(a) Update from Interim City Manager regarding SB 100.
6. CONSENT AGENDA - All consent agenda items listed are considered routine by the City Council and will be enacted by one motion. There will be no separate discussion of these items unless a Councilmember so requests; in which event, the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. Information concerning consent agenda items is available for public review.
(a) Consider approving the minutes of the special and regular City Council meetings of October 3, 2011.
(b) Consider awarding contract for Biosolid Sludge Hauling Services.
(c) Consider authorizing the City Manager to execute an agreement with Ninyo & Moore Geotechnical & Environmental Sciences Consultants for materials testing services on an as-needed basis.
(d) Consider authorizing the acceptance of a water transmission pipeline easement from Sienna/Johnson Development, L.P., for water transmission pipelines serving the Surface Water Treatment Plant.
7. PUBLIC HEARINGS AND RELATED ACTIONS
(a) Zoning Public Hearings and Ordinances
(1) Public hearing to receive comments for or against a request by Kurt Racca of Reese/Racca Interests, Ltd. to amend Ordinance O-02-03 relating to a Specific Use Permit (SUP) - kindergarten and nursery schools, to remove an approximate 1.24 acre tract of land from the boundaries of the SUP, providing a penalty; providing for severability; and to consider the ordinance on the second and final reading. The underlying zoning designation of the property would remain SD, Suburban District. The subject site is located at the intersection of Silver Ridge Boulevard and Sienna Parkway, south of the Primrose School of Sienna and west of the Silver Ridge residential subdivision.
(2) Public hearing to receive comments for or against a request by KTRK Television, Inc., on behalf of Joseph and Maybritt Mujadzic, to obtain a Specific Use Permit to allow for the construction of a 100 foot tower with Doppler radar antenna and associated equipment on a 1.54-acre of land located in an industrial district, providing a penalty; providing for severability; and to consider the ordinance on the second and final reading. The subject site is located northwest of the intersection of Beltway 8 and South Garden Street, north of The Rental Store (Mustang C.A.T. equipment rental facility), south of GH Air Conditioning and Heating, LLC, and west of Landmark Electric.

9. AUTHORIZATIONS
(a) Consider authorizing the execution of the Memorandum of Understanding between the Texas Forest Service, the City of Missouri City and the Fire Marshal relating to the Regional Incident Management Team.
(b) Consider authorizing the Interim City Manager to execute agreements for employee benefits.
(c) Consider authorizing the execution of a Placement Agent Agreement between the City of Missouri City, Texas and First Southwest Company related to the Tax Notes, Series 2011.
10. ORDINANCES
(a) Consider an ordinance of the City of Missouri City, Texas, authorizing the issuance and sale of City of Missouri City, Texas, Tax Notes, series 2011, in the aggregate principal amount not to exceed $1,740,000; levying a tax in payment thereof; authorizing the execution and delivery of a bond purchase contract; and a paying agent/registrar agreement; approving the engagement of certain professionals in connection with the issuance of the bonds; finding and determining that the meeting at which this ordinance is passed is open to the public as required by law; and enacting other provisions relating thereto; and to consider the ordinance on the first and final reading.
11. RESOLUTIONS
(a) Consider a resolution of the city council of the City of Missouri City, Texas, authorizing the Mayor to execute and the City Secretary to attest an Interlocal Cooperation Agreement by and between the Cities of Missouri City, Richmond, Rosenberg and Stafford and Fort Bend County pertaining to the Regional Technical Rescue Team.

13. CLOSED EXECUTIVE SESSION The City Council may go into Executive Session regarding any item posted on the Agenda as authorized by Chapter 551 of the Texas Government Code. Notice is hereby given that the City Council may go into Executive Session in accordance with the following provision of the Government Code: Texas Government Code, Section 551.074 - Deliberation concerning the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee: city manager and director of public works. Texas Government Code, Section 551.071 - Consultation with attorney to seek or receive legal advice regarding pending or contemplated litigation, a settlement offer, or on a matter which the duty of the attorney to the City under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflicts with Texas Open Meetings Act: open meetings act.
