5. CONSENT AGENDA - All consent agenda items listed are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event, the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. Information concerning consent agenda items is available for public review.
(a) Consider approving the minutes of the special and regular City Council meetings of October 5, 2009.
(b) Consider authorizing purchase of an automated pothole patcher.
(c) Consider awarding a contract for Interactive Voice Response software.
(d) Consider authorizing the Mayor to accept and the City Secretary to attest the Special Warranty Deed conveying approximately 33 acres of land, subject to execution and final review of such deed, from Sienna Plantation Levee Improvement District of Fort Bend County, Texas, pursuant to the terms of the Agreement by and between the City of Missouri City, Texas and Sienna Plantation Levee Improvement District of Fort Bend County, Texas for the Site Acquisition for the Surface Water Treatment Plant executed on or around August 18, 2008.
(e) Consider authorizing the Mayor to accept and the City Secretary to attest the Special Warranty Deed, subject to execution and final review of such deed, conveying 31.13 acres of land for park property from Fort Bend County Levee Improvement District No. 19 to the City of Missouri City. (f) Consider authorizing the Mayor to accept and the City Secretary to attest a Temporary Access Easement, subject to execution and final review of such access easement, for 0.07 acres of land from Fort Bend County Levee Improvement District No. 19 for access to a 31.13 acre tract of land.
(g) Consider authorizing the Mayor to accept and the City Secretary to attest a Temporary Access Easement, subject to execution and final review of such access easement, for 0.73 acres of land from GBI Group LLC for access to a 31.13 acre tract of land.
(h) Consider authorizing the Mayor to execute and the City Secretary to attest a Memorandum of Understanding between the City of Missouri City and GBI Group LLC providing for installation of utility stubouts to a 31.13 acre tract of land at a future date.
(i) Designation of Acting City Managers.
6. PUBLIC HEARINGS AND RELATED ACTIONS
(a) Zoning Public Hearings and Ordinances
(i) Public hearing to receive comments for or against a request by Margaret Pleasant on behalf of the Palmer Center LP for a Specific Use Permit to locate an adult day care center for senior citizens within a retail space located at 2651 Cartwright Road, Ste. I; providing for penalty; providing for severability; and to consider the ordinance on the second and final reading. The subject site is located within the Quail Valley Shopping Center located at 2601-2703 Cartwright Road, west of Cypress Point Drive.
(ii) Public hearing to receive comments for or against a request by TBG Partners, Inc. on behalf of the WB Murphy Road Development LLC to rezone an approximate 20.85-acre tract of land from R-5, Townhouse Residential to PD, Planned Development District to locate a mixed use development to include assisted and independent living facilities as well as patio homes, commercial and medical pad sites; providing for penalty; providing for severability; and to consider the ordinance on the second and final reading. The subject site located north of Hampton Drive, east of Murphy Rd. (FM 1092), north and east of the Wells Fargo Bank and south of Oyster Creek and the Quail Valley Thunderbird West Courtyard Homes.
(iii) Public hearing to receive comments for or against a request by Philip Pecord of AutoZone on behalf of Dr. Assad A. Sergie, Michele L. Sergie, Dr. Aly Sergie, Aicha Safa Sergie, and Aly Assad Sergie to create a Planned Development District for a 1.028-acre tract of land to allow for deviations to the City's Zoning Ordinance for the development of an AutoZone retail store; providing a penalty; providing for severability; and to consider the ordinance on the first of two readings. The subject site is located southeast of the intersection of State Highway 6 and Vicksburg Boulevard, southwest of the intersection of State Highway 6 and the Fort Bend Toll Road, and east of the Oakwick Forest Estates Residential Subdivision.

8. AUTHORIZATIONS
(a) Consider authorizing the Mayor to execute and the City Secretary to attest an Interlocal Agreement with Fort Bend County for the collection of annual assessments in Public Improvement District No. 2.
(b) Consider authorizing the Mayor to execute and the City Secretary to attest an Interlocal Agreement with Fort Bend County for the collection of annual assessments in Public Improvement District No. 4.
(c) Consider authorizing the Mayor to execute and the City Secretary to attest a Tax Abatement Agreement between Lufkin Industries, Inc. and the City of Missouri City, Texas for a site located in Reinvestment Zone #5.
(d) Consider appointing the Secretary of Quail Valley Fund, Inc. (the Fund) as the Proxy for the Special Meeting of the Members of the Fund to be held on November 2, 2009, to vote for or against the Amendments to the Articles of Incorporation of the Fund on behalf of the City of Missouri City.

(a) Enrique Paredez is scheduled to appear before City Council to provide comments regarding his water bill.
10. ORDINANCES
(a) Consider an ordinance of the City of Missouri City, Texas, amending City of Missouri City Ordinance O-02-14, adopted March 18, 2002, as amended; providing terms and conditions for business expense reimbursements and allowances; repealing all ordinances, resolutions or policies in conflict herewith; providing for severability; and to consider the ordinance on the second and final reading.
(b) Consider an Ordinance of the City of Missouri City, Texas Authorizing and Ordering the Issuance of City of Missouri City, Texas Combination Tax and Revenue Certificates of Obligation, Series 2009C; Prescribing the Terms and Form Thereof; Providing for the Payment of the Principal Thereof and Interest Thereon; Awarding the Sale Thereof; Authorizing the Preparation and Distribution of an Official Statement To Be Used In Connection with the Sale of the Certificates; Making Other Provisions Regarding Such Certificates, Including Use of the Proceeds Thereof, and Matters Incident Thereto. CONSIDERATION OF THIS AGENDA ITEM HAS BEEN POSTPONED. CITY COUNCIL WILL CONSIDER APPROVAL OF THIS ITEM AT ITS NEXT REGULARLY SCHEDULED MEETING ON NOVEMBER 2, 2009.
11. RESOLUTIONS
(a) Consider a resolution of the City Council of the City of Missouri City, Texas, authorizing the submission of an application to the State Comptroller of Public Accounts State Energy Conservation Office for a Transportation Efficiency Traffic Signal Synchronization and Replacement Stimulus Grant; authorizing the execution and submission of a grant agreement related thereto; and authorizing the payment of matching funds.
(b) Consider a Resolution of the City Council of the City of Missouri City, Texas, authorizing the execution of the Local Transportation Project Advance Funding Agreement for a Congestion Mitigation Air Quality Improvement Category 5 Project Amendment One, between the State of Texas and the City of Missouri City to upgrade the intersection geometrics and traffic signal systems at FM 1092 and Cartwright Road, at State Highway 6 and Glenn Lakes Boulevard, at FM 1092 and Lexington Boulevard, and at State Highway 6 and FM 1092/University Boulevard.
