(a) City Manager will present a report on the City's development process and procedures.
5. CONSENT AGENDA - All consent agenda items listed are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a
Councilmember so requests; in which event, the item will be removed from the Consent Agenda
and considered in its normal sequence on the agenda. Information concerning consent agenda

6. PUBLIC HEARINGS AND RELATED ACTIONS
(a) Zoning Public Hearings and Ordinances
(1) Public hearing to receive comments for or against a request by Mina Barekzei of STM and Associates on behalf of Gary Hamidan and Ali Qattom to amend Ordinance O-09-01 pertaining to PD, Planned Development District #66 to allow for deviations from the architectural style of exterior accent materials and wall signage in order to develop a 9er's Grill Restaurant Franchise; providing for penalty; providing for severability; and to consider the ordinance on the second and final reading. The subject site is located northwest of the intersection of State Highway 6 and Colonial Lakes Drive, south of the Kids R Kids Learning Center and west of the Goodwill Store and Oyster Creek Plantation Subdivision.
(b) Public Hearings and related actions
(1) A public hearing to receive comments concerning the use of FY 2009 Community Development Block Grant Annual Action Plan.

8. AUTHORIZATIONS
(a) Consider ratifying the Mayor's acceptance of an access easement granted by Sienna Plantation Levee Improvement District for access to and from the City's Surface Water Treatment Plant's detention facility.
(b) Consider authorizing City Staff to negotiate and the Mayor to accept, upon successful negotiation by City Staff, an easement from Sienna/Johnson North, L.P., Jason Miller and Melissa Marroquin for installation and maintenance of a roadway and access to and from the City's Surface Water Treatment Plant site.
(c) Consider authorizing the Mayor to execute and the City Secretary to attest an Interlocal Agreement by and between Blue Ridge West Municipal Utility District and the City of Missouri City relating to the conveyance of recreational facilities located at Hunter's Glen Park.

(a) Consider an ordinance of the City of Missouri City, Texas, amending Chapter 58, Motor
Vehicles and Traffic, of the Code of Ordinances of the City of Missouri City, Texas;
regulating the use of wireless communication devices while operating motor vehicles;
providing a penalty; providing an effective date; providing for severability; and to consider
the ordinance on the second and final reading.
(b) Consider an ordinance of the City Council of the City of Missouri City, Texas, ordering the
2010 General election; and to consider the ordinance on the first and final reading.
(c) Consider an ordinance of the City of Missouri City, Texas, amending the Code of Ordinances of the City of Missouri City, Texas, by amending Chapter 22 of the City of Missouri City Code of Ordinances; amending rules and regulations for establishment and maintenance of the Emergency Management Plan; adopting an update to the Basic Plan of the Fort Bend County Interjurisdictional Emergency Management Plan; repealing all ordinances or resolutions in conflict herewith; providing a penalty; providing for severability; and to consider an ordinance on first and of two readings. (a) Consider a resolution of the City Council of the City of Missouri City, Texas, adopting rules governing the investment of funds of the City; repealing City of Missouri City Resolution No. R-08-12 adopted on May 19, 2008, as amended; and designating the Director of Finance to be responsible for the investment of City funds.

13. CLOSED EXECUTIVE SESSION The City Council may go into Executive Session regarding any item posted on the Agenda as authorized
by Chapter 551 of the Texas Government Code. Notice is hereby given that the City Council may go
into Executive Session in accordance with the following provisions of the Government Code:
Texas Government Code, Section 551.071 - Consultation with attorney to seek or receive legal
advice regarding pending or contemplated litigation, a settlement offer, or on a matter which the duty of the
attorney to the City under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas
clearly conflicts with Texas Open Meetings Act: eminent domain proceeding relating to the Quail Valley golf
course.
