3. PRESENTATIONS AND RECOGNITIONS
(a) Recognize State Representative Charlie Howard in appreciation for his outstanding contributions and dedicated service to the citizens of Missouri City.
(b) Introduce Stacie Walker as the City's Public Information Manager.
4. STAFF REPORTS - There are no Staff Reports at this time.
5. CONSENT AGENDA - All consent agenda items listed are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event, the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. Information concerning consent agenda items is available for public review.
(a) Consider approving the minutes of the special and regular City Council meetings of August 17, 2009.
(b) Consider authorizing the Mayor to execute and the City Secretary to attest a Primary Interlocal Agreement between Fort Bend County and the City of Missouri City for assistance in various governmental functions and services.
(c) Consider awarding a contract for the Public Safety Headquarters Parking Lot Expansion.
(d) Consider awarding a contract for plan review services.
(e) Consider amending an authorization for the purchase of new vehicles.
(f) Consider authorizing purchase of HVAC for computer room in Emergency Operations Center.
6. PUBLIC HEARINGS AND RELATED ACTIONS
(a) Zoning Public Hearings and Ordinances - There are no Zoning Public Hearings and Ordinances at this time.
(b) Public Hearings and related actions
(i) Conduct a fourth public hearing to receive comments concerning the structures at 603 Whippoorwill in the City of Missouri City. After receiving comments, City Council will consider declaring the structures as substandard and may issue orders as shall appear reasonably necessary to prevent the structures from being a hazard to life or property and to eliminate the substandard qualities; and to consider an order on the first and final reading.
(ii) Conduct a public hearing to receive comments for or against adopting the City's Comprehensive Plan; repealing all ordinances, resolutions or policies in conflict therewith; and to consider an ordinance on the first of two readings.
7. APPOINTMENTS
(a) Consider an appointment to the Board of the Tax Increment Reinvestment Zone One (TIRZ 1).
8. AUTHORIZATIONS
(a) Consider authorizing the Mayor to execute and the City Secretary to attest the First Amendment to the Development Agreement among the City of Missouri City, the Missouri City Development Authority, Reinvestment Zone Number Two, City of Missouri City and Vicksburg Estates, Ltd., relating to reimbursement of Developer Advances for Lake Shore Harbour Subdivision, Sections 1, 2 and 3.
(b) Consider ratifying the City Manager's execution of a conveyance agreement, authorizing the purchase of property to provide access for the 16th hole of the golf course and authorizing the Mayor to accept the deed upon execution and delivery by the property owner.
(c) Consider authorizing the purchase of 60 acres of land adjacent to the Sienna Plantation development and authorizing the Mayor to accept the deed upon execution and delivery by the property owner.
(d) Consider awarding a contract for the construction of Mass Grading and Raw Reservoirs for Surface Water Treatment Plant.
(e) Consider granting an exemption to the competitive bid requirements of the Texas Local Government Code for the purchase of the water filtration system that is proprietary to Pall Corporation.
9. PUBLIC COMMENTS - An opportunity for the public to address Council on items/concerns not on this agenda.
10. ORDINANCES
(a) Consider an ordinance of the City of Missouri City, Texas, amending the City of Missouri City Public Infrastructure Design Manual by amending Chapters 7 and 17 thereof; providing rules and regulations for storm water detention and for residential slab elevations; providing a penalty; providing for severability; and to consider the ordinance on the second and final reading.
(b) Consider an ordinance of the City of Missouri City, Texas, establishing maximum prima facie speed limits upon portions of streets and highways situated in Missouri City, Texas as designated herein; establishing maximum prima facie speed limits on 5th Street; excepting those speed limits established in school zones; excepting those speed limits established in construction zones; providing a penalty; repealing all ordinances or parts of ordinances in conflict herewith; providing for severability and declaring an emergency; and to consider the ordinance on the first and final reading.
(c) Consider an ordinance of the City of Missouri City, Texas, amending Chapter 30, Environment, of the Code of Ordinances of the City of Missouri City, Texas; regulating discharges to the Municipal Separate Storm Sewer System; providing an effective date, providing a penalty; and providing for severability; and to consider the ordinance on the first of two readings.
(d) Consider an ordinance of the City of Missouri City, Texas, adopting the City of Missouri City Trails Master Plan; repealing all ordinances, resolutions or policies in conflict therewith; providing for severability; and to consider an ordinance on the first of two readings.
(e) Consider an ordinance of the City of Missouri City, Texas, amending City of Missouri City Ordinance No O-02-14, adopted March 18, 2002, as amended; providing terms and conditions for retirement benefits; and providing for severability; and to consider the ordinance on the first of two readings.
11. RESOLUTIONS
(a) Consider a resolution authorizing the publication of the notice of intention to issue City of Missouri City, Texas Certificates of Obligation in a principal amount not to exceed $5,500,000 for construction of public works and the purchase of certain materials, supplies, equipment and machinery for authorized needs and purposes and for payment of contractual obligations for professional services; authorizing distribution of a Preliminary Official Statement relating to such Certificates; and containing other provisions relating thereto.
(b) Consider a resolution of the City Council of the City of Missouri City, Texas, authorizing participation to the full extent permitted by law in proceedings affecting the rates of CenterPoint Energy Resources Corp. customers within the City of Missouri City.

13. CLOSED EXECUTIVE SESSION The City Council may go into Executive Session regarding any item posted on the Agenda as authorized by Chapter 551 of the Texas Government Code. Notice is hereby given that the City Council may go into Executive Session in accordance with the following provisions of the Government Code: Texas Government Code, Section 551.071 - Consultation with attorney to seek or receive legal advice regarding pending or contemplated litigation, a settlement offer, or on a matter which the duty of the attorney to the City under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Open Meetings Act: sign ordinance. Texas Government Code, Section 551.087 - Deliberations regarding commercial or financial information that the governmental body received from a business prospect that the governmental body seeks to locate, stay, or expand in or near the territory of the governmental body and with which the governmental body is conducting economic development negotiations.
