(c) Proclaim Week of October 5-9, 2009, as Fire Prevention Week in Missouri City.

5. CONSENT AGENDA - All consent agenda items listed are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event, the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. (a) Consider approving the minutes of the special and regular City Council meetings of September 21, 2009.
(b) Consider awarding a contract for the construction management and lab testing for mass grading for the surface water treatment plant.
(c) Consider authorizing the Mayor to execute and the City Secretary to attest an Interlocal Agreement with Fort Bend County for the purchase of goods and services.
(d) Consider awarding a contract for traffic signal services.
(e) Consider awarding a contract for the purchase of email software from Dell LP, through the Texas Department of Information Resources cooperative contract.

6. PUBLIC HEARINGS AND RELATED ACTIONS
(a) Zoning Public Hearings and Ordinances
(i) Public hearing to receive comments for or against a request by Margaret Pleasant on behalf of the Palmer Center LP for a Specific Use Permit to locate an adult day care center for senior citizens within a retail space located at 2651 Cartwright Road, Ste. I; providing for penalty; providing for severability; and to consider the ordinance on the first of two readings. The subject site is located within the Quail Valley Shopping Center located at 2601-2703 Cartwright Road, west of Cypress Point Drive.
(ii) Public hearing to receive comments for or against a request by Philip Pecord of AutoZone on behalf of Dr. Assad A. Sergie, Michele L. Sergie, Dr. Aly Sergie, Aicha Safa Sergie, and Aly Assad Sergie to create a Planned Development District for a 1.028-acre tract of land to allow for deviations to the City’s Zoning Ordinance for the development of an AutoZone retail store; providing a penalty; providing for severability; and to consider the ordinance on the first of two readings. The subject site is located southeast of the intersection of State Highway 6 and Vicksburg Boulevard, southwest of the intersection of State Highway 6 and the Fort Bend Toll Road, and east of the Oakwick Forest Estates Residential Subdivision.
(iii) Public hearing to receive comments for or against a request by TBG Partners, Inc. on behalf of the WB Murphy Road Development LLC to rezone an approximate 20.85-acre tract of land from R-5, Townhouse Residential to PD, Planned Development District to locate a mixed use development to include assisted and independent living facilities as well as patio homes, commercial and medical pad sites; providing for penalty; providing for severability; and to consider the ordinance on the first of two readings. The subject site located north of Hampton Drive, east of Murphy Rd. (FM 1092), north and east of the Wells Fargo Bank and south of Oyster Creek and the Quail Valley Thunderbird West Courtyard Homes.
(b) Public Hearings and related actions
(i) Public hearing to receive comments for or against the designation of a 6.2-acre tract of land as Reinvestment Zone No. 5 for tax abatement purposes, to be located in the Lakeview Business Park, in the vicinity of Fondren Road and Buffalo Run within the City of Missouri City; and to consider the ordinance on the first of two readings.

10. ORDINANCES
(a) Consider an ordinance of the City of Missouri City, Texas providing for the assessment, levy, and collection of ad valorem taxes for the City of Missouri City, Texas, for the tax Page 3 of 4 City of Missouri City October 5, 2009, Regular City Council Meeting Agenda
year 2009 and for each year thereafter until otherwise provided; providing the date on which such taxes shall be due and timely paid; authorizing an additional penalty for the collection of delinquent ad valorem taxes in lieu of recovering attorney fees; providing a repealer clause; and to consider the ordinance on the first and final reading.
(b) Consider an ordinance of the City of Missouri City, Texas, amending City of Missouri City ordinance O-02-14, adopted March 18, 2002, as amended; providing terms and conditions for business expense reimbursements and allowances; repealing all ordinances, resolutions or policies in conflict herewith; providing for severability; and to consider the ordinance on the first of two readings.
(c) Consider an ordinance of the City of Missouri City, Texas establishing maximum speed limits for all school zones located within the City, including designating locations and times; providing penalty; repealing all ordinances or parts of ordinances in conflict therewith; providing for severability; and declaring and emergency; and to consider the ordinance on the first and final reading.
11. RESOLUTIONS
(a) Consider a resolution of the City Council of the City of Missouri City, Texas, designating representatives of the 2009 Houston-Galveston Area Council General Assembly and Board of Directors from October 5, 2009, through December 31, 2009.
(b) Consider a resolution of the City Council of the City of Missouri City, Texas, designating representatives of the Houston-Galveston Area Council 2010 General Assembly and Board of Directors.
(c) Consider a resolution of the City Council of the City of Missouri City, Texas, authorizing the execution of an Advance Funding Agreement with the Texas Department of Transportation for the construction of an Intelligent Transportation System including upgrades to all traffic signals to provide regional traffic flow.
