UM, THIS IS OTIS SPRIGS WITH THE DEVELOPMENT SERVICES, THE DEPARTMENT, AND I JUST HAD AN ANNOUNCEMENT AND I WANTED TO, UM, PROVIDE SOME INFORMATION TO THE GENERAL PUBLIC ON BEHALF OF OUR, UM, COMMUNITY DEVELOPMENT DIVISION.

WE ARE, UH, PREPARING FOR THE, UM, THE NEW PROGRAM YEAR 2020 ON THE HERTZ SIDE, UH, IN TERMS OF THE SERVICES THAT WE PROVIDE TO THE COMMUNITY, UM, TO SATISFY THE HERD, UH, NATIONAL OBJECTIVES, WHICH ARE NUMBER ONE TO AID IN THE PREVENTION AND ELIMINATION OF SLUM AND BLIGHT AND BENEFIT LOW TO MODERATE INCOME INDIVIDUALS AND ALSO TO MEET URGENT NEED.

UM, THAT PROGRAM APPLICATION PROCESS HAS BEGUN.

UM, WE'VE BEEN, UM, IN THE APPLICATION PHASE SINCE MAY IN WHICH, UM, STUDENTS WITHIN THE MISSOURI CITY, UH, CITY LIMITS HAVE THE ABILITY TO APPLY FOR SCHOLARSHIPS.

SO WE WOULD HOPE THAT YOU ALL WOULD HAVE RECOMMENDATIONS FOR US AND SEND FOLKS OUR WAY, UM, IN TERMS OF SCHOLARSHIPS AND WE CAN PROVIDE MORE INFORMATION TO THOSE INDIVIDUALS.

SO HAVE THEM CONTACT MYSELF.

SO THOSE APPLICATIONS ARE DUE BY JULY 3RD AND THE DEPARTMENT WILL BE HOSTING ON THE NEXT TWO WEDNESDAYS AT FOUR O'CLOCK VIRTUAL SESSIONS IN WHICH WE'LL HAVE AN OPPORTUNITY TO HAVE AN ORIENTATION AND PRESENTATION ON THAT APPLICATION PROCESS.

UM, SO IF YOU HAVE ANY QUESTIONS BY ALL MEANS MEANS, PLEASE CONTACT US IN TERMS OF THE ACTION PLAN.

THIS IS A PUBLIC HEARING TO RECEIVE COMMENTS FOR OR AGAINST POSSIBLE AMENDMENTS IN THE CITY OF MISSOURI CITY ZONING ORDINANCE REGARDING MOBILE FOOD UNITS.

WE'LL HEAR FROM STAFF FIRST AND THEN WE'LL MOVE TO THE PUBLIC COMMENT.

AGAIN, I AM GOING TO SUMMARIZE JUST WHERE WE'RE AT, UH, WITH, UH, THE MOBILE FOOD UNIT, UH, REGULATIONS AND, UH, PROVIDE A FEW ITEMS FOR US TO DISCUSS TONIGHT.

UM, AND SO THEN ONCE YOU ALL GET TO THE DISCUSSION PART, WE CAN COME BACK TO THOSE ITEMS. UM, SO JUST IN SUMMARY, UM, YOU ALL FIRST, UH, REDISCUSSED THESE ITEMS LAST FALL AND, UM, AT THE DIRECTION OF COUNCIL, UH, LOOKING TO PROVIDE FLEXIBILITY TO ALLOW FOR THE OPERATION OF FOOD UNITS THROUGHOUT THE CITY.

AND SO FROM THE COUNCIL AND THE COMMISSION INPUT, UM, WITH KIND OF, UH, FOCUS IN ON THESE AREAS, UM, IN ALLOWING FOOD TRUCKS TO OPERATE AND CENTRALIZED LOCATIONS AROUND THE CITY, UM, PROVIDE SOME ALLOWANCE FOR ONSITE LOCATION.

UH, AND THEN THE COMMISSION, UH, BROUGHT IN, UM, HAVING A RESERVATION POLICY OR SOME TYPE OF LIMITATION ON TIME, UM, FOR THOSE, UH, UNITS THAT ARE LOCATED AND ALSO ENSURE THAT, UH, HOMEOWNER PROPERTY OWNERS ASSOCIATIONS, AND THEN INDIVIDUAL PROPERTY OWNERS, UM, HAVING PRIVATE PARTIES ALSO HAVE THE ABILITY TO UTILIZE A MOBILE UNIT, UM, AS WE'VE GONE THROUGH THIS PANDEMIC OVER THE LAST SEVERAL, UM, UM, UM, ANOTHER TYPE OF MOBILE VENDOR HAS KIND OF A SURFACE FOR US.

UM, IT'S NOT A NEW CONCEPT.

UH THERE'S UM, UH, EXAMPLES OF IT IN THE HOUSTON AREA AND AROUND THE COUNTRY.

UM, BUT FOR MISSOURI CITY, IT WAS A NEW CONCEPT.

AND SO, UH, WE WERE, UH, INTRODUCED TO GROCERY STORES, UM, ON WHEELS AND, UH, THOUGHT THAT THE TINY WITH US HAVING A SUPPRESSION ON A MOBILE SLEUTH UNITS, UH, IT MIGHT BE APPROPRIATE ALSO TO, UH, CONSIDER THIS TYPE OF MOBILE VENDOR AND WHETHER OR NOT THERE'S ANY DESIRE TO MAKE THIS ALSO ALLOW, UH, THROUGHOUT THE CITY.

SO KIND OF HOW WE'RE LOOKING AT THE MOBILE FOOD UNIT, YOU HAVE REGULATIONS IN PLACE THAT CURRENTLY ALLOW FOR MOBILE CLOSED UNITS TO OPERATE.

AND SO WE'RE LOOKING NOW TO, UH, CREATE, UH, THOSE CENTRALIZED AREAS AND DISTINGUISH IT FROM, UH, THE INDIVIDUAL OPERATORS, UH, THAT MIGHT'VE, THAT MIGHT WANT TO LOCATE A UNIT.

SO THE EXISTING REGULATIONS, UM, THAT ARE CURRENTLY WITHIN THE ZONE ORDINANCE, UM, A LOT OF THEM, THE HOURS OF OPERATION LOCATION, A LOT OF THAT HAS TO DO WITH THE ACTUAL PERMITTING PROCESS.

UH, SO WE'RE LOOKING AT EXPANDING ON THOSE, UH, TO ALLOW FOR THE FLEXIBILITY FOR THE SINGLE OPERATOR, BUT CREATING A NEW, UM, LAND DUES, UH, KIND OF CATEGORY FOR A GROUPING OF OPERATORS, UM, AND LOCATING THEM WITHIN A MOBILE FOOD UNIT PARK.

SO FOR THE SINGLE OPERATOR, WE'RE LOOKING AT TAKING THE CURRENT REGULATIONS THAT ARE IN THE ZONING ORDINANCE, UNDER THE SUPPLEMENTARY REGULATION, THE LOCATION REQUIREMENTS, HOURS OF OPERATION, THE SIGNAGE, WHICH, UH, THE SCIENCE ALLOWANCE FOR MOBILE UNITS IS CERTAINLY WHAT YOU SEE ON THE UNIT ITSELF.

UM, THEY DON'T HAVE THE ABILITY TO LOCATE, UM, SIGNS EXTERIOR, UM, YOU KNOW, TO THE UNIT OR, YOU KNOW, AROUND THE AREA THAT THEY'RE LOCATED.

UM, BUT THOSE KINDS OF REGULATIONS, TRASH DISPOSAL, UM, AND DIFFERENT OPERATIONAL, UM, ITEMS, ALL OF THAT WOULD BE TAKEN FROM THE ZONING BOARD MINUTES AND RELOCATED, UH, TO THE BUSINESSES SECTION OF, UM, UH, THE CITY'S CODE OF ORDINANCES.

SO WHAT WE'RE LOOKING TO ADD TO PROVIDE THE FLEXIBILITY AND TO RESPOND TO SOME OF THE FOCUS AREAS THAT WE'VE DISCUSSED IS ON THE LOCATION REQUIREMENTS.

UH, GENERALLY THE ITEMS YOU SEE HERE THAT ARE NOT IN COLOR OR IN BOLD ARE AREAS THAT ARE, THAT, UH, FOOD TRUCKS ARE PERMITTED TODAY.

SO THE LOCATION REQUIREMENTS THEY'RE ALLOWED TO LOCATE WITHIN THE INDUSTRIAL ZONING, UM, ANY KIND OF INDUSTRIAL ZONING AREA AS CONSTRUCTION BY, UM, AS PART OF A SPECIAL EVENT, A CITY EVENT IN PUBLIC PARKS.

WHAT'S NOT LISTED ON HERE AND I APOLOGIZE FOR NOT INCLUDING IT.

UM, BUT THE CURRENT REGULATIONS DO ALLOW FOR A PROPERTY OWNERS ASSOCIATION OR, UM, A HOMEOWNERS ASSOCIATION, UH, TO LOCATE A FOOD TRUCK AT ONE OF THEIR FACILITIES WITHIN THE NEIGHBORHOOD.

AND SO THAT IS A CURRENT ALLOWANCE, UH, IN, IN THE REGULATION.

SO WHAT WE'RE LOOKING TO ADD,

UH, TO RESPOND TO OUR FOCUS FOCUS AREAS IS TO INCLUDE COMMERCIAL DISTRICTS, ALL OF OUR COMMERCIAL DISTRICTS.

UM, SO YOU'RE THINKING, YOU KNOW, YOUR LC DISTRICTS, UM, YOUR BUSINESS PARK DISTRICTS.

SO, YOU KNOW, ALONG ALL OF THE MAJOR CORRIDORS FOR, UM, YOU KNOW, FOR THE MOST PART, UM, AS WE LOOKED AT SOME OF THE SURROUNDING COMMUNITY REGULATIONS, UM, WE ARE RECOMMENDING TO ADD MULTIFAMILY RESIDENTIAL, OUR DISTRICT TO THAT AS WELL.

AND THAT WOULD COME, THAT WOULD SORT OF FUNCTION SIMILAR TO LIKE THE RESIDENTIAL HOMEOWNERS ASSOCIATION, WHERE IF, UM, THE MANAGEMENT GROUP FOR MULTIFAMILY DEVELOPMENT, UM, IS HAVING A FUNCTION, SPONSORING A FUNCTION, UM, ON SITE THAT THEY WOULDN'T HAVE THE ABILITY AS TO LOCATE A FOOD TRUCK ON SITE, UM, WITHOUT HAVING TO GO THROUGH A SPECIAL EVENT PERMIT, UM, OR ANOTHER TYPE OF APPLICATION.

UM, IN ADDITION TO THAT, UH, WE WOULD EXPAND IT TO ALLOW WITHIN RESIDENTIAL DISTRICTS, UM, FOR PRIVATE HOMEOWNERS, PRIVATE PARTIES, UM, AND THEN ALSO, UH, UH, FROM LOOKING AT SOME OF THE OTHER, UH, COMMUNITY REGULATIONS, UM, EXPANDING IT TO SCHOOL SITES.

UH, SO THAT WOULD INCLUDE PUBLIC AND PRIVATE SCHOOLS, UM, HCC, UM, YOU KNOW, THE COLLEGES SO THAT BECAUSE THEY FREQUENTLY HAVE EVENTS, UH, PORTLAND IFC USUALLY WILL APPLY FOR A SPECIAL EVENT CLIMATE, UH, TO LOCATE A FOOD TRUCK ON, YOU KNOW, AS PART OF THEIR EVENTS, BUT THERE THERE'S TYPICAL FULL EVENTS THAT ARE PART OF, UM, YOU KNOW, THE TYPICAL NO SCHOOL STRUCTURE.

SO OUR RECOMMENDATION IS JUST TO INCLUDE THEM IN THE LIST, UM, FOR LOCATION, UH, THAT INDIVIDUAL UNITS WOULD BE ABLE TO OPERATE, UM, AT ALL OF THESE LOCATIONS WITH THE RECOMMENDATION IS RIGHT NOW IS, UH, TO LIMIT IT TO NO MORE THAN ONE UNIT AND THE UNIT WOULD HAVE TO BE PLAYED ON A FLAT LOT OR RESERVE AND THE FLAT PORTION.

AND THAT IS THINKING THAT, YOU KNOW, TRY TO AVOID UNITS BEING PLACED ON VACANT LOTS, UM, UNIMPROVED LOT, UM, YOU KNOW, LOTS WHERE DRAINAGE OR, YOU KNOW, UTILITY HAVE NOT BEEN FACTORED IN, UH, WHETHER OR NOT, YOU KNOW, THEY'RE EMPLOYED OR NOT.

UM, BUT TRYING TO ENSURE THAT THE LOCATION, UM, IS SUFFICIENT FOR MADELINE'S THE LOCATION OF THE UNIT, UM, BUT INDIVIDUALS ACCESSING, UH, THE PROPERTY, NEXT SLIDE, PLEASE.

AND THE HOURS OF OPERATION AND LOOKING AT PROVIDING THAT FLEXIBILITY AND EXPANDING, UM, WHERE, UM, MOBILE FOOD UNITS COULD BE LOCATED.

UH, THE RECOMMENDATION IS TO EXTEND THE HOURS, UM, FROM 6:00 AM TO 10:00 PM.

UH, SO RIGHT NOW IN YOUR CURRENT, THOSE HOURS ARE ALREADY APPLIED TO CONSTRUCTION SITES.

UH, THIS WOULD BE EXPANDED HOURS FOR INDUSTRIAL ZONING.

UM, SO SOME OF YOU RECALL FROM THE INITIAL CONVERSATION ON FOOD TRUCKS, THE IDEAS WERE, YOU KNOW, AGAIN, NOT TO HAVE TO RESTART, TO COMPETE, YOU KNOW, WITH OUR BRICK AND MORTAR BUSINESSES.

UM, BUT YOU KNOW, AS AN ENHANCEMENT ARE TO BOTH SERVICES.

SO THE CURRENT REGULATIONS RESTRICT FOOD TRUCKS FROM ONLY BEING ABLE TO LOCATE IN INDUSTRIAL AREAS DURING PEAK HOURS.

SO THEY WOULD ONLY BE ABLE TO LOCATE, YOU KNOW, IN THE MORNING RUSH THE LUNCH, RUSH, THE ACCESS, THE EVENING, RAJ, THE DINNER ARREST.

UM, SO THIS WOULD BE EXPANDED HOURS FOR, UM, THOSE ZONES, BUT THIS WOULD APPLY TO ALL OF THOSE AREAS SHOWN ON THE SCREEN.

UM, AND THEN ALSO ONE OF THE THINGS THAT WE STARTED TO DISCUSS IS IF WE'RE LOOKING AT, UH, THE CENTRALIZED AREAS AND CREATING LIKE A MOBILE FOOD PARK, MOBILE FOOD TRUCK PARK, UM, THEN HOW DO YOU DISTINGUISH BETWEEN HAVING A PARK AND THEN THAT SINGLE OPERATOR THAT MAY PULL A PERMIT TO LOCATE ON THE PROPERTY RIGHT.

ONE OF THE ISSUES THAT WE'RE HAVING IS THE MONTHLY, NOT THE MONTHLY FEE, THE, THE, THE FEED THAT THE FOOD TRUCKS HAVE TO PAY EACH TIME THEY COME TO THE MARKET IS $55 EACH TIME.

AND THAT SCARES A LOT OF THE FOOD TRUCK OWNERS AWAY BECAUSE MOST OF THEM HAVE A YEARLY LICENSE THROUGH FORT BEN.

SO I'M ASKING IF WE COULD GET A YEARLY PERMIT, UM, INSTEAD OF THEM HAVING TO PAY $55 EVERY TIME THEY SET UP AT THE, AT THE FARMER'S MARKET, ONE OF THE ISSUES BECAUSE THE FARMER'S MARKET IS ONLY FOUR HOURS AND IT'S NORMALLY FROM 10 TO TWO.

SO A FOOD TRUCK THAT COMES AT 10, NOBODY'S REALLY BUYING ANY FOOD AT 10.

THEY WON'T START EATING UNTIL AROUND 11, 1130.

SO THAT ONLY GIVES THEM A COUPLE OF HOURS TO ACTUALLY SELL.

SO IT'S NOT A, IT'S NOT A GOOD FIT.

AND SO WHAT I'VE DONE TO COMPENSATE, INSTEAD OF THEM PAYING TO BE AT THE, AT THE, UH, FARMER'S MARKET, I FOUND A SCHOLARSHIP FOR SOMEBODY TO PAY THEIR WEEKLY FEED WITH US.

WE HAVE A GROUP IT'S ABOUT SIX OR EIGHT FOOD TRUCKS THAT WE USE, AND WE ROTATE AND, UH, VERY IT'S, IT THEY'RE THE SAME ONES MOST OF THE TIME.

SO FOR EVERYBODY TO HAVE TO COME OUT, YOU KNOW, THE CITY HAS TO SPEND A LOT OF TIMES IN AN INSPECTOR OUT EVERY TIME TO KIND OF REVIEW THE SAME TRUCK THAT MAY HAVE REVIEWED, YOU KNOW, A WEEK AGO OR MAYBE TWO WEEKS AGO.

SO THAT WOULD SAVE A LOT.

AND THEN WE'RE LOSING A LOT OF BUSINESS TO OTHER CITIES.

WE WERE CHARGING THAT EXTRA MONEY EVERY MONTH BECAUSE IF A FOOD TRUCK HAD TO OPERATE EVERY DAY FOR $55 IN MISSOURI CITY, LIKE FOR INSTANCE, IF THEY WERE ON AN OPERATION 28 DAYS, AND SOME OF THEM ARE RE, THIS IS THEIR LIVELIHOOD, THEY'RE PAYING ALMOST $2,000 A MONTH JUST ON FEES FOR THE, UH, FOR THE PERMIT, FOR THE FOOD TRUCK.

SO WE JUST GET A YEARLY FEE THAT WE CAN HAVE FOR THEM INSTEAD OF PAYING A WEEKLY AMOUNT, EVERY THEY WOULD ADD A WHOLE LOT.

AND ONE OF THE BIGGEST STUFF, FOOD TRUCK BUSINESSES, WHICH IS COUSINS.

REMEMBER THEY WERE ON SHARK TANK AND THEY GOT THEIR START AND THEY CAME MUCH MORE SERVICE CITY TO, UM, UM, MARKETING.

THEY, THEY ARE AT THE FARMER'S MARKET IN SUGAR LAND, AND THEY GAVE UP MISSOURI CITY.

THEY WON'T COME BACK TO MISSOURI CITY ANYMORE BECAUSE OF THE HAT PERMITS.

SO THEY JUST DO THE SUGAR LAND BECAUSE THEY GO WITH JUST THE COUNTY AND THEN THEY HAVE A SMALL YEARLY FEE FOR THEM.

SO IF WE COULD CONSIDER THAT, THAT WOULD HELP A WHOLE LOT BECAUSE THEY'RE SMALL BUSINESSES AND, YOU KNOW, WE WANT TO HELP THEM.
