCUSE ME, SHOWS SIGNING BONUSES AS AN ENTICEMENT FOR OFFICER CANDIDATES.

EVEN THE POLICE CHIEF POSITION IS STATED TO BE INTERIM SIENA RESIDENCE CURRENTLY HAVE THE BENEFIT OF A SUPPLEMENTAL PATROL CONTRACT WITH THE FORT BEND COUNTY SHERIFF'S OFFICE.

THERE ARE SEVEN DEPUTIES, ONE OF WHICH IS AN ONSITE SERGEANT DIVIDED UP TO PATROL WITHIN SIENNA ON THREE SHIFTS 24 7 IN RELATIONSHIP.

THAT TO SOMETHING THAT WAS MENTIONED IN THE RECENT PRESENTATION.

I KNOW FIRSTHAND THAT IT IS, IT HAS NOT BEEN CONFIRMED THAT THIS SERVICE WILL CONTINUE FOR MUD TWO RESIDENCE.

SO A COMPARISON OF WHAT WE CURRENTLY HAVE TO WHAT THE MISSOURI CITY POLICE DEPARTMENT WILL PROVIDE IS NOT AN APPLES TO APPLES COMPARISON.

BASED UPON STATEMENTS MADE BY THE, THE INTERIM MISSOURI CITY POLICE CHIEF LAST WEDNESDAY AT OUR TOWN HALL MEETING.

AFTER ANNEXATION, THERE WOULD BE TWO TWO WITH THE GOAL OF THREE OFFICERS PATROLLING THE HIGHWAY SIX CORRIDOR NEAR SIENNA, NOT IN SIENNA.

THIS WOULD CLEARLY BE A SIGNIFICANT DECREASE IN SERVICE LEVEL AND IS OF GRAVE CONCERN FOR SIENNA MUD TWO RESIDENTS.

IN OTHER WORDS, RESIDENTS WOULD PAY MORE TAXES FOR LESS SERVICE.

ADDITIONALLY, I WOULD GUESS THAT CURRENT MISSOURI CITY RESIDENTS WOULD BE CONCERNED ABOUT AN ADDITIONAL 16 TO 1700 HOUSEHOLDS BEING ADDED TO THE PATROL RESPONSIBILITY OF A POLICE FORCE THAT IS ALREADY STRETCHED THIN.

MY QUESTION IS THIS, CAN THE ANNEXATION BE DELAYED UNTIL THE POLICE FORCE IS FULLY OR CLOSE TO FULLY STAFFED? THANK YOU FOR YOUR TIME.

WELL, I CAN TELL YOU, I KNOW MOST OF THESE MUD DIRECTORS, I'VE WORKED WITH THEM.

I ALSO HAPPENED TO BE NEIGHBORS WITH MANY OF THEM.

THEY WOULD DO THIS WITHOUT PAY.

SO WHILE I DO APPRECIATE THAT, THAT DOES, THOSE FEES DO GET ABSORBED AS WELL AS OTHERS INTO YOUR ALL'S BUDGET WHEN YOU WOULD ANNEX US, IT'S STILL, AS MANY PEOPLE HAVE SAID, IS ANNEXATION AT A HIGHER TAX RATE.

AND SO ALL THESE THINGS THAT YOU WOULD BE BRINGING ON ARE ALREADY COVERED BY THAT 43 CENTS.

WE ALL REALIZE THAT ANNEXATION IS IMMINENT.

UM, CERTAINLY IN THE FUTURE.

SO I WOULD JUST ASK, UM, FOR EVERYONE TO KIND OF TAKE A STEP BACK, LOOK AT IT REALLY IN TERMS OF WHAT IT MEANS FOR MISSOURI CITY RESIDENTS AS WELL.

BECAUSE YOU WILL BE TAKING ON DEBT AS WELL AS CNA ASSOCIATION AND CNA, MUNICIPAL, TWO RESIDENTS AS WELL AS FUTURE RESIDENTS.

I THINK PEOPLE DID TOUCH ON THIS, THAT THIS IS A PICTURE FOR WHAT MAY HAPPEN AGAIN IN THE FUTURE.
