[4. REPORTS]

WE'RE NOW AT THE POINT OF STAFF REPORT, UM, DIRECTOR OTIS ON TONIGHT.

I THINK HE WANTED TO INTRODUCE US TO THE NEW CITY MANAGER, MR. JONES.

GOOD EVENING.

AS WE WANTED TO INTRODUCE TO THE COMMISSION COMMISSIONERS OF MODUS JOHNSON CITY MANAGER WITH THE CITY HE'S BEEN WITH US SINCE MAY, JULY OF THIS YEAR.

SO HE WANTED TO TAKE AN OPPORTUNITY TO, TO SPEAK TO THE COMMISSION AND ADDRESS YOU ALL.

SO THANK YOU.

AND PLEASE WELCOME OUR NEW CITY MANAGER, OTIS JONES, MADAM CHAIR, MEMBERS OF CA UH, MEMBERS OF THE COMMISSION.

I JUST WANTED TO INTRODUCE MYSELF.

I'VE BEEN HERE FOR A FEW MONTHS NOW AND I'M, I'M STILL MAKING MY ROUNDS.

UH, BUT I, YOU KNOW, I WANTED TO LET YOU KNOW THAT, UM, UH, MY OFFICE IS HERE FOR YOU.

IF YOU NEED ANYTHING.

I KNOW THAT YOU WERE IN GOOD HANDS AND KEEPING WITH OTIS AND THE STAFF.

UH, BUT UH, I WANTED TO MAKE SURE THAT, UH, I GOT AN OPPORTUNITY JUST TO SAY HELLO.

UH, AND, UH, I LOOKED FORWARD TO EMMA, BE REACHING OUT TO, TO SCHEDULE SOME ONE-ON-ONE TIME WITH ALL OF THE COMMISSIONERS, UH, OF THE CITY.

SO I LOOK FORWARD TO HOPEFULLY SIT DOWN INDIVIDUALLY WITH ALL OF YOU AND GETTING TO KNOW YOU, UH, I'VE BEEN, UH, IN THIS BUSINESS FOR APPROXIMATELY A LITTLE OVER 25 YEARS.

UH, YEAH, I STARTED ON AN EAST COAST AND THE MIDWEST AND MOST PART OF MY CAREER, UH, LED, UH, BOTH STATE AND LOCAL GOVERNMENT ORGANIZATIONS, UH, WERE MANAGED AND SUPERVISE STAFF OF OVER 1500 PEOPLE AND A BUDGET NORTH OF $250 MILLION.

OBVIOUSLY IN MY CAPACITY HERE IN MISSOURI CITY, I'M RESPONSIBLE FOR THE DAY-TO-DAY OPERATIONS OF THE CITY AND SERVING AS THE CHIEF EXECUTIVE OF THE CITY.

UH, AND, UH, UH, I WANTED TO ALSO TO, IF I MAY, UH, JUST REMIND THE PUBLIC WHO MAY BE LISTENING, THAT OUR COVID, UH, NUMBERS ARE UP AND JUST TO REMIND EVERYONE, PLEASE BE SAFE, UH, AND MAKE SURE YOU'RE TAKING ALL THE PRECAUTIONS REGARDING TO SOCIAL DISTANCING.

I KNOW THAT THE MAYOR, UH, AS WELL AS OUR MEDICAL DIRECTOR AND I HAVE BEEN MEETING, UH, AND WORKING CLOSELY ON MONITORING THE SITUATIONS.

AND AT SOME POINT,

[00:10:01]

UH, I KNOW THE MAYOR WOULD LIKE TO SEE THAT WE GET OPEN.

HOWEVER, UH, AT THIS POINT, GIVEN THE NUMBERS THAT ARE GOING UP, UH, THE MEDICAL DIRECTOR AND THE MAYOR HAVE DECIDED THAT WE'RE GOING TO CONTINUE HAVING ALL OF OUR MEETINGS VIRTUAL AT THIS POINT.

UH, BUT, UH, I JUST WANT TO REMIND THE PUBLIC AND REMIND EVERYONE TO BE SAFE, TAKE THE PRECAUTIONS BECAUSE COVID IS REAL.

SO, UH, WITH THAT, I'LL BE HAPPY TO, UH, ASK ANY QUESTIONS YOU, UH, COMMISSIONED MAY HAVE OF ME, BUT I TRULY LOOK FORWARD TO SITTING DOWN AND, AND, UH, AND MEETING ALL OF YOU, UH, AND WORKING WITH YOU AS I, I TRULY APPRECIATE ALL YOUR COMMITMENT, UH, THAT YOU'VE MADE TO THE CITY AND YOU ARE CONTINUING TO MAKE AS WELL.

SO, UH, WITH THAT, UH, I, UH, JUST SAY THANK YOU AND, AND THANK YOU FOR GIVING ME AN OPPORTUNITY TO DO SOME MYSELF.

OKAY.

THANK YOU SO MUCH FOR JOINING US ALL TONIGHT.

AND IT IS A PLEASURE TO ME TOO, AND ITS OWN AS, UH, THE PANDEMIC ALLOWS US TO MEET.

I'M PRETTY SURE WE ALL LOOK FORWARD TO MEETING YOU COMMISSIONERS.

DID YOU GUYS HAVE ANY QUESTIONS OF MR. JONES? NO, THIS IS COMMISSIONER LUCAS.

JUST WORK ON, UH, MR. JONES TO THE CITY.

THANK YOU.

AND, UH, AGAIN, UH, I TRULY LOOK FORWARD TO MEETING ALL OF YOU.

UH, I KNOW IT'S A LITTLE TOUGH BECAUSE OF THE COVID, UH, UH, SITUATION.

UM, YOU KNOW, YOU TEND TO KIND OF HAVE THESE THINGS MORE IN PERSON, BUT, UH, WE, WE ALL HAVE TO BE VIRTUAL TO MAKE SURE WE'RE PROTECTING OURSELVES AND PROTECTING THE PUBLIC.

AND, UH, AGAIN, JUST THE SHOUT OUT TO THE PUBLIC, UH, YOU KNOW, MAKE SURE YOU'RE TAKING ALL THE PRECAUTIONS.

UM, WE'RE IN CONSTANT CONVERSATION WITH, UH, NOT ONLY OUR OR OUR COUNTY HEALTH DIRECTOR, BUT ALSO TO THE CITY'S OWN MEDICAL DIRECTOR AND THE STATE AND OUR NUMBERS ARE SKYROCKETING.

SO BE SAFE, WEAR YOUR MASK AND MAKE SURE YOU STAY SOCIAL DISTANCE AND WASH YOUR HANDS.

THIS IS COMMISSIONER OVERTON, UH, EXCUSE ME.

I HAD A QUESTION.

ARE THERE ANY, UH, TESTING SITES IN MISSOURI CITY OR FORT BEND COUNTY, THERE, THERE, THERE ARE SEVERAL, UH, SITES WHERE YOU CAN GET TESTED OR THAT THE PUBLIC CAN GET TESTED.

UH, THOSE ARE POPULATED ON OUR WEBSITE, UH, WHAT WE WILL DO, UH, I WILL ALSO HAVE STACY OUR COMMUNICATION DIRECTOR JUST SENT A QUICK, UH, HIGHLIGHT ON OUR, UH, SOCIAL MEDIA POSTS, JUST TO REMIND YOU OF WHERE, WHERE THOSE LOCATIONS ARE.

BUT, UH, YES, THERE IS.

AND, UH, THE KEY THING THOUGH, AS A, OUR MEDICAL DIRECTOR, AND YOU MENTIONED THAT YOU'RE WASHING YOUR HANDS AND THE MEMBERS AND AT YOU, UH, WEAR YOUR MASK, UH, AND, UH, JUST WEARING THE MASK IN ITSELF.

UH, THE RESEARCH HAS SHOWN US THAT, UH, IT CAN SAVE MANY LIVES.

SO JUST, JUST TO THE PUBLIC, JUST WEAR YOUR MASK, STAY SOCIALLY DISTANCE AND KEEP YOUR HANDS WASHING.

AND WITH THAT, THANK YOU FOR YOUR TIME.

I APPRECIATE IT.

AND I DON'T WANT TO TAKE UP YOUR TIME CAUSE I KNOW YOU'VE GOT A LONG AGENDA HIT.

THANK YOU VERY MUCH, DOUG.

IT LOOKS LIKE, UM, MADAM CHAIR MAY BE, UM, HAVING AUDIO ISSUES.

I THINK THE, UM, TELEPHONE LINE IS MUTED.

WOULD YOU LIKE TO GO I'M ON, IF YOU GUYS CAN HEAR ME.

YES, WE CAN HEAR, WE CAN HEAR YOU.

ALL RIGHT.

THANK YOU.

AND I'M SO SORRY.

I DON'T KNOW WHAT'S GOING ON WITH THIS STUFF.

WE'LL MOVE NOW.

UM, TO CITY ENGINEERING, IF CITY ENGINEERING HAS A REPORT, THIS IS JEREMY, THE ASSISTANT CITY ENGINEER, GOOD EVENING COMMISSIONERS.

UM, THE ENGINEERING DIVISION IS CURRENTLY UPDATING THE CITY'S WATERSHED MASTER PLAN.

UH, THE PURPOSE OF THIS WATERSHED MASTER PLAN UPDATE IS TO REVIEW SPECIFIC FLOOD RELATED INFORMATION THAT CAN BE

[00:15:01]

USED BY THE CITY STAFF AND ACT ENTITIES RELATED TO FLOOD RISK, PREPAREDNESS, PLANNING, AND FLOOD RESPONSE DURING EMERGENCIES, IN ORDER TO INCORPORATE LOCAL FEEDBACK, WE HAVE SET UP A WEB PAGE AS WELL AS A MAP WHERE RESIDENTS CAN PLACE A PIN ON THE MAP SHOWING WHERE THEY NOTICED SOME DRAINAGE CONCERNS.

UH, I'LL HAVE THE DIRECT LINK ADDED TO THE MEETING MINUTES, BUT, UH, IN GENERAL, THE PATH TO GET THERE IS, UH, ONCE YOU'RE ON THE MAIN WEBPAGE FOR MISSOURI CITY, YOU GO TO DEPARTMENTS, THEN UNDER DEPARTMENTS, YOU GO TO PUBLIC WORKS, THEN DIVISIONS, THEN DRAINAGE, AND THEN YOU'LL SEE THE WATERSHED MASTER PLAN UPDATE.

YOU CAN ALSO JUST TRY GOOGLING MISSOURI CITY WATERSHED, MASTER PLAN UPDATE, AND IT CAN LEAD YOU TO OUR WEBPAGE AS WELL.

WE LOOK FORWARD TO RECEIVING RESPONSES FROM OUR CITIZENS.

THAT'S ALL.

OKAY.

THANK YOU SO MUCH, MR. DAVIS, AT THIS TIME, THIS IS THE PUBLIC COMMENT OPPORTUNITY.

UM, IF THERE IS ANYONE IN THE AUDIENCE THAT WOULD LIKE TO SPEAK TO THE COMMISSION OF PARTICULARLY IN REGARDS TO A MATTER, THAT IS NOT ON THE AGENDA, WE'LL HEAR FROM THEM NOW.

SHERRY BROWN.

MARSHALL.

YES.

I DID NOT SEE ANYONE WHO SPEAK FOR THE PUBLIC COMMENTS.

OKAY.

THANK YOU SO VERY MUCH.

WE'LL MOVE FORWARD.

NOW UNDER ITEM

IF THOSE ITEMS WOULD STAND AS POOLED, PLEASE, ALL OTHER ITEMS, I WOULD ENTERTAIN A MOTION TO ACCEPT THOSE AT THIS TIME.

COMMISSIONER LUCAS MAKE THE MOTION TO ACCEPT THE ITEMS ON THE CONSENT AGENDA.

I THINK MADAM CHAIR HAS FROZEN UP AGAIN.

IS THERE YOU HAVE A MOTION AND A SECOND SAY OUR COMMISSIONERS.

I'M SORRY.

AND WAS THERE A MOTION TO POOL THE OTHER AGENDA ITEMS? HELLO EVERYBODY.

CAN YOU HEAR ME? YES.

COMMISSIONER MARSHALL IS ON HER PHONE.

UM, AND SO SHE WAS SAYING IF SHE FREEZES, SHE CAN STILL HEAR, BUT HER PHONE NEEDS TO BE UN-MUTED.

YOU SHOULD BE ABLE TO HIT STAR SIX TO UNMUTE IF YOU'RE ON A CELL PHONE.

YES, THAT SHOULD UNMUTE THE PHONE.

OKAY.

WONDERFUL GUYS.

I AM UN-MUTED SO EVEN IF I GO AWAY, I'M STILL HERE.

SO THE ENGINEERING DEPARTMENT WANTED IT SET WITHIN THE SECTION AND IT'S NOW WITHIN, UM, IT'S LOCATED ON THE NORTHEAST CORNER OF THE PLATTE AND THEN THE FLAT NOTES, 10 AND 11 HAVE ALSO BEEN UPDATED, FLAGGED THE TEMPORARY BENCHMARK.

AND, UM, YOU ARE APPROVED, UH, THAT YOU WERE PRE PARK'S EDGE SECTION 18, ALL CONDITIONS HAVE BEEN MET, CORRECT? YES.

NOW TO ITEM SIX 82, WHICH WOULD BE PARK STAGE SECTION 19.

AND SAME WITH SECTION, UM, 19 FOR PARK'S EDGE.

THE TEMPORARY BENCHMARK WAS LOCATED OUTSIDE OF THE SUBDIVISION.

SO, UM, THE TEMPORARY BENCHMARK HAS BEEN REVISED AND LOCATED WITHIN THIS SECTION ON THE SOUTHEAST CORNER OF THE PLAT AND FIVE, 10, AND 11 HAVE ALSO BEEN UPDATED TO REFLECT THE ADDITION OF TEMPORARY BENCHMARK.

AND THEN WE ASKED THAT YOU APPROVED THE PARK'S EDGE SECTION 19.

OKAY.

SOUNDS GOOD.

SO ALL CONDITIONS HAVE BEEN TAKEN CARE OF AS WELL HERE.

OKAY.

IS THERE A MOTION THAT WE APPROVE PARKS AGE 19? THANK YOU SO MUCH, COMMISSIONER O'MALLEY.

[7A. PUBLIC HEARING FOR A SPECIFIC USE PERMIT]

MOVE NOW TO ITEM SEVEN, THE ZONING MAP AMENDMENT, THE FIRST ITEM, WHICH WILL BE ITEM A AS A PUBLIC HEARING FOR AN ISSUE P WILL RECEIVE COMMENTS FOR OR AGAINST IT REQUESTS BY SCOTT NICHOLS, DESTINY CHURCH, OR AN SUP TO LOCATE A PLACE OF ASSEMBLY WITHIN APPROXIMATELY 7,000 SQUARE FOOT

[00:25:01]

LEASE LOCATED IN THE VILLAGE WALK SHOPPING CENTER.

GOOD EVENING, MADAM CHAIR AND COMMISSIONERS.

THE VILLAGE WALK SOUTH AND CENTER IS LOCATED SOUTH AND WEST OF THE INTERSECTION OF FM 10 9,200 CAR, RIGHT? AND EAST OF THE MISSOURI CITY PUBLIC SAFETY HEADQUARTERS.

THE APPLICANT IS REQUESTING A 7,000 SQUARE FOOT, UH, ASSEMBLY, UH, IN WHICH THEY WILL HAVE A SYMBOL, THE AREA OFFICES, A COFFEE STATION AND KIDS' SPACES.

CURRENTLY THE CHURCH MEETS AT THE BALLROOM AT THE HAMPTON INN LOCATED AT 49 ZERO NINE HIGHWAY SIX.

AND THE PASTOR AS CURRENTLY STATED AT THE, UH, CONGREGATION SIZE IS 80 MEMBERS IN TERMS OF THE ZONING.

IT IS EL C3.

AND AS YOU CAN SEE ON THE, UH, ON YOUR SCREENS, YOU CAN SEE THE LOCATION, UH, OF THE, UH, AC CELL STORAGE, WHICH IS A PD UNIT, AS WELL AS THE STRIPES, UH, STRIVES CONVENIENCE STORE NEXT TO IT.

AND THE, UH, WAS THERE A CITY, UH, PUBLIC SAFETY OPERATIONS IN REGARDS TO THE CONFORMANCE WITH THE FUTURE LAND USE PLAN? UH, IT IS LOCATED IN THE FM 10 92 CORRIDOR, WHICH IS FOCUSES ON OPPORTUNITIES FOR FUTURE OFFICE AND FLEX BASED DEVELOPMENT.

UH, AND THERE IS NORTH THE COURT ROADS, UH, CAR CAUGHT RIGHT ROAD, UM, IN REGARDS TO THE HISTORY OF THE PROPERTY, UM, DUE TO SOME OF THE COMMERCIAL AND RETAIL DEVELOPMENT ALONG HIGHWAY SIX, UH, THIS CORRIDOR HAS HAD, UH, SOME CHALLENGES IN REGARDS TO, UM, OCCUPY AND TENANTS AT THE CURRENT SPACE.

AS YOU CAN SEE, THERE ARE, UH, POINTS OF ACCESS FROM THE LOCATION.

ONE OFF OF FM, 10 92, THE OTHER OFF OF CARTWRIGHT ROAD.

WE DID SPEAK WITH THE ENGINEERING DEPARTMENT AND THEY DID STATE THAT AT THIS POINT, NO, A TIA OR A WORKSHEET IS REQUIRED AT THIS TIME, BASED ON THE CURRENT, UM, CONDITIONS OF THE PROPERTY.

UH, WOULD IT BE AN EXISTING PARKING SPACES AND DRAINAGE AND THINGS OF THAT NATURE IN REGARDS TO DE LANDSCAPING? NO NEW LANDSCAPING HAS BEEN PROPOSED AT THIS TIME, AS WELL AS ANY NEW, UH, DUMPSTERS OR WASTE BEANS.

UM, THE CHURCH DOESN'T THINK THERE EXCEED OR REQUIRE ADDITIONAL DUMPSTER AT THIS POINT IN TIME, IN TERMS OF THE, UH, ALSO AS YOU SAW ON THE SITE PLAN, UM, THEY DID HAVE ENOUGH PARKING SPACES, UM, THAT THEY SHOWED A APPROXIMATELY 219 PARKING SPACES BEING PROVIDED IN THE FRONT.

AND THERE'S AN ADDITIONAL 13 PARKING SPACES IN THE REAR, UH, ACCORDING TO OUR PARKING STANDARDS, WHICH IS SIX AND 12.2, UH, THE CHURCH, A PLACE OF ASSEMBLY, UM, AS A REQUIREMENT OF A MINIMUM OF 38 PARKING SPACES.

AND THEY DO, UH, THEY DO, UH, HAVE THAT, UH, CURRENTLY AT THIS POINT AT TIME, THE PAST THE DISK SPEAK OF, UH, THE GROWTH OF THE CHURCH, HE'S UNSURE OF PROJECTION AT THIS POINT IN TIME, BUT HE WAS SEEKING TO, UH, DOUBLE THE CONGREGATION TO 190 PERSONS.

SO BASED ON THE INFORMATION THAT WAS PROVIDED, UM, AND DATE, THEY ARE ALSO SEEKING A FIVE-YEAR LEASING, UH, OPTION WITH THE PROPERTY IF, UH, ALLOW THEIR AGREEMENT.

SO BASED ON THE INFORMATION OF EVERYTHING, UH, MEETING STAFF'S APPROVAL AT THIS POINT, STAFF RECOMMENDS APPROVAL TO SUP WITHOUT, FOR THE ALLOWED LOCATION OF A PLACE OF ASSEMBLY, NOT TO EXCEED THE FIVE YEARS.

UM, IT IS OUR DESIRE THAT THE PLANNING COMMISSION SHOULD ADOPT THIS AS HIS FINAL REPORT AND FORWARD TO THE CITY COUNCIL, A RECOMMENDATION.

OKAY.

THANK YOU SO MUCH, MR. WHITE.

UH, VERY GOOD.

UH, DESCRIPTIVE OVERVIEW OF THE PLANT COMMISSIONERS.

DO YOU GUYS HAVE ANY QUESTIONS OF MR. WHITE? OKAY.

[00:30:01]

THIS IS A PUBLIC HEARING.

IF THERE IS ANYONE THAT HAS SIGNED UP TO SPEAK IN REGARDS TO THIS MATTER, UH, WE'D GLAD TO HEAR FROM THEM RIGHT NOW.

DON'T HAVE ANY LISTS FROM ANYONE INTERESTED IN SPEAKING IN REGARDS TO THIS PROGRAM.

UH, JAMIE, CAN YOU CONFIRM, I DO CONFIRM THAT I DO NOT SEE ANYONE TO SPEAK ON, ON THIS AGENDA ITEM.

OKAY.

I REALLY DO APPRECIATE IT.

THANK YOU SO MUCH.

IS THERE A MOTION THAT WE CLOSE THE PUBLIC HEARING? OKAY.

HERE, MADAM HERE.

I'M SORRY.

MADAM CHAIR.

IS THERE SOMEONE HAND RAISED, VISIBLE? ROLLING.

IS THAT A HAND RAISE? WELL, THANK YOU FOR THAT.

UH, I CAN'T SEE IT.

SO THANK YOU FOR THAT, DOUG.

WOULD YOU CONFIRM IT? THERE WAS A HAND RAISED OR NOT.

GO AHEAD, MS. ROLLINS, MS. ROLLINS, I BELIEVE MS. ROLLINS IS, UM, MAYBE FOR THE NEXT AGENDA ITEM.

OH, OKAY.

THANKS.

THANK YOU SO MUCH.

ALL RIGHT.

YEAH, THIS IS JENNIFER.

I BELIEVE THE APPLICANT IS ON THE LINE.

IF YOU WILL WANT TO HEAR FROM THEM, I WAS JUST GETTING READY TO CALL THEM FOR HIM.

THANK YOU.

YES, SIR.

UM, AND I GUESS WE'LL DO THAT BEFORE WE CLOSE THE PUBLIC HEARING.

SURE.

IF THE APPLICANT IS, UM, AVAILABLE AND HE'D LIKE TO GIVE US AN OVERVIEW OF THE PROJECT.

SURE.

THIS IS PASTOR SCOTT NICHOLS, AND I THINK IT WAS COVERED VERY WELL.

I DON'T KNOW THAT I WOULD HAVE ANYTHING TO ADD THAN WHAT YOU'VE ALREADY HEARD.

OKAY.

THANK YOU SO MUCH, MR. NICKEL.

YOU'RE WELCOME.

COMMISSIONER, DID YOU HAVE ANY QUESTIONS OF THE APPLICANT FIVE YEARS? AND YOU'RE STILL THINKING, WELL, OUR HOPE IS TO EVENTUALLY, UH, OBTAIN A LARGER LOCATION, EVEN IF WE HAVE TO, UH, DO A SEARCH FOR LAND AND BUILD A BUILDING LATER ON, BUT THIS WOULD BE AN INTERIM STEP TO GET US FROM WHERE WE ARE NOW TO THAT POINT.

UH, BUT I FULLY ANTICIPATE BY THE END OF FIVE YEARS THAT WE'RE PROBABLY GOING TO NEED ANOTHER SPACE.

SO THAT'S WHY THE TERM, UH, THE FIVE-YEAR TERM HAS BEEN DISCUSSED.

ARE THERE ANY OTHER QUESTIONS FROM THE OTHER COMMISSIONERS? IS THERE A MOTION THAT WE CALL IT? OKAY, GO AHEAD.

I'M SORRY.

AND LUCAS YOU'RE ASSEMBLING WILL BE, OR WE WOULD MEET, WE WOULD MEET ON SUNDAYS RIGHT NOW.

WE MEET ON SUNDAYS AT 11:00 AM AND WE, WE WOULD MOST LIKELY MEET ON WEDNESDAY AT SEVEN 30.

AND I BELIEVE IN BOTH OF THOSE TIMEFRAMES, THERE ARE NONE OF THE OTHER TENANTS IN THE SPACE.

THE SPACES ADJACENT TO US ARE ACTUALLY OPEN FOR BUSINESS DURING THOSE HOURS.

OKAY.

ARE THERE ANY OTHER QUESTIONS FROM THE COMMISSIONERS? THANK YOU, MR. O'MALLEY.

IS THERE A SECOND, SECOND.

THANK YOU.

ALL THOSE IN FAVOR TO CLOSE PUBLIC HEARING SIGNIFY BY SAYING AYE.

AYE, AYE.

AS WELL.

ARE THERE ANY NOS? OKAY, WONDERFUL.

THAT MOTION CARRIES.

OKAY, GUYS, WE'VE HEARD ABOUT THE PROJECT AT THIS POINT AND, UM, STAFF IS RECOMMENDING POSITIVE RECOMMENDATION.

IS THERE A MOTION WE'LL ACTUALLY THAT WE APPROVE? THIS IS A FINAL REPORT AND FORWARD THIS ON TO CITY COUNCIL.

IS THERE A MOTION? THANK YOU, MR. O'MALLEY.

IS THERE A SECOND TO MISSION A LUCAS? SECOND.

THANK YOU, MS. LUCAS, ANY FURTHER DISCUSSION? ALL THOSE IN FAVOR SIGNIFY BY SAYING AYE AND I AS WELL.

ARE THERE ANY NOS OR EXTENSION?

[00:35:03]

THANK YOU.

THAT MOTION.

KAREN WE'LL MOVE NOW

[7B. PUBLIC HEARING FOR A SPECIFIC USE PERMIT]

TIE THEM SEVEN DAY, WHICH IS ALSO A PUBLIC HEARING FOR SGT.

SPECIFIC USE PERMIT WE'LL RECEIVE COMMENTS FOR OR AGAINST THE REQUEST BY JOSEPHINE STEWART TO LOCATE AN ASSISTED LIVING FACILITY, AN INSTITUTION FOR ELDERLY PERSON, MENTALLY IMPAIRED PERSONS OR PHYSICALLY IMPAIRED PERSON WITHIN AN EXISTING SINGLE-FAMILY RESIDENTIAL HOME.

YES MA'AM.

CAN YOU HEAR ME? YES, MA'AM.

OKAY.

UM, NEXT SLIDE, PLEASE.

THE LOCATION IS OUTLINED IN RED.

IT MAY BE A LITTLE DIFFICULT TO SEE.

UM, IT'S SHOWN US THE PROPOSED ASSISTED LIVING ON THE MAP AND IT'S LOCATED AT 1405 ADAMS STREET AND THAT'S TO THE EAST OF TEXAS PARKWAY, UH, NEAR THE INTERSECTION OF FIFTH STREET IN, UH, TEXAS PARKWAY.

NEXT SLIDE PLEASE.

SO A LITTLE BACKGROUND, UM, ON THIS REQUEST, UM, THIS REQUEST WAS MADE, UH, BACK IN 2014, UH, FOR AN ASSISTED LIVING FACILITY.

IT'S CURRENTLY BEING USED AS A FACILITY, UM, FOR, UH, THE COMMISSIONER.

SOME OF YOU MAY BE AWARE, UH, SOME NOT, UM, BUT, UH, THERE IS A TEXAS STATE LAW KNOWN AS THE TEXAS COMMUNITY HOMES FOR PERSONS WITH DISABILITIES.

UM, THAT ALLOWS FOR CERTAIN, UH, SMALL, UH, COMMUNITY HOME, UH, GROUP HOMES, UH, FOR PER PERSONS, UH, VARYING DEGREES, UM, OF ABILITIES, UH, TO BE LOCATED IN RESIDENTIAL AREAS AND PROVIDED THAT THOSE HOMES MEET CERTAIN QUALIFICATIONS, INCLUDING NOT EXCEEDING MORE THAN SIX BIT IN TWO CAREGIVERS AT THE HOME AT ANY POINT IN TIME.

UM, THEN THEY ARE CONSIDERED UNDER THE RESIDENTIAL ZONING DESIGNATION, UH, FOR MUNICIPALITIES, IF A COMMUNITY HOME EXCEEDS THAT NUMBER OR DOESN'T NEED THE QUALIFICATIONS ESTABLISHED BY THAT ACT.

UM, THEN IT IS STILL SUBJECT TO THE CITIES AS ZONING REGULATIONS, UM, AND A SPECIFIC USE PERMIT IS REQUIRED, UH, IN MISSOURI CITY, THE SUBJECT LOCATION, UH, THE PROPERTY OWNERS, UM, AND THEY'RE ALSO THE OPERATORS OF THE FACILITY.

UM, AND THEY HAVE A SMALL PRESENTATION AFTER I, I FINISHED.

UM, BUT THEY'RE PROPOSING TO EXPAND, UH, THE LEVEL OF SERVICE THAT THEY PROVIDE, UM, FROM THIS HOME.

AND SO WHAT THEY'RE LOOKING TO DO IS TO EXPAND, UH, TO PROVIDE SERVICES FOR UP TO 16 RESIDENTS.

AND THIS WOULD BE, UH, LARGELY SENIOR AND DISABLED PERSONS THAT THEY WOULD BE, UH, PROVIDING SERVICES FOR.

THEY ARE, UH, PROVIDING A TYPE B FACILITY, UM, AS DEFINED BY THE TEXAS DEPARTMENT OF AGING AND DISABILITY SERVICES, WHICH IS ALSO THE LICENSING AGENCY, UM, FOR THIS FACILITY.

UM, AND THAT WOULD INCLUDE THE ONSITE ADMINISTRATION OF MEDICATIONS.

UM, AND THEN THERE'S ALSO LAUNDRY CLEANING, UM, AND, UH, HOSPICE CARE, UH, THAT WOULD BE PROVIDED.

THE PURPOSE OF THESE OF FACILITIES ARE TO ALLOW, UH, PERSONS, UM, IN, YOU KNOW, VARIOUS STAGES OF HEALTH, UH, TO BE ABLE TO MAINTAIN LIVING IN A RESIDENTIAL SETTING, UM, AS OPPOSED TO GOING AND HAVING TO LIVE IN MORE OF AN INSTITUTIONALIZED, UH, KIND OF SETTING.

UM, SO THE PURPOSE OF THIS APPLICATION IS TO MAINTAIN, UM, THE RESIDENTIAL CHARACTER, UH, BUT TO INCREASE THE NUMBER OF RESIDENTS THAT ARE PROVIDED SERVICE FOR AT THIS FACILITY, UH, STAFF DOES RECOMMEND APPROVING, UH, THE SUP AND, UH, THE STAFF REPORT THAT'S BEEN PROVIDED HAS NOTED, UH, SOME PARKING CLARIFICATION'S, UH, SCREENING BUFFERING, UM, AND SOME SIGNAGE CONSIDERATIONS, UM, FROM THE 2014, UM, APPLICATION, THERE WERE, UH, THE PROPERTY OWNER AT THAT POINT WAS LOOKING AT ADDING, UH, SOME PARKING ON TO THE SITE I'VE SINCE SPOKEN WITH, UM, MR. STEWART, UM, PART OF THE TEAM THAT OWNS THIS PROPERTY, UM, AND HE'S CLARIFIED WHAT YOU CAN SEE IN THIS PICTURES.

AND THESE ARE OLD FIXTURES, UM, FROM 2014.

UM, BUT THERE IS A CIRCULAR DRIVEWAY, UH, COMING OFF OF ADAMS STREET, UH, THAT RUNS TO THE FRONT OF THE HOUSE AND THEIR INTENT WITH THE FACILITY, UM, FROM CAREGIVERS THAT ARE COMING TO THE SITE,

[00:40:01]

UH, VISITORS THAT MIGHT BE COMING TO THE SITE, OTHER MEDICAL PROFESSIONALS THAT MIGHT, UH, COME TO THE SITE, UH, THEY WILL UTILIZE, UH, THEIR INTENT IS TO UTILIZE THAT ROUND A CIRCULAR DRIVEWAY, UH, TO FACILITATE PARKING, UM, AS WELL AS, UM, A SMALL PIECE TO THE SIDE, THAT'S ALSO ON SITE, UH, TO FACILITATE ANY ADDITIONAL, UM, PARKING NEEDS.

UM, SO IF THAT IS THE CASE, OH, CAN WE GO BACK ON ONE SLIDE, IF THAT IS THE CASE? UM, THEN THAT IS THE CLARIFICATION AS REQUESTED, UM, IN THE STAFF REPORT AND THE COMMISSION, UH, THROUGH THIS DISCUSSION CAN TALK ABOUT WHETHER OR NOT THAT WOULD BE SUFFICIENT MEASURES FOR PARKING, AND THEN IF ANY ADDITIONAL, UH, SCREENING, UH, WOULD BE NEEDED.

UM, ALSO THE CONSIDERATION WAS ON SIGNAGE, UH, TO CLARIFY, UM, AT ASSIST AS A FACILITY WITHIN A RESIDENTIAL AREA, UH, WHETHER OR NOT, UH, SIGNAGE, UH, CONSIDERATIONS, TYPICAL, UH, COMMERCIAL SIGNAGE, UH, SHOULD BE APPLIED.

UM, THE SITE AS IT STANDS, ANY PROPERTY IS SUBJECT TO THE CITY SIGN REGULATIONS.

UM, AND SO THE STAFFER RECOMMENDATION WOULDN'T CHANGE THAT, UM, BUT WOULD, UM, RECOMMEND THAT IF SIGNAGE IS ADDED, UH, THAT, UH, ELECTRONIC SIGNAGE CHANGEABLE MESSAGE SIGNAGE, UH, WOULD NOT MEDIATE, UH, FOR THIS LOCATION AND THE CLARIFICATION.

CAUSE I KNOW WE HAVE A LOT OF, UM, PUBLIC LISTENING, UM, AND ALSO, UM, WAITING TO SPEAK ON THIS TOPIC.

UM, THERE ARE NO PLANS IN PLACE RIGHT NOW, ADD ANY SIGNAGE AT, TO THE SITE.

THIS WOULD JUST BE, UH, CREATING THOSE REGULATIONS, UM, YOU KNOW, FOR ANY EVENT THAT, UH, SIGNAGE IS PROPOSED IN THE FUTURE.

NEXT SLIDE, PLEASE.

WHAT WAS INCLUDED, UM, IN YOUR PACKETS WHERE THE MEETING MINUTES, UM, FROM 2014, UH, WHEN THIS WAS PRESENTED ORIGINALLY TO THE COMMISSION, UM, AS WELL AS TO THE CITY COUNCIL.

UM, AND SO IT, UH, PROVIDES SOME OF THE CONCERNS THAT THE PUBLIC WERE RAISED AT THAT TIME.

UM, AS WELL AS, UH, PROTESTS THAT WAS RECEIVED THAT WERE RECEIVED AT THAT TIME.

UM, SOME OF THOSE RESIDENTS ARE ON THIS CALL, UM, AND SOME HAVE PROVIDED A PROTEST AGAIN.

UM, MOST OF THAT HAS BEEN PROVIDED, UH, TO THE COMMISSION, UH, WITH THE COMMENTS THAT HAVE BEEN MADE.

UM, BUT I JUST HIGHLIGHTED ON THIS SIDE, JUST A FEW OF THE AREAS OF CONCERN, OTHER SPIN, CONTINUOUS CONCERN ABOUT, UM, THIS CONTINUALLY BEING A RESIDENTIAL AREA, UM, SURROUNDED BY RESIDENTIAL, AMONG BULL LANE.

UM, YOU HAVE THE BOLTON OF THE STATE'S, UH, RESIDENTIAL AREA, UM, THE CRAVENS VILLAGE, A RESIDENTIAL AREA, A CRESTMONT, UM, PLACE, UM, RESIDENTIAL AREA.

UM, AND SO, UH, BOAT MISSTATES BULL LANE, UM, THOSE ARE, UM, UH, MATURE, UH, RESIDENTIAL AREAS THAT, UM, HAVE BEEN IN THE CITY FOR A VERY LONG TIME.

UM, SO THERE'S A LOT OF LONG-TERM RESIDENTS THAT LIVE IN THAT AREA.

UM, AND SO THEIR CONCERN IS ON, UM, BUSINESS OPERATIONS, UM, WHETHER THIS IS THE FIRST OF MANY, UM, OR JUST, UM, CHANGING THE CHARACTER OF THAT AREA.

ALSO, WHAT'S BEEN BROUGHT UP IS TRAFFIC, UM, TRAFFIC CUTTING THROUGH ADAMS STREET, NOT NECESSARILY TIED TO THIS FACILITY, BUT JUST, UM, WHAT IMPACT ON PLACING A BUSINESS, UM, ALONG IN ADAM STREET MIGHT HAVE, UH, TO THOSE TRAFFIC'S CONCERNS.

UM, AND THEN THERE WAS ALSO DISCUSSION CONCERNING SITE PARKING ACCOMMODATIONS, UM, FOR A PERSON WHO MIGHT BE VISITING THE FACILITY.

UH, SO THAT'S JUST A SUMMARY OF THOSE CONCERNS.

UM, AGAIN, THERE ARE A PUBLIC MEMBERS OF THE PUBLIC THAT HAVE SIGNED UP TO SPEAK, AND I KNOW THAT THEY WILL EXPRESS THEIR CONCERNS AS WELL.

AND THEN, UM, AS I MENTIONED, THE APPLICANT HAS A SMALL PRESENTATION, UM, THAT THEY WOULD LIKE TO SHARE, UH, WITH THE COMMISSION.

SO IF THE COMMISSION IS OPEN TO THAT, THAT'S GOING TO BE THE NEXT SERIES OF SLIDES.

JENNIFER, YOU CAN MOVE FORWARD WITH THE PRESENTATION.

THAT WILL BE FINE.

OKAY.

AND THEN I THINK, UM, MRS. STEWART, YOU WERE ON THE LINE, ARE YOU WHO WHO'S GOING TO WALK THROUGH THOSE SLIDES? HI, JENNIFER, IT'S JO STEWART.

IT WILL BE OUR INITIAL STORE THAT WE'LL BE PRESENTING THIS EVENING.

THANK YOU GUYS FOR THE OPPORTUNITY EVENING, EVERYONE.

MY NAME IS ALISHA STUART.

I WANTED TO SPEAK TO YOU.

I'M ONE OF THE OWNERS AT COZY LIVING COMMUNITY, AND I WANTED TO ADDRESS, UH, WHAT WE ARE, UH, AS A COMPANY, UH, WHAT OUR MISSION IS, UM, ADDRESS WHAT WE DO AS AN ASSISTANT LIVING FACILITY.

[00:45:01]

UM, AND HOW WILL WE DIFFER FROM NURSING HOMES AND BOARDING HOMES AND, UM, ALSO ADDRESS SOME OF THE ISSUES THAT HAVE COME UP.

SO I WANT TO FIRST START BY TELLING YOU A LITTLE BIT ABOUT OUR VISION, AND I WOULD JUST READ VERBATIM OUR MISSION STATEMENT AND OUR VISION, BUT I'M JUST GOING TO SUM IT UP FOR YOU, WHAT OUR GOAL IS.

SO OUR GOAL THAT COZY LIVE IN COMMUNITY IS, UM, TO PROVIDE A HOME-LIKE ENVIRONMENT TO PROVIDE GOOD CARE FOR OUR CLIENTS AND OUR RESIDENTS.

UH, AND ALSO IN DOING THAT, WE WANT TO MAKE SURE THAT OUR FAMILIES HAVE PEACE OF MIND THAT THEIR LOVED ONES ARE BEING TAKEN WELL CARE OF JUST PUTTING MYSELF IN THAT SITUATION.

UM, IN MY LATE THIRTIES, UH, I WORK WITH MY PARENTS THEY'RE THEY'RE SENIORS.

SO IF, AND WHEN THAT TIME COMES, THAT THEY NEED TO BE PLACED IN THE FACILITY, I DEFINITELY WANT TO HAVE PEACE OF MIND THAT THEY'RE WELL TAKEN CARE OF THAT I CAN SLEEP AT NIGHT OR I'LL BE UP THERE EVERY DAY, TRYING TO FIGURE OUT WHAT'S GOING ON.

SO THAT IS OUR GOAL.

UM, AND I CAN HONESTLY SAY THAT I FEEL LIKE THAT WE ARE DELIVERING THAT AND MY MEASUREMENTS ARE THE TESTIMONIES THAT WE HAVE ON OUR WEBSITE.

UM, AND ALSO JUST THE FACT THAT WE REALLY HAVEN'T DONE ANY MARKETING, UM, AND FAMILIES HAVE JUST BEEN SHARING WITH OTHER PEOPLE.

AND WE'VE BEEN SAYING, YOU KNOW, 85% FULL MOST OF THE TIME.

SO BEFORE I MOVE TO THIS SLIDE, I HAD ANOTHER PRESENTATION.

SOME OF MY SLIDES GOT LOST.

SO BEAR WITH ME THE SLIDE BEFORE THIS WAS JUST TO KIND OF GIVE YOU A FEEL OF HOW WE GOT STARTED.

AND I WANTED TO SHARE MY MOTHER'S STORY BECAUSE THIS IS WHERE THE WHOLE VISION CAME FROM, BUT SHE SAID HER STORY WAS A LITTLE TOO LONG.

SO I'M GOING TO SHOW YOU MY STORY.

SO, UM, MY STORY IS A CONTINUATION OF HERS.

UM, ONE OF MY FONDEST MEMORIES AS A CHILD IS HER WORKING.

SHE'S A REGISTERED NURSE AND I AM TO HER WORKING AS A REGISTERED NURSE DOING IB INFUSIONS AND VISITING NURSING HOMES.

AND SHE TRAVELED A LOT AND SHE WOULD BRING BOTH ME AND MY BROTHER WHO WAS ABOUT FOUR YEARS OLDER THAN ME.

AND WE WOULD WAIT FOR HER AND WHILE WE'RE WAITING, WHAT CARE CARE FOR THE ELDERLY.

AND WE JUST HAD VERY GOOD PLEASURE IN THAT BECAUSE JUST THEY BRIGHTENED UP WHEN WE WERE THERE AND THEY JUST KIND OF ACCEPTED US AS FAMILY.

AND WE REALLY ENJOY THAT.

AND THAT'S A MEMORY THAT I, I TAKE ALONG WITH ME AND I EVENTUALLY TOOK THAT SAME PASSION AND BECAME A REGISTERED NURSE AS WELL.

UM, I DO ENJOY CARING FOR OTHERS.

WE ALL DO.

AND THAT'S KINDA WHY WE GOT STARTED, BUT EVEN NOW, SO I'M ACTUALLY LIVING OUT THAT DREAM BECAUSE, UM, WE'RE, I'M ABLE TO TOUCH MORE PEOPLE.

AND I JUST KEEP GOING BACK TO THAT VISION, UM, BEING IN A NURSING HOME AND, AND CARING FOR THEM AND MAKING THEM SMILE.

AND, UM, ALONG WITH THAT, I HAVE THE PLEASURE OF BEING ABLE TO DO IT ALONGSIDE MY MOM.

SO NOW I'M GOING TO TALK A LITTLE BIT ABOUT HOW WE DIFFER.

WE TEND TO GET GROUPED, UH, ASSISTANT LIVING FACILITIES, BUT TEND TO GET GROUPED IN EITHER A NURSING HOME CATEGORY OR A PERSONAL CARE HOME OR A BOARDING HOME, BUT THERE IS A DIFFERENCE.

AND SOME OF THE DIFFERENCES I'M GOING TO START WITH NURSING HOME FIRST, UM, MOST PEOPLE ARE AWARE OF WHAT NURSING HOMES ARE.

THEY ARE SKILLED NURSING FACILITIES.

SO A LITTLE BIT MORE INSTITUTIONALIZED THAN WHAT AN ASSISTED LIVING FACILITY IS.

UM, WE, WE WANT OUR FACILITY TO BE LIKE HOME LIKE THAT THERE, THAT THERE'S THEIR HOME, AS OPPOSED TO AN INSTITUTION.

WE DON'T PROVIDE ANY SKILLED NURSING CARE THERE.

SO IT'S MORE ABOUT ASSISTING IN ACTIVITIES OF DAILY LIVING, LIVING, SUCH AS BATHING, UM, GROOMING, UH, ANYTHING THAT, YOU KNOW, MOST, MOST OF US TAKE FOR GRANTED THAT, UM, MAYBE SOME OF THE SENIOR CITIZENS OR DISABLED WOULD NEED SOME HELP WITH, UH, NURSING HOMES CAN TAKE CARE OF BEDRIDDEN INDIVIDUALS.

UH, WE CANNOT, UM, THEY HAVE 24 HOUR MEDICAL CARE AND MENTAL HEALTH SERVICES AND EMERGENCY SERVICES, AND AGAIN, ASSISTED LIVING FACILITIES OR JUST PROVIDING ASSISTANCE.

SO I'M GOING TO GO OVER TO GROUP TWO BOARDING HOMES AND GROUP HOMES, WHICH WE TEND TO BE CLASSIFIED A LOT WITH.

UM, UNFORTUNATELY BOARDING HOMES DO GET A BAD REP.

UH, THEY ARE THE DIFFERENCE BETWEEN US AND ASSISTANT LIVING FACILITIES IS THEY ARE UNLICENSED FACILITIES.

SO THERE'S NO REGULATION FOR BOARDING HOMES, UH, AND NO INSPECTIONS, UM, AS OPPOSED TO ASSISTANT LIVINGS, UH, LIVING FACILITIES, WE ARE LICENSED BY HHSC.

UH, WE DO HAVE REGULATIONS AND, AND ANNUAL INSPECTIONS THAT WE DO HAVE TO GO THROUGH.

UH, SOME OF THE GOOD ONES ARE CERTIFIED BY THE CITY.

UM, THEY HAVE BEEN FOUND TO HAVE THREE TO 20 PLUS INDIVIDUALS.

UM, SOME OF YOU MAY BE AWARE OF ONE OF THE MOST RECENT EVENTS THAT HAPPENED ON THE NEWS WHERE ASSISTANT LIVING, I MEAN, NOT AN ASSISTANT, A BOARDING HOME

[00:50:01]

AT, I BELIEVE 42.

I'M HOPING I'M QUOTING THAT CORRECTLY UP TO 42 RESIDENTS IN THAT FACILITY.

AND THE BEDS WERE JUST KIND OF LINED UP AND STACKED ALL OVER THE PLACE.

UM, ONE OF THE REASONS WHY THESE FACILITIES GET SLID THROUGH IS BECAUSE THEY ARE UNLICENSED AND THEY'RE NOT BEING REGULATED.

UM, ALSO WITH THAT NO STAFFING REQUIREMENTS OR FOR, UH, BOARDING HOMES, THEY DON'T HAVE ANY STAFFING REQUIREMENTS.

SO, UM, NO, UH, REQUIRED AN ANNUAL, UM, TRAINING OR INITIAL TRAINING FOR THE STAFF.

AND ALSO AS THERE'S NO REQUIREMENTS ON CRIMINAL BACKGROUNDS AS WELL, WHEREAS ASSISTING LIVING FACILITIES, PART OF MY LITTLE THING IS CUT OFF.

UM, WE ARE LICENSED FACILITY ARE A LICENSED FACILITY, SO WE ARE REQUIRED TO GO THROUGH, UM, HEALTH AND SAFETY INSPECTIONS.

UM, SOME OF THAT STUFF WAS CUT OFF.

WE HAVE FIRE ALARMS AND WE HAVE FIRE ALARMS AND THE FIRE SPRINKLERS FOR SAFETY ISSUES.

WE'RE REQUIRED TO HAVE MONTHLY FIRE DRILLS.

UM, AGAIN, WE ARE STRICTLY PROVIDING ASSISTANCE WITH ACTIVITIES OF DAILY LIVING.

SO I THINK ONE OF THE CONCERNS THAT, UM, SOME PEOPLE MAY HAVE HAD IS, IS THE NOISE LEVEL, AS FAR AS, UM, JUST A LOT OF, UH, AMBULANCE COMING THROUGH OR MEDICAL CARE, PASS THEM BACK AND BACK AND FORTH.

UH, OUR CLIENT POPULATION IS AGAIN, SENIORS AND ELDERLY AND DISABLED.

THE ACUITY LEVEL IS NOT THAT HIGH.

SO IF IT IS, IT DOES COME TO THE POINT WHERE THEIR ACUITY LEVEL IS THAT HIGH, WHERE THEY HAPPEN TO HAVE, YOU KNOW, DIFFERENT TRAFFIC BACK AND FORTH, THEY WOULD HAVE TO BE MOVED TO A MORE APPROPRIATE FACILITY.

ASSISTED LIVING FACILITIES CAN NOT HAVE THAT TYPE OF CLIENTELE THERE.

SO AGAIN, THIS IS JUST FOR, UH, INDIVIDUALS WHO REQUIRE ASSISTANCE, UM, CRIMINAL BACKGROUNDS, WE ARE REQUIRED.

CAN YOU GO BACK A SECOND? WE ARE REQUIRED TO HAVE CRIMINAL BACKGROUND CHECKS, UM, FOR ALL OF OUR STAFF, UH, THEY'RE ALSO PASSED THROUGH A MISCONDUCT REGISTRY AS WELL AS IMMUNIZATION REQUIREMENTS.

UM, THEY HAVE REQUIRED TRAINING, UH, ONE OF THEIR, THE INITIAL, THEY HAVE A FOUR HOUR INITIAL TRAINING.

IT INCLUDES INFECTION, CONTROL, DISASTER PLANNING, UH, HIPAA.

I'M PRETTY SURE I'M FORGETTING SOMETHING, RESIDENTS RIGHTS.

UM, SO THAT'S A REQUIREMENT EVEN BEFORE THEY GET STARTED, THEN THEY'RE REQUIRED TO HAVE EIGHT HOURS ON THE JOB TRAINING AND THEN SIX HOURS ANNUAL TRAINING.

UM, THEY'RE REQUIRED TO HAVE TRAINING AND CPR IN CASE OF A MEDICAL EMERGENCIES.

SO A LOT OF SAFETY CONCERNS ARE ADDRESSED.

UM, ONE OF THE THINGS THAT IS, UH, SPECIFIC TO US IS THAT WE ARE OWNED AND OPERATED BY TWO REGISTERED NURSES.

UM, MY MOM HAS OVER 40 PLUS YEARS OF NURSING AND I MYSELF HAVE, UH, HAVE 12 YEARS OF NURSING EXPERIENCE.

I HAVE A MASTER'S DEGREE IN NURSING EDUCATION, AND I USE THAT TO TRAIN, UM, ALL OF MY CAREGIVERS.

SOMETIMES I THINK I TRAIN THEM A LITTLE TOO HARD THAT THEY HAVE TO REMIND ME THAT THEY'RE NOT REGISTERED NURSES, BUT WHEN THEY ARE, UM, WELL-TRAINED AND I ALSO HAVE, UH, MY DAD'S WHISPERING IN THE BACKGROUND.

I ALSO HAVE A CERTIFICATION IN GERONTOLOGY AS WELL.

OKAY.

IS THERE ANYTHING ELSE THAT YOU'D LIKE TO SHARE WITH THEM? YES.

SO, UH, JUST A LITTLE BIT MORE ABOUT US.

WE'VE BEEN IN, IN BUSINESS FOR ABOUT FOUR YEARS.

WE'VE BEEN LICENSED BY HHSC FOR THREE.

UH, AGAIN, WE'RE VERY, VERY PASSIONATE AND CARING FOR OTHERS.

UH, IT IS A QUIET AND COMFORTABLE HOME-LIKE ENVIRONMENT, WHICH IS WHAT WE WANT.

WE WANT THEM TO FEEL LIKE HOME.

AGAIN, THESE ARE SENIOR CITIZENS.

THEY'RE VERY QUIET.

UM, NOBODY IS DRIVING.

UM, THEY, THEY DON'T HAVE CARS BACK AND FORTH AND ESPECIALLY DUE TO COVID, UH, WE ARE LIMITING, UH, SOME OF THE VISITS BACK AND FORTH.

UM, WE TAKE PRIDE IN WHAT IT LOOKS LIKE ON THE OUTSIDE.

I THINK THAT WAS ONE OF THE ISSUE TOO.

THESE ARE OLDER PICTURES, SO WE HAVE REALLY SPRUCED UP THE PLACE SINCE THEN.

UM, WE DO TAKE PROUD IN HOW IT LOOKS IN, IN KEEPING UP PROPER, PEELED UP AGAIN WITH SAFETY, WE HAVE A CAMERA SYSTEM AND A SPRINKLER SYSTEM.

THE FACILITY IS WELL LIT.

WE HAVE DUST TO DAWN LIGHT.

UM, AND EVEN IN THE ADVANTAGE, WE DON'T HAVE ANYONE THAT WANDERS, BUT IN THE EVENT THAT SOMEONE DOES, WE DO HAVE SOME ALARMS AND BILLS IF SOMEONE WERE TO WALK OUT OF THE FACILITY.

OKAY.

SO I'M GOING TO ADDRESS SOME CONCERNS.

SO WITH THOSE BEEN IN BUSINESS FOR AWHILE, WE HAVE LEARNED SOME TOUGH LESSONS, SACRIFICE THEN, AND LACK OF SLEEP AND ALL

[00:55:01]

THOSE THINGS.

BUT ONE OF THE THINGS THAT WE TAKE TAKE TO HEART IS CRITICISM.

AND WE KNOW THAT WE GROW THROUGH CRITICISM AND WE WANT TO ADDRESS SOME OF THOSE CONCERNS AND HELP THAT WE CAN, WE CAN EASE SOME OF, SOME OF THOSE CONCERNS.

SO THE FIRST ONE IS SAFETY.

I THINK I TALKED A LITTLE BIT ABOUT ALL OF THE SAFETY ISSUES, AS FAR AS, UM, THE REGULATIONS AND, UH, SPRINKLER SYSTEMS AND BAR FIRE SAFETY AND ALL OF THAT.

UM, SO I'M GOING TO JUMP DOWN TO SIGNAGE.

SO OUR GOAL IS TO PROVIDE A HOME LIKE ENVIRONMENT.

SO WE REALLY DON'T WANT SIGNS THAT WOULD JUST DRAW TOO MUCH ATTENTION.

WE WANT IT TO FEEL LIKE A HOME LIKE ENVIRONMENT.

UM, SO WE DO NOT WANT TO SIGN, UM, TRAFFIC AGAIN, WE DON'T HAVE A LOT OF TRAFFIC COMING BACK AND FORTH.

UH, OUR CLIENTELE DON'T DRIVE, UH, AND THEY DON'T REQUIRE A LOT OF MEDICAL TREATMENT.

AND IN FACT, COVID KIND OF HELPED US OUT AS WELL, UH, BECAUSE ALL OF THE DOCTOR'S VISITS HAVE GONE VIRTUAL, UH, WHICH IS GOOD.

SO WE CAN ADDRESS SOME OF THE PREVENTATIVE AND WELLNESS THINGS VIA A VIRTUAL REALLY QUICKLY.

SO THAT ALSO LIMITS SOME OF THE VISITS IN AND OUT.

BUT, UH, EVEN PRIOR TO COVID, WE DIDN'T HAVE A LOT OF VISITS, UH, NOISE LEVEL.

UM, THEY'RE NOT MAKING A LOT OF NOISE.

IT, MOST OF THEM ARE IN BED BEFORE EIGHT O'CLOCK.

SO THAT'S PROBABLY A LITTLE BIT MORE DISTURBING TO US THAN ANYTHING.

UM, AND THEN PARKING WAS THE CONCERN.

UM, UH, YOU GUYS CAN SEE THOSE CIRCULAR DRIVEWAY.

IT HOLDS UP FOUR TO SIX BARS OF THE STATE BREAKS WITH FAR AS TO HAVE ONE PARKING SPOT FOR, UH, EVERY FOUR RESIDENTS.

AND WE MEET THAT REQUIREMENT.

UM, AND AS FAR AS WASTE, TOTALLY VOICE WAS A CONCERN.

WE, UM, ALL OF OUR WASTE ARE BEING MANAGED ON A BUY WITH WEEKLY BASIS.

BI-WEEKLY PICK UP, UM, AND WE, WE DON'T REQUIRE ANY MORE THAN IT.

UM, BEFORE I LEAVE YOU GUYS, I ALWAYS SAY TO ASK FOR WHAT YOU WANT.

SO ONE OF THE THINGS THAT WE'RE ASKING IS TO INCREASE TO A 16 BED FACILITY.

I HAD A SLIDE THAT HAD ONE PICTURE OF BEFORE AND AFTER PICTURE, AND IT WAS THE SAME EXACT PICTURE.

AND THAT'S ONLY JUST TO SHOW THAT WE WON'T BE DOING ANY CHANGES TO THE EXTERIOR.

IT WOULD ONLY BE INTERNAL CONSTRUCTIONS INSIDE THE FACILITY.

WE HAVE ENOUGH SQUARE FOOTAGE TO, TO PROVIDE THAT FOR US.

AND I ALSO WANT TO LEAVE YOU WITH, UM, WE'VE HAD, WE KNOW THAT THERE'S A NEED, IT IS THE AGE FACILITY.

UM, WE'VE ACTUALLY HAD SOME INTERESTS WHERE PEOPLE IN THE, IN THE AREA HAVE COME AND TAKEN A LOOK AND TRYING TO FIND, UM, SOME PLACES FOR THEIR LOVED ONES AS WELL.

AND THEN THE LAST THING I WANT, I WANT TO LEAVE WITH, UH, WAS A QUOTE FOR MY ANGELA, WHAT KIND OF FELL OFF MY POWERPOINT PRESENTATION AND IT, AND IT SAYS, AS YOU GROW OLDER, YOU WILL DISCOVER THAT YOU HAVE TWO HANDS, ONE FOR HELPING YOURSELF AND THE OTHER FOR HELPING OTHERS.

AND WE HAVE THOSE HELPING HANDS WE'RE READY, WE'RE READY TO ASSIST.

AND WE KNOW THAT THERE'S A NEED IN THIS AREA AND WE'RE HERE TO HELP.

OH, AND WE HAVE, WE HAVE ANNA, UH, SHE IS, UH, ONE OF OUR FAMILY MEMBERS AND SHE'S, SHE'S GOING TO SPEAK ON US AS WELL ON OUR BEHALF AS WELL.

OKAY.

HI.

THANK YOU.

THANK YOU SO MUCH FOR GIVING ME AN OPPORTUNITY TO ADDRESS Y'ALL.

I FEEL REALLY STRONGLY ABOUT COZY LIVING.

MY DAD, JUAN MONASTERIO IS A RESIDENT THERE.

MY DAD IS A 90 YEAR OLD KOREAN WAR VETERAN.

SO I'M PARTICULARLY HONORED TO GET TO DO THIS ON VETERAN'S DAY.

MY DAD HAS ALZHEIMER'S.

HE WAS A VERY PROUD STRONG MAN, AND IT'S KIND OF TOUGH THAT, YOU KNOW, HE'S GETTING OLDER NOW AND, UH, AND IT NEEDS THIS LEVEL OF CARE.

WE, HE, HE, HIS NEEDS ARE BEYOND WHAT WE CAN DO IN OUR HOME.

UM, MY DAD'S STILL VERY HIGHLY FUNCTIONING, BUT HIS ALZHEIMER'S HAS MANIFEST IN POOR IMPULSE CONTROL, WHICH MAKES HIM A VERY NOT SUITABLE CANDIDATE FOR A LARGE HOME.

UM, AND HE HAD BEEN KICKED OUT OF TWO HOMES BECAUSE OF NOT BEHAVING HIMSELF.

SO, UH, YEAH, I GUESS I'M GETTING PAID BACK FOR ALL THOSE YEARS.

I WAS AN ANNOYING CHILD NOW, NOW, UH, THE TABLES ARE TURNED.

UM, AND THEN WE GOT, WE FOUND ANOTHER HOME UP IN CONROE.

WE PUT DANNY IN THERE AND IT WAS AWFUL.

UM, MY FATHER LEFT TO SIT IN DIRTY DIAPERS.

UH, THE CARE WAS TERRIBLE.

UM, AND WE HAD TO GET HIM OUT OF THERE.

AND MY DAD'S A TOUGH PLACEMENT AND WE WERE, WE HAD SOMEBODY, UH, RECOMMEND US CONSIDER ONE OF THESE GROUP HOMES AND WE HAD NEVER CONSIDERED IT BEFORE.

AND, UM, MY DAD'S BEEN THERE SINCE, UH, 2018.

I CANNOT EVEN TELL YOU THE LEVEL OF CARE AND DIGNITY THAT MY FATHER HAS BEEN TREATED WITH BY THESE PEOPLE.

AND YES, WE'RE VERY HAPPY TO HAVE HIM IN A HOME SETTING, BUT FOR US, IT HAD GOTTEN TO THE POINT WHERE WE DIDN'T HAVE THE OTHER OPTIONS.

UM, HE'S JUST, HE'S A TOUGH PLACEMENT.

AND THESE SMALL GROUP HOMES ARE ABLE TO CATER

[01:00:01]

TO HIS KNEES AND GUESS WHAT HIS BEHAVIOR PROBLEMS HAVE DISAPPEARED WITH THIS LEVEL OF CARE.

UM, I WOULD, I WOULD URGE YOU GUYS TO CONSIDER ACCOMMODATING THEM THAT THEY CAN EXPAND THE NUMBER OF PEOPLE THAT THEY CAN TREAT IN THAT HOME.

BECAUSE I GOT TO TELL YOU, WE WERE THE FA UH, FAMILY AT THE END OF OUR ROPE WHEN WE FOUND THEM AND THEY HAVE BEEN A GODSEND TO OUR FAMILY.

UM, AND YOU CAN SEE THE PRIDE THAT THE STEWART FAMILY HAS IN THEIR CARE, UH, OF THESE PEOPLE.

UM, I KNOW THAT THEIR RESIDENTS OR NEIGHBORS WHO ARE CONCERNED, BECAUSE THIS IS A BUSINESS, IT'S MY DADDY'S HOME, AND I URGE YOU TO DO THIS.

SO OTHER PEOPLE CAN SAY THE SAME THING.

THANK YOU.

OKAY.

WAIT, WAIT A MINUTE.

MS. JOSEPHINE, MS. JOSEPHINE, HOLD, HOLD ON JUST ONE MINUTE.

WHAT, WHAT WE REALLY WANTED TO HAVE DONE WAS TO HEAR FROM THE APPLICANT, WHICH WOULD BE YOURSELF, AND THEN ANY OTHERS THAT WOULD WANT TO SPEAK, YOU KNOW, WE WOULD HAVE TO TAKE THEM DURING THE PUBLIC COMMENT TIME.

OKAY.

OKAY.

SO, SO, SO HANG ON TO MS. KIM, HANG ON TO HER.

HANG ON.

OKAY.

ALRIGHTY.

NOW, COMMISSIONERS.

UH, WE TYPICALLY GO BACK AND IF WE HAVE QUESTIONS OF THE APPLICANT, ONCE WE'VE HEARD FROM THE APPLICANT SPEAK, WE GET AN OPPORTUNITY TO ASK THE APPLICANT, ADDITIONAL QUESTIONS.

COMMISSIONERS, DO YOU HAVE QUESTIONS OF THE APPLICANT? UH, THIS IS COMMISSIONER BAILEY.

UH, I WAS JUST CURIOUS, UH, I THINK THE UNDERSTAND CORRECTLY THAT YOU'RE ALLOWED UP TO SIX RESIDENTS THERE AT THE FACILITY, AND YOU'RE REQUESTING TO INCREASE THAT UP TO 16.

THAT IS CORRECT.

WE ARE OUR OCCUPANTS OCCUPANCY, ACTUALLY THE MISSOURI CITY OCCUPANTS TO ACTUATE GAVE US UP TO 10 IN OUR FACILITY.

I KNOW THAT MISSOURI CITY THAT SAY THAT WE COULD HAVE SIX TO LIVE IN CAREGIVERS.

WHAT'S THAT NUMBER THEN IS EIGHT, BUT MISSOURI CITY DID GIVE US, UM, ACCURACY FOR 10 AND WE ACTUALLY HAVE A LICENSE.

OKAY.

AND YOU INDICATED THE TEXAS DEPARTMENT OF AGING AND DISABILITY SERVICES CLASSIFIED THAT AS A TYPE B OF FACILITY, IS THAT WHAT IS TYPICALLY THE MINIMUM SQUARE FOOTAGE PER RESIDENT GIVEN THAT CLASSIFICATION? IT'S 80 SQUARE FOOT PER PERSON.

OKAY.

SO 80 TIMES 10 OR EVEN 16, UH, YOU'RE STILL, YOU KNOW, WELL, WITHIN, I THINK THE FOOTPRINT, EVEN WHEN ACCOUNTING FOR OTHER SERVICES, LIKE DINING AND, AND THAT KIND OF THING.

SO IT SOUNDS LIKE YOU'RE OKAY IN THAT RESPECT, CORRECT? CORRECT.

OKAY.

THANK YOU.

YOU'RE WELCOME.

ARE THERE ANY OTHER QUESTIONS FROM THE COMMISSION, THIS, THIS COMMISSIONER OVERTAKE? I WAS WONDERING, HOW DO YOU, HOW DID THE RESIDENTS QUALIFIED TO, UM, BECOME, UH, I GUESS, TO LIVE IN YOUR HOMES? WHAT ARE THE QUALIFICATIONS OF THE RESIDENTS? IF THE QUALIFICATIONS BASICALLY IS LEFT UP TO FAMILY MEMBERS WHEN THEY WANT TO PLACE THEM IN AN ASSISTED LIVING FACILITY, UM, AND IT DEPENDS ON WHAT THEIR NEEDS ARE AND WHETHER WE CAN MEET THOSE NEEDS.

WE DO DO ASSESSMENTS ON EACH ONE OF OUR, UH, POTENTIAL RESIDENTS.

AND IF WE CANNOT MEET THOSE NEEDS, FOR EXAMPLE, IF WE HAD A RESIDENT THAT, UM, WHY IS ON, LIKE FOR EXAMPLE, AN ALS TYPE RESIDENT THAT WAS ON OXYGEN AND HAD HAD LIKE ONE-ON-ONE TYPE OF CARE NEEDS, AND WE KNEW WE COULD NOT MEET THOSE NEEDS, THEN THAT WOULD NOT BE A TYPE OF POINT THAT WE WOULD ACTUALLY ADMIT INTO OUR FACILITY.

SO AGAIN, WE WILL ASSESS THEM INDIVIDUALLY AND, UH, UPON INTO WHAT THOSE NEEDS ARE AND WE WOULD MEET THOSE NEEDS.

AND SO IN A TIGHT V FACILITY, THE, THE RESIDENTS MUST BE ABLE TO GET UP INTO, UH, A WHEELCHAIR.

I'LL GET OUT OF BED FOR AT LEAST TWO HOURS PER DAY, ACCORDING TO HHSC.

UM, THE OTHER THING IS THAT BECAUSE WE ARE SPRINKLES, THE RESONANCE CAN OR CAN, WE CAN ASSIST THEM OUT OF THAT INTO A WHEELCHAIR TO BE ABLE TO TRAVEL.

AND I SAY THAT COMPARISON WITH THE TYPE EIGHT FACILITY, THOSE RESIDENTS IN A TYPE A FACILITY, THEY DON'T HAVE TO HAVE ALL OF THEM HERE NEEDS, BUT AGAIN, TO ANSWER YOUR QUESTION, THE QUALIFICATIONS IS KIND OF BASED UPON

[01:05:01]

AN ASSESSMENT AND ONE, THE FAMILY MEMBER IS GOING TO MOVE THEM IN AND WHETHER THEY FINANCIALLY CAN'T AFFORD TO MOVE INTO THE FACILITY, THERE IS AN INCOME REQUIREMENT IN ORDER MOVE INTO THE FACILITY FROM THE FAMILIES OR THE RESIDENCE.

YES.

CORRECT.

THAT'S CORRECT.

OKAY.

COMMISSIONERS, DO YOU HAVE ANY OTHER QUESTIONS OF THE APPLICANT, JENNIFER? UM, THIS COMMISSIONER LUCAS, I HAVE A QUESTION FOR YOU.

CAN YOU GO OVER IT AGAIN? WHAT IS THE CITY REQUIREMENT FOR AN ASSISTANT LIVING FACILITY NOW? CURRENTLY? YES.

CAN YOU HEAR ME? YES, I CAN.

SO THE, UH, TEXAS, UM, ACT THAT WAS CITED BEFORE, UM, ESSENTIALLY REQUIRES ANY TEXAS COMMUNITY, UM, TO ALLOW FOR, UH, COMMUNITY HOMES THAT MEET CERTAIN QUALIFICATIONS.

AND ONE OF THOSE QUALIFICATIONS IS NO MORE THAN SIX, UH, RESIDENTS WITH TWO CAREGIVERS AND PROVIDED THAT THEY MEET THOSE QUALIFICATIONS THAT ARE SPECIFIED BY THE ACT.

UM, THEN, UH, MUNICIPALITIES HAVE TO TREAT THEM AS SINGLE FAMILY RESIDENCES.

SO IN OUR, UH, DISTRICTS THAT ARE SINGLE FAMILY RESIDENTIAL, THOSE WOULD BE CONSIDERED USES BY, RIGHT.

IF THEY EXCEED THAT NUMBER, UM, OF SIX RESIDENTS TO CAREGIVERS, UM, THEN MISSOURI CITIES, ZONING REGULATIONS, UM, CLASSIFIES IT AS AN INSTITUTION.

UM, AND IT'S UNDER THE INSTITUTION FOR, UM, ELDERLY, UM, FOR DISABLED PERSONS.

AND THAT'S WHERE THE SPECIFIC USE PERMIT, UM, IS REQUIRED, UH, FOR THE LOCATION.

SO THAT'S WHERE IF, UM, THE REQUEST TO INCREASE THE BED NUMBER, UM, INCREASE IT BEYOND, UH, WHAT THE ACT, UH, WOULD ALLOW, UM, REQUIRES THE SUP APPROVAL.

DOES THAT ANSWER YOUR QUESTION? YES, IT DOES.

I JUST WANTED SOME CLARITY ON THAT.

UM, AND FOR, UH, MS. STEWART, THIS IS COMMISSIONER LUCAS.

I HAVE A QUESTION FOR YOU AND, AND MAY HAVE ALREADY ANSWERED IT.

AND JUST IN HERE, IT IS YOUR CURRENT FACILITY, UH, LARGE ENOUGH TO ACCOMMODATE 16 NOW, OR YOU WOULD HAVE TO DO SOME, UM, ADDITION.

WE WOULD HAVE TO DO SOME RENOVATIONS INSIDE THE FACILITY, NOT OUTSIDE THE FACILITY.

SO WE HAVE, YOU KNOW, WHERE FOOTAGE TO ACCOMMODATE 16 RESIDENTS.

YOU SAID THAT WOULD BE DONE ON THE INSIDE.

YOU WOULDN'T, YOU WOULDN'T HAVE TO ADD ON IS JUST REMODELING OR MODIFICATION.

YES MA'AM.

AND SO IT'S REMODELING THE INSIDE OF THE HOUSE.

WE WOULD NOT HAVE TO DO ANYTHING.

IN ADDITION TO THE, OF THE HOUSE, WE CURRENTLY HAVE ENOUGH SQUARE FOOTAGE THAT IS, THAT WOULD SATISFY 16 BEDS WHERE WE'RE REQUIRED TO HAVE A, TO SQUARE UP WITH PER PERSON.

AND YOU GUYS CURRENTLY HAVE 7,000 SQUARE FEET OF LIVING SPACE RIGHT NOW.

SO YOU HAVE MORE THAN ENOUGH SPACE.

SO WHAT KIND OF OUTSIDE SPACE OR WOULD THEY BE CONFINED JUST TO THE END DOORS WHERE THEY TO ANSWER THAT QUESTION? OUR PROPERTY SITS ON 0.8, SIX, I THINK, UH, LAND SPACE.

AND, UM, SO WE, WE HAVE A REALLY LARGE BACKYARD THAT IS A CLOSED IN BACKYARD.

UM, WE HAVE A PATIO THAT A CLOSED END PATIO THAT I CAN'T THINK OF THE SQUARE FOOTAGE, CAUSE THEN WHO WANT TO LIE TO YOU ABOUT THAT.

BUT WE ALSO HAVE, UH, AN OUTDOOR PATIO WITH THAT WALKS OUT TO A WATER FOUNTAIN.

WE'RE LOOKING AT EVEN POSSIBLY PUTTING A WALKING TRAIL IN THE BACKYARD FOR THEM.

WE CURRENTLY RIGHT NOW HAVE, UM, TABLES OUT THERE WITH CHAIRS.

I MEAN, YOU CAN SIT AND IT'S VERY COOL OUT THERE BECAUSE YOU HAVE NICE SHADE TREES, JENNIFER, I JUST HAVE ONE, ONE MORE QUESTION BEFORE WE OPEN IT UP TO THE PUBLIC.

MAYBE, MAYBE I DIDN'T UNDERSTAND THIS QUITE WELL, BUT I THOUGHT I HEARD HER

[01:10:01]

SAY THAT, UM, THEY'RE REQUIRED TO HAVE FOUR PARKING SPACES PER INDIVIDUAL IN THE PROPERTY.

SO IF I'M COUNTING 16 AND THEN PEOPLE THERE TIMES FOUR THAT'S 64 PARKING SPACES, UH, I JUST DON'T SEE HOW WE HAVE 64 PARKING SPACES IN.

CAN YOU HEAR? YES.

MA'AM.

YEAH.

AND I, I BELIEVE YOU ALL SAID ONE, ONE SPACE PER PERSON AND I'LL ASK, SO THAT'S, THAT'S THE LICENSING, UM, REQUIREMENT AND THEN THE CITY'S REQUIREMENT, UM, IS LESS RESTRICTIVE THAN THAT.

SO THE LICENSING REQUIREMENT, UM, THIS IS WHAT'S TRIGGERING THAT.

OKAY.

OKAY.

WONDERFUL.

THANK YOU SO MUCH COMMISSIONERS.

ARE THERE ANY OTHER QUESTIONS OF THE APPLICANT BEFORE WE OPEN IT, UH, TO THOSE THAT ARE IN ATTENDANCE THAT HAVE SIGNED UP TO SPEAK? NO.

OKAY.

THANK YOU SO VERY, VERY MUCH.

UM, WE DO HAVE QUITE A FIT, QUITE A FEW PROTESTS LETTERS IN WITH US ON TONIGHT AND WE, WE HAVE ONE LETTER IN SUPPORT.

SO FOR THOSE THAT HAVE SIGNED UP TO SPEAK, I'M GONNA JUST GO RIGHT DOWN THE LIST.

UM, AND ONCE I SAY YOUR NAME, IF YOU WOULD CHIME IN AND STATE YOUR NAME AGAIN, ALONG WITH YOUR ADDRESS, SO THAT, UH, OUR SECRETARY CAN, CAN CAPTURE YOUR NAME, PLEASE, JOE.

AND IF I MISPRONOUNCE IT, I APOLOGIZE IN O S K E JOE.

I'LL MAKE ONE MORE CALL FOR MR. NASC, J O E N N O S K E.

HE'S ON JUST GIVE HIM ONE MOMENT.

OH, VERY WELL, THANK YOU, MR. .

YOU CAN PLEASE PRESS STAR SIX TO UNMUTE YOUR PHONE, PLEASE.

OKAY.

WHILE HE, UH, TAKES CARE OF THAT.

OKAY.

THERE YOU ARE.

MR. LOSS.

NO, IT'S WORKING.

THERE YOU GO.

OKAY.

GOOD EVENING EVERYONE.

THIS IS JOE NAZI AT 1403 ADAM STREET.

UM, I JUST WANTED TO GO A LITTLE BIT INTO MY PATH HERE.

WHEN I PURCHASED MY HOME, THE PROPERTY NEXT DOOR AT 1405 WAS STILL HELD BY THE PREVIOUS OWNER.

AND, UH, WHEN I WAS PURCHASING, PURCHASING THIS PROPERTY, EVEN WITH THE 20% DOWN PAYMENT, THE LENDER WAS HESITANT TO GIVE A HOME LOAN BECAUSE THE APPRAISER HAD INDICATED THE LARGE PROPERTIES IN THE NEIGHBORHOOD BECOME COMMERCIAL, LIKE OTHER OLDER NEIGHBORHOODS IN HOUSTON.

MY REALTOR POINTED OUT THAT UNLIKE HOUSTON, MISSOURI CITY HAS ZONING ORDINANCES AND MY HOUSE AND THE NEIGHBORHOOD WAS ZONED FOR SINGLE FAMILY.

RESIDENTIAL USE ONLY INDICATED THAT THE ZONING COMMISSION NOT
