4. STAFF REPORTS
(a) Update regarding the Quail Valley Parks Projects.
(b) Update regarding the City of Missouri City Police Department's achievement of "Recognized Status" for compliance with the Texas Law Enforcement Agency Best Recognition Program.
5. CONSENT AGENDA - All consent agenda items listed are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event, the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. Information concerning consent agenda items is available for public review.
(a) Consider approving the minutes of the special and regular City Council meetings of August 3, 2009.
(b) Consider awarding a bid for auto/truck paint and body repairs.
(c) Consider authorizing the purchase of new vehicles.
6. PUBLIC HEARINGS AND RELATED ACTIONS
(a) Zoning Public Hearings and Ordinances
(i) Public hearing to receive comments for or against a request by N & N Associates on behalf of A-S 91 Ft. Bend Parkway-Hwy 6, L.P. and Kroger Texas L.P. to amend Planned Development District No. 62 (Ordinance No. O-07-19) an approximate 28-acre tract of land to allow for deviations to the City's Zoning Ordinance for the development of a Burger King Restaurant; providing a penalty; providing for severability; and to consider the ordinance on the second and final reading. The subject site is located southeast of the intersection of State Highway 6 and Vicksburg Boulevard, southwest of the intersection of State Highway 6 and the Fort Bend Toll Road, and east of the Oakwick Forest Estates Residential Subdivision.
(ii) Public hearing to receive comments for or against a request by Ashok Mungara on behalf of Houston Knanaya Catholic Society, Inc. to amend SUP, Specific Use Permit No. 147 (Ordinance No. O-03-35) to add additional acreage to the boundaries of the site and to allow for the development of a new church building; providing a penalty; providing for severability; and to consider the ordinance on the second and final reading. The subject site is located along the west side of Staffordshire Road, immediately north of the V.F.W. Post #4010, at 2210 Staffordshire Road.
(b) Public Hearings and related actions
(i) Conduct a third public hearing to receive comments concerning the structures at 2219 Long Barrel Lane in the City of Missouri City. After receiving comments, City Council will consider declaring the structures as substandard and may issue orders as shall appear reasonably necessary to prevent the structures from being a hazard to life or property and to eliminate the substandard qualities; and to consider an order on the first and final reading.
(ii) Conduct a third public hearing to receive comments concerning the structures at 603 Whippoorwill in the City of Missouri City. After receiving comments, City Council will consider declaring the structures as substandard and may issue orders as shall appear reasonably necessary to prevent the structures from being a hazard to life or property and to eliminate the substandard qualities; and to consider an order on the first and final reading.
7. APPOINTMENTS
(a) Consider confirming appointments to the Parks Board.
(b) Consider appointing members to the board of the Tax Increment Reinvestment Zone One (TIRZ 1).
8. AUTHORIZATIONS
(a) Consider authorizing Staff to post signs at the entrance to all school crossing zones located in the City informing operators of motor vehicles that the use of a wireless communication device is prohibited in the school crossing zone and that the operator is subject to a fine if the operator uses a wireless communication device in the school crossing zone.
9. PUBLIC COMMENTS - An opportunity for the public to address Council on items/concerns not on this agenda.
10. ORDINANCES
(a) Consider an ordinance of the City of Missouri City, Texas, amending City of Missouri City Ordinance No. O-02-14, adopted March 18, 2002, as amended; providing terms and conditions for employee military leave as set forth in the personnel manual; and providing for severability; and consider the ordinance on the second and final reading.
(b) Consider an ordinance of the City of Missouri City, Texas, amending the City of Missouri City Public Infrastructure Design Manual by amending Chapters 7 and 17 thereof; providing rules and regulations for storm water detention and for residential slab elevations; providing a penalty; providing for severability; and consider the ordinance on the first of two readings.
11. RESOLUTIONS
(a) Consider a resolution of the City Council of the City of Missouri City, Texas, suspending the effective date of Centerpoint Energy Resources Corp.'s requested rate changes to afford the City time to study the request and to establish reasonable rates; approving cooperation with other cities within the Harris, Montgomery and Fort Bend County area distribution system to create a steering committee to direct the efforts of legal counsel and consultants necessary for ratemaking or litigation; requiring reimbursement of cities' rate case expenses; authorizing intervention in any ratemaking proceeding at the Railroad Commission that relates to the company's filing; requiring notice of this resolution to Centerpoint Energy Resources Corp.
12. CITY COUNCIL ANNOUNCEMENTS - There are no City Council Announcements at this time.
13. CLOSED EXECUTIVE SESSION The City Council may go into Executive Session regarding any item posted on the Agenda as authorized by Chapter 551 of the Texas Government Code. Notice is hereby given that the City Council may go into Executive Session in accordance with the following provisions of the Government Code: Texas Government Code, Section 551.071 - Consultation with attorney to seek or receive legal advice regarding pending or contemplated litigation, a settlement offer, or on a matter which the duty of the attorney to the City under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Open Meetings Act: sign ordinance.
