TWO DAYS AGO DURING THE MISSOURI CITY CITY COUNCIL REGULAR MEETING ON OCTOBER 16TH, I EMPHASIZED TO MISSOURI CITY GOVERNMENT THAT FOR THE SAKE OF FUTURE GENERATIONS, WE MUST BE BETTER.

I'M CERTAIN CITY COUNCIL FELT A RANGE OF EMOTIONS DURING THAT MEETING TWO DAYS AGO, SINCE IT LASTED THREE AND A HALF HOURS, IT STARTED AT APPROXIMATELY SIX 30.

IT HAD TWO EXECUTIVE SESSIONS BY CITY COUNCIL.

THE FIRST EXECUTIVE SESSION LASTED ABOUT 15 MINUTES WHILE THE SECOND ONE LASTED ABOUT AN HOUR AND 10 MINUTES.

HAVING STARTED AT APPROXIMATELY 8:49 PM AND ENDED AT 10 O'CLOCK, I REALIZE THAT MISSOURI CITY COUNCIL PLANS TO DISCUSS AND OUR VOTE ON THE ETH ETHICS COMMISSION REGULATIONS TONIGHT, I ENCOURAGE YOU TO VOTE NO OR POSTPONE ANY CHANGES TO THOSE MATTERS TONIGHT RELATED TO ETHICS.

AT THAT THREE AND A HALF HOUR MEETING ON OCTOBER 16TH, THE HOMEOWNER OF MISSOURI CITY PUBLICLY SHARED DETAILS WITH CITY COUNCIL ABOUT HE, HOW HE FILED THREE ETHICS COMPLAINTS PER THE EXISTING ETHICS ORDINANCE.

AMONG OTHER TOPICS, HE SPOKE ABOUT A VARIETY OF TOPICS THAT, IN MY MIND, RAISED VALID CONCERNS ABOUT WHETHER THE, THE EXISTING ETHICS PROCESS IS BROKEN, WHETHER HIDDEN, LOST, MISPLACED OR OTHERWISE.

WE, THE 80,000 PEOPLE IN MISSOURI CITY DO NOT HAVE ANSWERS TO ANY OF THIS HOMEOWNERS FILINGS FOR MANY ETHICS COMMISSION NOR CITY COUNCIL.

FOR ME, IT'S A, IT'S, IT'S NOT HARD TO FATHOM THAT IF THE ADJUDICATION PROCESS FOR ETHICS COMPLAINTS IS ALREADY BROKEN, THEN WHY APPROVE CHANGES BEFORE THE ETHICS COMMISSION OR THE PUBLIC FINDS OUT WHY THE NATURE, TIMING AND EXTENT, EXTENT OF THOSE ETHICS COMPLAINTS ARE UNKNOWN ON A DIFFERENT TOPIC.

I WANTED TO UNDERSCORE TWO ITEMS ON TONIGHT'S AGENDA FOR POSSIBLE CHANGES BY CITY COUNCIL.

IN THE ETHICS COMMISSION REGULATIONS ONE CHANGE IS DESCRIBED AS QUOTE, DEFERS PROCESSING COMPLAINTS IF THEY'RE FILED 120 BUSINESS DAYS BEFORE AN ELECTION.

THIS IS BUSINESS DAYS, NOT CALENDAR DAYS.

SO THIS IS SIX MONTHS PRIOR TO ANY ELECTION.

I ASK THE QUESTION WHY, IF, IF THE ETHICS RULES STATE THAT CERTAIN THINGS NEED TO HAPPEN WITHIN FIVE BUSINESS DAYS AND FIVE BUSINESS DAYS BEFORE AND AFTER, THEN WHY IS THIS REQUIREMENT SO LONG? AND IN MY MIND IS UNACCEPTABLE.

ANOTHER CHANGE IS DESCRIBED AS QUOTE REQUIRES SENSOR PUBLICATION IN THE NEWSPAPER DETERMINED BY CITY COUNCIL.

I ENCOURAGE CITY COUNCIL TO ASK, WHAT DOES THIS CLAUSE, CLAUSE MEAN AND WHY SHOULD CITY COUNCIL, NOT THE ETHICS COMMISSION, DETERMINE THE ANSWER TO THIS QUESTION? IN MY MIND, CITY COUNCIL AND THE CITY CITY'S LEGAL DEPARTMENT, AS WELL AS THE CITY SECRETARY'S OFFICES SHOULD BE INVOLVED WITH ANY ETHICS COMPLAINTS.

UH, THE FIRST BEING THAT THE COUNCIL SPENT THREE POINT ALLEGED, UH, UH, THAT THE COUNCIL SPENT $3.6 MILLION MORE ON PERSONNEL COST THAN WAS IN THE BUDGET.

CONTRARY TO SECTION 9.03 OF THE CITY CHARTER SECTION TWO DASH 6 0 4 4.

UH, REASON FOR SUBMISSION OF ALLEGATION, UH, ONE IS THE ALLEGED CONDUCT OCCURRED MORE THAN SIX MONTHS BEFORE THE DATE ON WHICH THE COMPLAINT WAS FILED.

OTHER TO WITT.

THE ALLEGED VIOLATION WAS COMMITTED BY THE CITY COUNCIL AS A WHOLE AND NOT THE RESPONDENT.

THE, THE COMPLAINT CANNOT BE SUBSTANTIATED.

UH, ALSO ALLEGATION TWO, UH, WAS DISMISSED THAT THE COUNCIL FAILED TO ABIDE BY THE TEXAS OPEN MEETINGS ACT AND OTHER TO WITT.

THE ALLEGED CONDUCT DOES NOT CONSTITUTE A VIOLATION OF THE STANDARDS OF CONDUCT UNDER MISSOURI CITY CODE SECTION TWO DASH 6 0 4, AND THEREFORE, THE ETHICS COMMISSION HAS NO JURISDICTION.

THE FIRST ITEM IS THE, UH, SUMMARY OF PROPOSED CHANGES FOR THE CITY'S ETHICS REGULATIONS.

THESE CHANGES HAVE BEEN PRESENTED TO YOU AT, UH, SEVERAL MEETINGS THIS YEAR.

A MAJORITY OF THEM ARE BASED ON RECOMMENDATIONS FROM THE ETHICS COMMISSION.

I'LL BRIEFLY GO THROUGH EACH, UH, PROPOSAL.

THE FIRST ITEM IS TO DEFINE CITY OFFICIAL TO INCLUDE FORMER OFFICIALS.

THE SECOND ITEM IS TO REQUIRE NOTARIZED COMPLAINT FORMS. THE THIRD ITEM IS TO CHANGE THE TIMELINE FOR COMPLAINTS TO ADD ADDITIONAL TIME, UH, FOR INDIVIDUALS TO FILE COMPLAINTS.

THE FOURTH ITEM, UH, PROVIDES THAT THE CITY SECRETARY WILL DETERMINE IF A COMPLAINT IS ADMINISTRATIVELY COMPLETE.

WHAT DOES THAT MEAN? THAT JUST MEANS THAT THE CITY SECRETARY'S OFFICE WILL DETERMINE WHETHER OR NOT BLANKS HAVE BEEN COMPLETED, UM, AND THE FORM IS, IS COMPLETELY FILLED OUT.

THE FIFTH ITEM, UH, IS THAT THE, UH, THE COMMISSION RECOMMENDED DEFERRING PROCESSING COMPLAINTS IF THEY ARE FILED WITHIN 120 DAYS, UH, BEFORE AN ELECTION.

THE REASON THE COMMISSION RECOMMENDED THIS WAS BECAUSE THEY DO NOT WANT THE CITY'S ETHICS COMPLAINT PROCESS TO BE UTILIZED AS A TOOL FOR, FOR POLITICS AND IN ELECTIONS.

SO THE ETHICS COMMISSION MADE THAT RECOMMENDATION IN ITS REPORT TO THIS COUNCIL.

THE SIXTH ITEM PROVIDES ADDITIONAL NOTICE REQUIREMENTS.

THE SEVENTH ITEM, UH, MAKES COMPLAINTS CONFIDENTIAL UNTIL DISMISSED OR SCHEDULED FOR A DETERMINATION HEARING.

THE EIGHTH ITEM EXPRESSLY PROHIBITS RETALIATION FOR FILING COMPLAINTS.

THE NINTH ITEM REQUIRES A JURISDICTIONAL DETERMINATION WITHIN 10 BUSINESS DAYS OF RECEIVING

A COMPLAINT.

UH, THE PROPOSAL ALSO REQUIRES SUBMISSION OF A PRELIMINARY REPORT FROM THE INVESTIGATING ATTORNEY WITHIN 15 BUSINESS DAYS OF DESIGNATION.

THE, UH, NEXT ITEM REQUIRES THE PRELIMINARY REPORT MEETING TO BE HELD WITHIN 15 BUSINESS DAYS AFTER THE REPORT IS SUBMITTED.

UH, THE, UH, 12TH ITEM, UH, I APOLOGIZE.

THE 13TH ITEM PROVIDES THAT IF AN INVESTIGATING ATTORNEY IS REQUIRED, THEN THE CITY IS A CITY ATTORNEY IS REQUIRED TO RECOMMEND THREE UH, ATTORNEYS TO THE COMMISSION FOR DESIGNATION.

THIS WOULD ALLOW THE COMMISSION TO DETERMINE WHO THEY WANT TO BE THE, UH, INVESTIGATING ATTORNEY ON EACH CASE.

THE NEXT ITEM REQUIRES FUNDING FOR THE COMMISSION.

THE NEXT ITEM ADDS SPECIFIC DEADLINES FOR VARIOUS SUBMISSIONS AND RELEASES.

UH, THE PROPOSED CHANGE, UH, CHANGES BY THE COMMISSION ALSO INVOLVE AUTHORIZING THE CHAIR AND VICE-CHAIR TO GRANT EXTENSIONS, UH, WHEN REQUESTED BY THE PARTICIPANTS.

UH, THE CHANGES ALSO, UH, REQUIRE THE COMPLAINANT TO PROSECUTE, UH, THE COMPLAINT.

YOU KNOW, WHAT WE HAVE MOST IN MOST OF THESE INSTANCES IS A RESIDENT WHO IS FILING A COMPLAINT AGAINST SOME OFFICIAL.

THIS CHANGE WOULD REQUIRE THAT COMPLAINANT TO ASK QUESTIONS, UH, BEFORE THE ETHICS COMMISSION.

AND THE ETHICS COMMISSION, OF COURSE, ALSO GETS TO ASK QUESTIONS AS WELL.

THE NEXT ITEM, UH, PROVIDES THAT THE, UM, ETHICS COMMISSION IS AUTHORIZED TO IMPOSE CERTAIN SANCTIONS WITHOUT COUNSEL ACTION.

AND THIS WAS RECOMMENDED BY THE ETHICS COMMISSION AS WELL.

UM, BASED ON YOUR PREVIOUS CONVERSATIONS, THOSE ACTIONS ARE, UH, PROVIDING A LETTER OF ADMONITION AND REQUIRING ADDITIONAL TRAINING OF OFFICIALS.

THE NEXT ITEM ALLOWS PUBLICATION IN A NEWSPAPER OR THE CITY'S WEBSITE OF CERTAIN SANCTIONS WOULD ESSENTIALLY BE A CENSURE.

THIS WOULD BE AN ACTION THAT COULD BE RECOMMENDED BY THE COMMISSION, BUT WOULD HAVE TO BE ACTUALLY FINALIZED BY THE CITY COUNCIL.

SO THE CITY COUNCIL WOULD MAKE THAT DETERMINATION.

THE NEXT ITEM PROVIDES THAT THE ETHICS COMMISSION, UH, MAY RECOMMEND THE SUSPENSION OR REMOVAL OF AN APPOINTED OFFICIAL.

AND THIS WAS ALSO RECOMMENDED BY THE ETHICS COMMISSION.

UH, THE ETHICS COMMISSION ALSO, UH, REQUIRED, UH, RECOMMENDED CITY COUNCIL ACTION ON ETHICS COMMISSION RECOMMENDATIONS.

SO THAT COULD BE EITHER ACCEPTANCE OF THE REPORT AS YOU DID TONIGHT, OR, UM, NOT GO, UM, AGREEING WITH THE REPORTER, TAKING SOME OTHER ACTION.

THE NEXT ITEM PROPOSED IS CLARIFYING THE STANDARD OF CONDUCT.

AND, UH, THIS WAS A COUNCIL, UH, INITIATED RECOMMENDATION, BUT CLARIFYING THE STANDARD OF CONDUCT THAT PROHIBITS DEFAMATION AND HARASSMENT BY INCLUDING SOCIAL MEDIA, UM, AS A FORM, UH, THAT PEOPLE MAY USE TO DO, UH, TO TAKE SUCH ACTIONS.

ADDITIONALLY, ADDING A STANDARD OF CONDUCT THAT PROHIBITS THE DISCLOSURE OF INFORMATION THAT THAT IS NOT PUBLICLY AVAILABLE FROM A CLOSED MEETING.

UH, THIS ISSUE HAS COME UP REPEATEDLY.

UM, AND THIS IS SOMETHING THAT THE COUNCIL HAS, UH, SUGGESTED AND RECOMMENDED.

ANOTHER COUNCIL RECOMMENDATION IS ITEM 24, WHICH IS TO ADD FOUR ALTERNATE MEMBERS TO THE ETHICS COMMISSION AND LIKE THE ZONING BOARD OF ADJUSTMENTS, WHICH DOES HAVE ALTERNATE MEMBERS WHO ARE ABLE TO COME IN, IN THE ABSENCE OF OTHER MEMBERS TO CREATE A QUORUM SO THAT BUSINESS CAN BE CONDUCTED.

THIS, UH, PROPOSAL WOULD DO THE SAME.

AND SO, UM, THEY'VE ONLY HAD ABOUT, I WANNA SAY FOUR OR FIVE MEETINGS, UH, TOTAL.

SO THIS IS, UH, A NEW COUNT, UH, COMMITTEE THAT'S BEEN WORKING DILIGENTLY, UH, AND PUTTING IN THE WORK TO, UM, TRY TO STREAMLINE THIS PROCESS, MAKE SURE THIS PROCESS IS TRANSPARENT, MAKE SURE THAT ALL OF THE DETAILS.

AND SO I'M VERY APPRECIATIVE OF THEM PUTTING IN THE WORK TO MAKE THESE STRONG RECOMMENDATIONS TO US, TO WHICH WE'RE MAKING DECISIONS, UH, ON POSSIBLY MOVING FORWARD WITH AN ORDINANCE ON THIS.

UH, I JUST WANTED TO, UH, EMPHASIZE THAT, UH, SOME OF THE THINGS, UH, IN THIS, THIS POTENTIAL ORDINANCE WILL GIVE THE ETHICS COMMISSION THE POWER TO ACT AS THE THIRD PARTY, IN ESSENCE THAT IT IS TO, UH, TO MAKE SANCTIONS AND DO THE VARIOUS THINGS WITHOUT

THE CITY'S SECRETARY'S OFFICE THEN FORWARDS IT TO THE LEGAL DIVISION.
