THESE RESTRICTIONS WOULD BE CONSISTENT WITH SOME OF OUR NEIGHBORING COMMUNITIES, AND SHOULD REDUCE THE NUMBER OF SPILLOVER INTO THE CITY. THE CITY CURRENTLY HAS ABOUT 21 ONE THAT IS STILL IN PROGRESS. THE CITY IS CURRENTLY UNDER A MORATORIUM RESTRICTING ANY NEW APPLICATIONS OR APPROVALS. EXISTING ZONING REGULATIONS DO NOT CURRENTLY SPELL OUT SMOKE SHOPS AS A SPECIFIED USE. WHAT THIS ORDINANCE WOULD DO IS TO CREATE A DEFINITION OF WHAT DEFINES A SMOKE SHOP. THIS IS CONSISTENT WITH THE DEFINITION APPROVED FOR THE MORATORIUM PERIOD. WHAT THIS WOULD ALSO DO IS ESTABLISH THAT SMOKE SHOPS ARE PROHIBITED WITHIN ALL OF THE CITY'S COMMERCIAL DISTRICTS. WHAT THIS ORDINANCE WOULD DO IS TO ESTABLISH THAT THE LC3 DISTRICT, WHICH IS MORE THE REGIONAL COMMERCIAL DISTRICT, IS THE LOCATION WHERE LIQUOR STORES WOULD BE ABLE TO OPERATE.

THE LC2 DISTRICT WOULD NO LONGER ALLOW FOR PACKAGED LIQUOR STORES TO BE LOCATED WITHIN ITS BOUNDARIES. THE LC1 DISTRICT BASICALLY SAYS THAT THE SALE OF ALCOHOL RELATED TO LIKE A GROCERY STORE, OR INCIDENTAL TO THOSE TYPES OF BUSINESSES WOULD STILL BE ABLE TO CONTINUE. AND THIS IS THE COMPARISON BETWEEN THE EXISTING CODE AND THE CHANGES THAT ARE BEING MADE. AGAIN, THIS WOULD RESTRICT LIQUOR STORES TO THE LC3 DISTRICT AS A USE BY RIGHT.
