SO, AS YOU MAY KNOW, UH, NOT ONLY DO YOU SERVE ON THE PLANNING AND ZONING COMMISSION, BUT YOU ALSO SERVE ON THE CAPITAL IMPROVEMENT ADVISORY COMMITTEE.
UH, THE, SOME OF THE THINGS THAT COMMITTEE DOES IS IT WORKS TO ADVISE AND ASSIST THE CITY COUNCIL ON ADOPTING LAND USE ASSUMPTIONS VERY SIMILAR TO WHAT YOU DO, UH, CURRENTLY AS COMMISSIONERS.
UH, YOU REVIEW IMPACT FEE CAPITAL IMPROVEMENT PLANS AND FILE WRITTEN COMMENTS.
UH, KAYLA DEANI, OUR CAPITAL, UH, OUR CIP ADMINISTRATOR HAD PRESENTED SOME OF THE CIP PROJECTS WE'RE WORKING ON ACROSS THE CITY LAST FALL.
YOU ALSO MONITOR AND EVALUATE THE IMPLEMENTATION OF THE IMPACT FEE CAPITAL IMPROVEMENT PLANS, SO THAT WE'RE MOVING FORWARD WITH THOSE.
AND THEN FILE SEMI-ANNUAL REPORTS TO THE PROCESS PROGRESS OF IMPACT FEE, CAPITAL IMPROVEMENT PLANS, REPORTING TO CITY COUNCIL, ANY PERCEIVED INEQUITIES IN IMPLEMENTING THE PLANS OR IMPOSING IMPACT FEES.
I'M GONNA BE PRESENTING, UH, WHAT WE'VE COLLECTED IN IMPACT FEES SO FAR THIS YEAR, WELL IN FY 24, AND THEN WHAT WE USE THOSE FOR.
AND THEN LASTLY, ADVISING CITY COUNCIL OF THE NEED TO UPDATE OR REVISE LAND USE ASSUMPTIONS, IMPACT FEE CAPITAL IMPROVEMENT PLANS AND IMPACT FEES.
SO PRETTY MUCH EVERYTHING TO DO WITH IMPACT FEES.
YOU GUYS HAVE A SAY IN THE CITY DOES HAVE THREE IMPACT FEES BY ORDINANCE OR RESOLUTION.
ONE IS THE LAKE OLYMPIA PARKWAY EXTENSION.
UH, THIS IMPACT FEE WENT IN TO FUND THE IMPROVEMENTS MADE ALONG LAKE OLYMPIA PARKWAY TO PUNCH

IT THROUGH OVER TO THE FORT BEND TOLL ROAD.THOSE IMPROVEMENTS HAVE BEEN DONE.
THE FUNDS THAT ARE COLLECTED WITHIN THIS IMPACT FEE USED TO PAY BACK THE, UH, NO PAY BACK THE CITY FOR THE UPFRONT CAPITAL COST.
THERE'S ALSO THE MUSTANG BAYOU IMPACT FEES.
THESE ARE FOR WATER AND WASTEWATER SERVICE WITHIN THE MUSTANG BAYOU SERVICE AREA.
MUSTANG BAYOU SERVICE AREA IS THE CITY SERVICE AREA.
IT'S NOT, UH, ONE OF THE MUDS.
IT'S, IT'S THE ONE OF THE TWO AREAS IN THE CITY THAT'S SERVICED BY, WELL SERVICED BY THE CITY, BUT OPERATED BY, UH, QUAIL VALLEY UTILITY DISTRICT.
AND SO THOSE IMPACT FEES GO TO PAY THE DEBT SERVICE ON THE BONDS THAT WE TOOK OUT IN ORDER TO MAKE WATER WASTEWATER IMPROVEMENTS.
UH, PREDOMINANTLY THAT'S LINE WORK, EXTENDING WATER WASTEWATER LINES, BUT IT'S ALSO BEEN, UH, TREATMENT PLANNING IMPROVEMENTS.
SO WE EXPANDED THE, UH, MUSTANG BAYOU WASTEWATER TREATMENT PLANT, TOOK THAT FROM, UH, 0.95 MGD UP TO 3M GD.
UH, ONCE WE GET DONE WITH THIS LAST EXPANSION, ACTUALLY WE JUST FINISHED IT UP.
WE'RE JUST WAITING ON TCEQ APPROVAL, BUT ALSO DOING SOME IMPROVEMENTS ON THE WATER SYSTEM, UM, EXPANDING THE, UH, WE'RE DOING RE REHABILITATION ON THE GROUND STORAGE TANKS FOR THE TWO GROUNDWATER, UM, GROUNDWATER TREATMENT PLANTS, PLANT ONE AND PLANT TWO OUT IN SHIPMAN'S COVE.
AND THEN, UH, FORT BEND TOBEL ROAD.
SO THAT PAYS FOR DEBT SERVICE.
AND THEN THE LAST ONE IS THE NORTHEAST OYSTER CREEK, UH, SUB WATERSHED.
AND THAT IS THE, THE NORTHEAST OYSTER CREEK WATERSHED IS GENERALLY THE DRAINAGE AREA THAT'S ALONG, UH, 10 92 AND FIFTH STREET.
I'M VERY SORRY I'M USING MY HANDS TO DESCRIBE ROADS.
UM, BUT, UH, FM 10 92 AND FIFTH STREET, THAT GENERAL AREA ALONG INDEPENDENCE BOULEVARD, THAT'S ALL THE WATERSHED IT COLLECTS INTO, UH, ONE OF THE CITY'S DETENTION BASINS.
THERE'S AN IMPACT FEE LEVIED ON THE PROPERTIES THAT COME IN THERE, THE DEVELOPMENTS THAT COME IN THERE TO PAY FOR IMPROVEMENTS WITHIN THAT WATERSHED.
SO THOSE ARE THOSE FEES OR THE, THOSE FEES BY ORDINANCE.
THIS IS WHAT WE'VE COLLECTED IN FY 24 FOR THOSE FEES.
UM, NORTHEAST OYSTER CREEK WATERSHED, OH, THAT ALSO HAD A WATER AND WASTEWATER IMPACT FEE.
UM, WE DON'T ACTUALLY KEEP THAT FEE THAT GETS PAID THROUGH TO QUAIL VALLEY WHO OPERATES THAT AREA FOR US.
UH, IT'S KIND OF A OUT OF DISTRICT SERVICE FOR THEM.
SO NO NEW DEVELOPMENT CAME IN.
UH, EVEN THOUGH THERE'S BEEN CONSTRUCTION ACTIVITY THAT'S OLDER CONSTRUCTION THAT'S BEEN PREVIOUSLY PLATTED PREVIOUSLY DESIGNED, THEY'RE JUST RUNNING, THEY'RE, HOW DO I SAY, THEY'RE BEING VERY DECISIVE IN THEIR CONSTRUCTION AND IT'S, IT'S MOVING AT A NOT RAPID PACE, BUT, SO EVEN THOUGH WE'RE SEEING CONSTRUCTION OUT ACTIVITY OUT THERE, THOSE FEES HAD BEEN PAID HISTORICALLY.
SO THERE HAVE BEEN NO NEW FEES PAID IN NORTHEAST OYSTER CREEK DRAINAGE WATER OR WASTEWATER.
UH, WE DID RECEIVE 31,000 PAID IN LAKE OLYMPIA, UH, ROADWAY IMPACT FEES FOR DEVELOPMENTS THAT OCCURRED ALONG THERE.
AGAIN, THAT'S PAYING BACK THE CITY'S CAPITAL INVESTMENT.
AND LASTLY, WE, OUR MUSTANG BAYOU SERVICE AREA, THAT'S, THAT'S WHERE ALL THE GROWTH IS HAPPENING.
UH, THAT'S, THAT'S GENERALLY THE AREA THAT'S ON THE, UM, SOUTHEAST SIDE OF THE, UM, FORT BEND TOLL ROAD.
SO EVERYTHING THAT'S COMING IN FORT BEND TOWN CENTER, TWO, FORT BEND, TOWN CENTER THREE, UM, AMAZON, ALL OF THAT AREA.
THAT'S ALL, UH, WELL, THAT'S ALL THE MUSTANG BIO.
AND SO THEY, WE TOOK IN JUST AROUND HALF A MILLION DOLLARS IN WATER IMPACT FEES AND ALMOST A MILLION DOLLAR IN WASTEWATER IMPACT FEES.
WASTEWATER IMPACT FEES ARE A BIT MORE THAN TWICE THE WATER IMPACT FEE.
BECAUSE WE NEEDED TO MAKE LARGER EXPANSIONS TO OUR WASTEWATER SYSTEM.
WE NEEDED TO, TO REALLY UPGRADE THE WASTEWATER TREATMENT PLANT AS OPPOSED TO THE WATER TREATMENT PLANTS WHERE WE WERE ABLE TO GET BY WITH SOME MINOR UPGRADES AND STILL MAINTAIN CONSISTENT PRESSURE AND SERVICE.
SO THOSE ARE THE FEES THAT, THAT WE HAD.
SO THAT'S THE, THE END OF MY PRESENTATION.
THERE IS NO ACTION ITEM ON THIS PRESENTATION.

UM, SO THAT'S PAYING BACK THAT DEBT SERVICE ON THOSE BONDS.
SO THAT DOESN'T, UH, IT'S NOT USED FOR ANY PROJECT.
IT'S JUST USED TO PAY THOSE BACK NORTHEAST OYSTER CREEK, UH, THE WATER WASTEWATER, UH, IMPACT FEES, THOSE GET PAID STRAIGHT TO QUAIL VALLEY.
THEY KIND OF WE'RE ALMOST A PASS THROUGH FOR THOSE.
THE DRAINAGE IMPACT FEE, UM, WHAT THAT'S GONNA DO IS IT SITS IN A, AN ACCOUNT, UH, I FORGET HOW MUCH IS IN THAT ACCOUNT.
I THINK IT'S AROUND $30,000, SOMETHING AROUND THAT RIGHT NOW.
AND THAT WILL BE USED FOR MAKING FUTURE IMPROVEMENTS.
SO IT'S NOT CURRENTLY DOING ANYTHING.
AND THEN THE LAKE OLYMPIA, UH, ROAD FEE, THAT ONE IS PAYING BACK THE CITY'S OBLIGATION.
AND THAT ONE, I DO NOT RECALL IT.
I'D WANT, I DON'T WANNA SAY BECAUSE I DON'T ENTIRELY REMEMBER SPECIFICALLY HOW THAT'S USED, BUT IT'S, IT'S EITHER USED FOR DEBT SERVICE OR IT GOES INTO THE GENERAL FUND.
IF WE FUNDED THOSE, UH, IMPROVEMENTS WITHOUT NEEDING TO TAKE A BOND.
AND I DON'T RECALL WHICH WAS THE CASE AT THE TIME.
JUST A QUICK QUESTION ON, UH, YOU HAD TALKED ABOUT LAKE OLYMPIA TAKING SO LONG, THE DEVELOPMENT, SO THE IMPACT FEE AS IT'S WRITTEN, IS IT THE SAME AMOUNT OR IS THERE INCREMENTAL RAISES AS COST CONSTRUCTION AND SERVICES GO UP? SO THE IMPACT FEES, UM, BY ORDINANCE, IMPACT FEE ORDINANCES IN THE LOCAL GOVERNMENT CODE OR NOT, NOT IMPACT FEE ORDINANCE.
THE IMPACT, UH, THE STATE, UH, RULES ON IMPACT FEES IS THAT IN THE LOCAL GOVERNMENT CODE? OKAY.
UM, IT'S BEEN A WHILE SINCE I'VE READ THEM IN DEPTH.
BUT THE, THE LOCAL GOVERNMENT CODE IN GENERAL SPECIFIES, YOU KNOW, HOW CITIES CAN LEVY IMPACT FEES AND IN GENERAL, THEY NEED TO BE TIED TO SPECIFIC INFRASTRUCTURE.
WE, WE HAVE A PLAN, WE'RE GOING TO DO A THING OR WE'VE DONE A THING.
AND SO IF WE'RE GONNA DO A THING, THERE'S A COST ASSOCIATED WITH IT.
AND IF WE'VE ALREADY DONE A THING, THEN WE KNOW THE COST AND BASED ON THOSE COSTS, THEN WE COME UP WITH A FORMULA TO HAVE AN EQUITABLE DISTRIBUTION OF THAT COST.
AND THEN THE CITY RECOUP THAT.
SO WHEN, WHEN WE'RE PAYING BACK THINGS WE'VE ALREADY DONE, UM, THERE, THAT TAKES INTO ACCOUNT THE TIME VALUE OF MONEY GENERALLY.

UH, WE ARE LOOKING AT THE FUTURE NEEDS OF THE SYSTEM AND IF WE SEE ANY ADDITIONAL FUTURE NEEDS THAT IS WORTH THE INVESTMENT OF THE CITY, WE MAY PROPOSE ADDITIONAL PROJECTS IN THE FUTURE, WHICH COULD CHANGE IMPACT FEES.

AND SO DEPENDING ON THE SIZE OF THE WATER METER, UH, WE HAVE A CONVERSION FACTOR AND LARGER METERS GENERATE LARGER FLOW AND, UH, HAVE LARGER FEES ASSOCIATED WITH THEM.
AND, AND THE, THE, THE REVENUE IS, IS, IS FOR, AS IT SAYS HERE, IS FOR INFRASTRUCTURE PROJECTS, BUT THE BOTTOM ONE SAYS SOME OF THAT'S PAID TO QUELL VALLEY UTILITY DISTRICT FOR CAPACITY FEE FEES FOR FLOWS THAT GO THROUGH THEIR PLANT? YES.
SO THERE, UH, WITHIN THE, THE WASTEWATER ONE ON THE NORTH SIDE OF THE MUSTANG BAYOU SERVICE AREA, THERE IS A PORTION OF THE SERVICE AREA THAT INSTEAD OF GOING TO THE CITY'S, UH, WASTEWATER TREATMENT PLANT, CURRENTLY GOES TO ONE OF QUAIL VALLEY'S WASTEWATER TREATMENT PLANTS.
AND AS THAT WE DO COLLECT THE FEE AND THEN WE PAY QUAIL VALLEY, UH, THEIR IMPACT FEE.
SO IT, IT BECOMES AN EFFECTIVE PASS THROUGH BECAUSE THAT'S NOT UTILIZING OUR SYSTEM IMPROVEMENTS, THAT'S UTILIZING IMPROVEMENTS MADE TO THE QUAIL VALLEY SYSTEM.
HOWEVER, AS WE ARE LOOKING AT EXPANDING AND FINISHING UP THE EXPANSION OF THE MUSTANG BAYOU SERVICE AREA OR THE MUSTANG BAYOU WASTEWATER TREATMENT PLANT, NOW THAT WE'RE ALMOST UP TO 3M GD, WE'RE GONNA LOOK AT DIVERTING THOSE FLOWS BACK TO THE CITY SO THAT ANY NEW DEVELOPMENT IN THAT AREA, THE CITY WILL KEEP THE, THE COSTS OF THOSE IMPACT FEES AND USE IT TO PAY DOWN OUR DEBT SERVICE.

THE ORGANIZATIONS THAT PROVIDE OVERSIGHT TO THIS AREA INCLUDE THE U-S-E-P-A, THE BRAZOS RIVER AUTHORITY, AND THE TEXAS COMMISSION ON ENVIRONMENTAL QUALITY.
THERE IS CURRENTLY A LICENSE, UM, A REGISTRATION WHICH AUTHORIZES THE DISTURBANCE OF ABOUT 52 ACRES OF THIS LAND, UH, WITHIN THE SEP BOUNDARIES.
AND AS FOR UTILITIES, THERE ARE NO, NO UTILITIES REQUIRED TO THE SITE AND THERE ARE NO, UM, PUBLIC UTILITIES PROPOSED TO THE SERVICE SITE EITHER.
UM, IF THEY AT SOME POINT DO NEED IT, THEY WOULD HAVE TO FOLLOW, UM, OUR CODE AND REGULATIONS AS FAR AS PUBLIC UTILITIES.
